Executive Privilege And Interbranch Comity After Clinton, Jonathan L. Entin Apr 2000

Executive Privilege And Interbranch Comity After Clinton, Jonathan L. Entin

William & Mary Bill of Rights Journal

Although both constitutional theory and practical considerations offer powerful reasons for Congress and the President to prefer negotiation rather than litigation of separation of powers disputes, the Clinton Administration litigated and lost several important cases dealing with presidential power. Some commentators have suggested that these rulings will undermine the presidency for years after Clinton leaves office. Professor Entin assesses some factors, notably the phenomenon of divided government, that might have contributed to the difficulty of reaching interbranch accommodations in recent years and suggests that the long-term implications of the adverse judicial rulings may be less severe than the pessimists fear.

Why Continental Jurists Should Consult Their Transatlantic Colleagues, Mathias Reimann Apr 2000

Why Continental Jurists Should Consult Their Transatlantic Colleagues, Mathias Reimann

Law Quadrangle (formerly Law Quad Notes)

The idea of codification has proved to be amazingly resilient. In its modern form, it was originally the child of the 18th century marriage between the law of reason and enlightened absolutism. It was adopted and refined by 19th century conceptual jurisprudence, liberalism, and republicanism. It survived even the 20th century with its mass democracy and totalitarian regimes, social and regulatory state, and consumer society. Thus, there is every reason to believe that it will be with us in the 21st century as well. This is particularly true in continental Europe. In most countries there, the traditional civil codes have …

Thinking, Thought And Nous In Aristotle's De Anima, Michael Bowler Apr 2000

Thinking, Thought And Nous In Aristotle's De Anima, Michael Bowler

The Society for Ancient Greek Philosophy Newsletter

Michael Wedin in his “Tracking Aristotle’s Nous’’ wishes to argue that the most plausible interpretation of De Anima, Book III, chapter 5 is . .that these chapters provide the essentials of a thoroughly finitistic account of individual noetic activity.” I want to argue that Wedin’s account is not the most plausible interpretation of Aristotle’s theory of individual noetic activity. I think Wedin’s interpretation misses a crucial distinction between the actualization of mind and the being of mind, insofar as he argues that mind is identical simpliciter with its object in the act of knowing when in fact, for Aristotle, mind …

Getting Their Feet Wet: The Supreme Court And The Practical Implementation Of Treaty Rights In The Marshall Case, Phillip Saunders Apr 2000

Getting Their Feet Wet: The Supreme Court And The Practical Implementation Of Treaty Rights In The Marshall Case, Phillip Saunders

Dalhousie Law Journal

Judicial decisions which recognize aboriginal or treaty rights to natural resources inevitably lead on to a process of negotiation, as governments and aboriginal and other users of the resource define the access and management regimes which allow for practical implementation of the legal rights. Courts should be cognizant of the impact of their decisions on such negotiations, and provide adequate clarity and substantive guidance to negotiators. This article considers the decisions of the Supreme Court of Canada in the Marshall case from this perspective, and details the shortcomings which made the prospects for successful negotiations less favourable. The weaknesses in …

Journal of the National Collegiate Honors Council Online Archive

Just after 9 p.m., I climbed abroad a Continental Trailways bus and stared through green glass as my parents watched the second of their two sons head off to college. Leaving the station, the bus moved into the bayous of south Louisiana along old Highway 90, then over the swamps and across rice and sugar cane fields and on through a night of small towns, finally climbing the Sabine River bridge into Texas, where a mileage marker announced New Mexico 878 miles. That should give any young man enough room.

Expanding Directions, Exploding Parameters: Culture And Nation In Latcrit Coalitional Imagination, Elizabeth M. Iglesias, Francisco Valdes Apr 2000

Expanding Directions, Exploding Parameters: Culture And Nation In Latcrit Coalitional Imagination, Elizabeth M. Iglesias, Francisco Valdes

University of Michigan Journal of Law Reform

The articles and commentaries in this Symposium are excellent points of departure for reflecting upon the advances thus far achieved in the evolution of this still very young community of scholars. The articles and commentaries that follow this brief Introduction comprise the second "free-standing" law review Symposium on LatCrit theory organized specifically in response to student interests and initiatives. The timing is fitting, for this Symposium also coincides with the fifth anniversary of LatCrit theory's emergence in the American legal academy. Since then, five annual conferences and four additional colloquia have produced, in total, nine published symposia in both mainstream …

Silence And Silencing: Their Centripetal And Centrifugal Forces In Legal Communication, Pedagogy And Discourse, Margaret E. Montoya Apr 2000

Silence And Silencing: Their Centripetal And Centrifugal Forces In Legal Communication, Pedagogy And Discourse, Margaret E. Montoya

University of Michigan Journal of Law Reform

Language and voice have been subjects of great interest to scholars working in the areas of Critical Race Theory and Latina/o Critical Legal Theory. Silence, a counterpart of voice, has not, however, been well theorized. This Article is an invitation to attend to silence and silencing. The first part of the Article argues that one's use of silence is an aspect of communication that, like accents, is related to one's culture and may correlate with one's racial identity. The second part of the Article posits that silence can be a force that disrupts the dominant discourse within the law school …

The Paradox Of Silence: Some Questions About Silence As Resistance, Dorothy E. Roberts Apr 2000

The Paradox Of Silence: Some Questions About Silence As Resistance, Dorothy E. Roberts

University of Michigan Journal of Law Reform

In Part I, I note the difficulty in distinguishing between silencing and silence as resistance. This difficulty has often led people in power to misinterpret the silence of people of color. Part II further explores the complications of incorporating the study of silence into resistance scholarship. I illustrate this complexity by discussing the silencing of welfare mothers and the use of language by women of color to challenge dominant medical discourse. Part III considers Professor Montoya's proposal to use silence as a pedagogical tool. Continuing my examination of silence as both liberating and accommodating, I distinguish between silence in the …

Factor Analysis Of Theological Constructs Related To Fatalism And Free Will, M. Ardell Broadbent Apr 2000

Factor Analysis Of Theological Constructs Related To Fatalism And Free Will, M. Ardell Broadbent

Issues in Religion and Psychotherapy

A questionnaire was used to determine to what degree members of the Church of Jesus Christ of Latter-day Saints endorse doctrinal statements concerning foreknowldge and determinism. A factor analysis of the questionnaire results confirmed lay constructs about an apparent polarization between members who hold strictly literal interpretations of omniscience and omnipotence as opposed to those who hold interpretations further removed from mainstream Christendom but whose positions are validated by LDS doctrine. The relation of demographic variables to the constructs was explored. The existence of simultaneously held conflicting beliefs was confirmed. Some implications for LDS therapists are discussed. A historical overview …

Settlement Patterns And The Origins Of African Jamaican Society: Seville Plantation, St. Ann's Bay, Jamaica, Douglas V. Armstrong, Kenneth G. Kelly Apr 2000

Settlement Patterns And The Origins Of African Jamaican Society: Seville Plantation, St. Ann's Bay, Jamaica, Douglas V. Armstrong, Kenneth G. Kelly

Faculty Publications

Archaeological and historical research at Seville Plantation, Jamaica, are used to explain changes in settlement patterns within the estate's African Jamaican community between 1670 and the late nineteenth century. Sugar plantations, such as Seville, are marked by well-defined spatial order based upon economic and power relations that was imposed upon enslaved communities by planters and managers. Archaeological evidence is used to explore how enslaved Africans modified this imposed order and redefined boundaries in ways that correspond with the development of a distinct African Jamaican society. The rigidly defined linear housing arrangements initially established by the planter, and their relations to …
