The Overlooked Concern With The Uniform Computer Information Transactions Act, Katy Hull

This Note examines the concerns surrounding the Uniform Computer Information Transactions Act ("UCITA"), a uniform commercial code for software licenses and other computer information transactions proposed by the National Conference of Commissioners on Uniform State Laws. Since case law addressing software licensing is currently inconsistent, some scholars believe that this uniform, nation-wide set of laws would provide for greater stability and predictability. Still, some critics of the UCITA worry that it fails to address consumer protection concerns. Few criticisms, however, have focussed on the UCITA's potential impact on the software licensing industry. Due to the growing importance of that industry …

Government "speaks" both directly through its own pronouncements and indirectly through funding private speech. Many scholars of both political theory and constitutional law have argued that government should not use its persuasive powers to promote contested notions of the good life. Whether the issue is providing information about childbirth without also providing information about abortion or insisting on adherence to decency standards when awarding cultural grants, scholars generally have maintained that government should avoid taking sides.

In this Article, Professor Greene supports the contrary position, advocating a vigorous role for government speech even in areas of great social contest. Government …

The purpose of his study was to examine the characteristics of the Professional Development School partnership between Indiana State University and several local school sites to determine the extent of institutional commitment, the roles which are valued and practiced by university liaisons, and the types of collaborative inquiry research which are conducted by university and school personnel. A survey of school teachers within PDS school sites was conducted to elaborate on the perceptions and opinions about the function and results of the PDS partnership. This study explores a concept for applying basic packaging materials to an environment of high vacuum. This study identified three basic packaging materials and exposed them to a high vacuum environment to identify visual effects caused by the vacuum. In semiconductor and data storage industries, the machinery needed to ultimately create a computer chip often contains vacuum chambers. A common practice of the industry is to ship this machinery while under a state of high vacuum. Luminesence Study Of Polymer-Copolymer Blends Using A Carbazole/Iodine Probe/Quencher System, Tammy Davis

The miscibility behavior of binary blends of polystyrene (PS), poly(methyl methacrylate) (PMMA) and their copolymers was re-evaluated using the luminescence of carbazole (Cz) and its quenching by 4-iodoaniline (I). The chromophore and quencher probes were polymerized into the polymers and copolymers to be blended. These experiments were conducted at room temperature, on thin films, and were compared to the published results of Braun, et. al.13Homopolymer/copolymer blend compositions were selected from regions of miscible, partially miscible, and immiscible phase behavior. The quencher molecule, 4-iodoaniline, was derivatized to form the vinylfunctionalized monomer, N-(4-iodophenyl)maleimide (NIPMI). The synthesis of NIPMI was carried out in …

This article critically discusses the representations of language that, since the 1980s, have been informing language policy in Galicia. Data from Galicia´s Sociolinguisic Map are re-analyzed and an argument is made that current language policies are grounded in a misinterpretation of how speakers map language on to identity.

The Presentation Of Gender-Based Sexuality Scripts In Sex Education Films, Patricia Anne Drew

The manifest purpose of sex education films is to transmit factual information about sexuality to schoolchildren. However, films additionally contain covert messages informing students of proper and improper sexual roles. Films can reinforce patriarchal gender-differentiation within the sexual realm or, alternately, films can promote commensurate, non-patriarchal gender scripts for sexuality. This paper researches the ideological gender messages set within and transmitted by sex education films. Although sex education films represent only a small part of the sexual culture, the trends revealed in the films may indicate general parameters of US sexual culture.

The Long-Term Viability Of A Zero-Valent Iron Permeable Reactive Barrier, Stuart Cowburn

Zero-valent iron permeable reactive barriers (PRB's) hold significant potential as a tool for groundwater remediation. Uncertainties remain, however, as to the effective lifetime of Fe0 barrier technology under full-scale operational conditions. Potential limits on barrier lifetime include reductions in permeability due to clogging by precipitates and oxidation of all Fe0 prior to the exhaustion of the contaminant source.

A 46 m long, 0.6 m wide, and 7.3 m deep Fe0 PRB was installed at the US Coast Guard Support Center, Elizabeth City, NC, in June 1996. The barrier was designed to remediate groundwater principally contaminated with Cr(VI) …

Large-scale wildlands reserve systems offer one of the best hopes for slowing, if not reversing, the loss of biodiversity and wilderness. Establishing such reserves requires both sound biology and effective advocacy. Attempts by The Wildlands Project and its cooperators to meld science and advocacy in the service of conservation is working, but is not without some problems. Scientists and advocates have differences in methods of work, different understandings of the origins and place of values in conservation, and differing expectations about the efficacy of biological information in achieving protection. Master of Urban and Regional Planning Workshop Projects

This project evaluated the recent construction of a public skatepark located in Tualatin Community Park. The skatepark is unique because a group of underrepresented youth initiated the idea of constructing it and helped bring it to fruition. The city has expressed a desire to see this level of energy and commitment duplicated in other youth-oriented initiatives, but needs to have a better understanding of how the skatepark project served as a positive youth development tool. In support of young people, the Tualtin City Council recently named youth issues as a "first tier" priority.

This book was prepared over a period of two years. Most of us have worked together previously as members of an advisory committee for “College Age Youth,” a W.K. Kellogg Foundation initiative to develop leadership abilities in college undergraduates at 31 institutions. That program demostrated that colleges and universities can provide highly effective environments for the development of future leaders (Zimmerman-Oster & Burkhardt, 1999). The idea of writing a book that could address the application of transformative leadership to higher education was first conceived in November 1997. In 1999, a federal jury, in the case of Planned Parenthood v. American Coalition of Life Activists, returned a verdict in plaintiff's favor to the tune of $100 million. At issue was whether the Web site known as The Nuremberg Files, as well as printed "wanted style" posters dubbed The Deadly Dozen, both listing personal information regarding abortion physicians, were "threats" under The Freedom of Access to Clinic Entrances Act of 1994 (FACE).

FACE imposes liability on any person who intimidates or attempts to intimidate by force or threat of force any person because that person provides reproductive health services. …

Clinical legal education has rapidly evolved from a novelty or boutique offering in law school curricula to a relatively settled and accepted component of the academy. Much has been written about the composition of law and university faculties, the value of faculty diversity in university and traditional law school educational settings, and proposals for reform.
