Divining Regulatory Intent: The Place For A "Legislative History" Of Agency Rules, Lars Noah

This Article juxtaposes the recent debates about statutory interpretation and the judicial uses of legislative histories with the relative quiescence over methods for interpreting agency regulations. The latter subject merits more attention than it has received given the relatively greater prevalence and practical import of legislative rules issued by administrative agencies as compared with statutory commands from the legislature. Unlike attempts to understand the legislature's original intent, whether by focusing solely on statutory text or considering extrinsic aids found in various pre-enactment explanatory materials, courts routinely defer to agencies' post-promulgation interpretations of the meaning of their regulations. Many researchers believe that nurses live in a dual structure, encompassing both the social and nursing worlds. They contend that these two worlds have contrasting views toward nurses. This is, while nurses are guided to establish professional status, society still expects them to remain in a dependent role. The purpose of this study is to explore and describe the experiences of a specific group of arts workers in an isolated rural community in the South West of Western Australia. These participants have all worked in the community as arts workers for an extended period of time. Transvestism, or the practice of wearing the clothes of the other gender, challenges societal values and guidelines for behaviour. The attitude of society to this practice has varied from veneration to vilification depending on the period of history and the culture of the people. Interactionist theories of second language acquisition (SLA) claim that both comprehensible input and modified interaction in the target language are necessary for language learning. In the foreign language context, little opportunity exists for such input simply through exposure to the target language outside the classroom. Therefore, the quantity as well as quality of input within classrooms is especially important. However in spite of this fact many non-native teachers of second language, including English as a foreign language (EFL) teachers, tend to avoid using the target language in their classrooms. The main advantages and disadvantages of the Telematics environment for talented mathematics students were investigated through a case study. The case study considered the interaction of, and opinions of 11 Year 9 students and the teacher/researcher. Participants were from nine schools in regional Western Australia, and were withdrawn from face-to-face classes to attend mathematics transmissions. Qualitative data were collected through student interviews, an anonymous questionnaire, tape recording of lessons, and teacher field notes. Students all agreed the main disadvantage occurred if timetabling for Telematics transmissions did not align with their local school class times for the same subject. The teacher …

This case study examined lower secondary student attitudes towards social studies and identified the factors that influenced attitudes in one Catholic secondary school located in the Perth metropolitan area. A total of 4 75 students were enrolled in Years 8 to 10 at the school in 1999. A modified version of Student Attitudes Towards Social Studies (Moroz 1996) questionnaire with 94 items, was utilised to gauge secondary student attitudes towards the learning area. This thesis describes the development of the application mapCAST, a computer-based concept-mapping tool that allows synchronous collaboration via TCP/IP networks, such as the Internet The useability and feasibility of mapCAST as a computer-based tool was examined and analysed in a real world situation. Results indicate that mapCAST is successful as a collaborative tool in a situations involving knowledge organisation, but lacks certain functionality that many Macintosh users are accustomed to.

Implementing new curriculum models for the first time can be difficult for teachers, especially those recently graduated. This study captured some of these challenges and difficulties, and the substantial rewards, through recording the teacher's reactions and reflections as he implemented his first season of SEPEP. The perceptions of the students involved in the season were recorded as a way of validating the teacher's reflections. I argue that rather than a technology of liberation as it is often perceived, virtual realities' conception has been influenced significantly by a discourse of control and order. Carl Jung's notion of contrasexuality allows women to embrace the masculine as well as feminine aspects of their personality. This creates a sense of complementarity or balance that is often lacking in the established psychoanalytic interpretation of female representations within mm texts. The 'animus,' or masculine complex, is an empowering theory in understanding representations of women within the filmic text as embarking on a process of self-realisation, self-acceptance, and the discovery of their own authority in the context of their relationships with men. Whilst retaining his accustomed rural geographical environment and civil war historical environment for some stories, he introduces us to urban landscapes and contemporary settings in many others. This study explored the experiences of women working in the adventure recreation industry in Western Australia. Ten women employed in the local adventure recreation industry were selected as a cross-section sample. Selection criteria for this study included employment in the industry for more than five years, competency in several adventure recreation activities and extensive field experience in "hands-on" instructional roles. Through time the dancer has been both celebrated and disadvantaged by antithetical ideas: the division of soul and body, form and matter, life and death, artist and audience. For the romantics, the dancing body stood in a relationship to poetic thought in much the same way as the dancer stood to the body. Notions of the body in early modernism arose from cultural and political constructs through which poets and writers examined the nature of truth. The purpose of this study is to examine the relation between accounting measures of total firm risk and the magnitudes of IPO initial returns. The existing explanations of the underpricing of lPO's suggests that the extent of underpricing is positively related to ex ante uncertainty about the issues. This study argues that accounting risk measures are related to the ex ante uncertainty. Since ex ante uncertainty is positively related to IPO underpricing, accounting risk measures are also arguably related to IPO underpricing. An event methodology is employed in this study. The purpose of this practicum was to develop, implement, and assess a plan for reducing the number of freshmen at the high school who failed the grade, with failure being defined as the inability to earn 4 credits within 1 year. From the 1993-1994 school year until the 1997-1998 school year, an average of 17.7% of the 9th-grade class had to repeat the grade. Through the year-long implementation of the plan called the Freshman Connection program, the researcher hoped that the failure rate of 21.9% in 1998 would be reduced to 10.0% in 1999.

Although the Congressional fight over the North American Free Trade Agreement (NAFTA) may have ended when the NAFTA Implementation Act passed by a narrow margin, the controversy surrounding NAFTA has not. In Made in the USA Foundation v. United States, the United Steel Workers of American and others asserted that NAFTA was void because it had been approved as a congressional-executive agreement when it should have been approved as a treaty under Article II, Clause 2 of the U.S. constitution.
