Who Should Control The Decision To Call A Witness: Respecting A Criminal Defendant's Tactical Choices, Rodney J. Uphoff
Who Should Control The Decision To Call A Witness: Respecting A Criminal Defendant's Tactical Choices, Rodney J. Uphoff
Faculty Publications
A law student approached me not long ago to discuss a problem he had encountered while helping to prepare a criminal case for retrial. The defendant's first trial ended with a hung jury. The defendant, Steven Brown, now faced a second trial on the same misdemeanor charge of assaulting a police officer. Although the defendant still wanted to go to trial, Brown told defense counsel that he did not want his elderly father to have to testify again. From defense counsel's standpoint, the father's testimony was critical because he was the only witness corroborating the defendant's version of the event. …

The "Darden Dilemma": Should African Americans Prosecute Crimes?, Kenneth B. Nunn
The "Darden Dilemma": Should African Americans Prosecute Crimes?, Kenneth B. Nunn
UF Law Faculty Publications
Christopher Darden (prosecutor in the O.J. Simpson trial) has come to epitomize the burdens that African American prosecutors face as they perform their professional tasks. Moreover, the "Darden Dilemma" has become a generic term for the anguish that these prosecutors endure as they negotiate between competing allegiances to the African American community and the State. Much has been written about the sense of isolation that African American prosecutors feel when confronting the conflict between their roles as prosecutors and their obligations to the African American community. This article argues that African Americans should not prosecute crimes in the current criminal …

Marshalling Principles From The Marshall Morass, Leonard Rotman
Marshalling Principles From The Marshall Morass, Leonard Rotman
Dalhousie Law Journal
The Marshall case is the latest in a long series of Supreme Court of Canada decisions concerned with the interpretation of treaties between the Crown and aboriginal peoples in Canada. While the majority and minority judgments agreed on the principles of treaty interpretation to be applied in the case, the significant divergence in opinion between the majority and minority decisions provides important commentary on the differences between articulating and applying these principles. The Marshall case is also noteworthy for the manner in which it addresses similarities and differences pertaining to aboriginal and treaty rights. Because of these various traits, the …
Was Amerindian Dispossession Lawful? The Response Of 19th-Century Maritime Intellectuals, D G. Bell
Was Amerindian Dispossession Lawful? The Response Of 19th-Century Maritime Intellectuals, D G. Bell
Dalhousie Law Journal
In the half-century ending about the time of Confederation a dozen writers addressed awkward questions about an earlier generation's dispossession of Maritime Amerindians from land and resources: had it been lawful; if so, how; if not, what should be done? In the main they approached it as an abstract question, divorced from those particulars of local history that would become the focus of late-20th-century investigation. Those who theorized that English tradition made dispossession lawful did so with reference to the doctrine of "discovery" or to the proposition, grounded in Locke and accepted widely in colonial public opinion, thatAmerindian possession of …
American Advice And New Constitutions, Cass R. Sunstein
American Advice And New Constitutions, Cass R. Sunstein
Chicago Journal of International Law
The early 1990s were among the most extraordinary periods for constitution-making in the history of the world. Several people at the University of Chicago Law School played a role in this period, mostly as observers, to some small degree as participants. The editors of this Journal have asked me for some brief reflections on this remarkable time; I am grateful to have been asked and happy to oblige. This is an impressionistic essay, but I do have a principal theme. It involves the conflict between what might be called pragmatic and expressive conceptions of constitution-making and constitutionalism. Americans generally tend …

A Socio-Cultural Comparative Study Of Freshmen Of Mexican Descent Attending Western Michigan University, Diane M. Ariza
A Socio-Cultural Comparative Study Of Freshmen Of Mexican Descent Attending Western Michigan University, Diane M. Ariza
Dissertations
Institutional racism, encouraged assimilation, and ignorance of Latino/a values are current barriers to the academic success and leadership development of students of Mexican descent in higher education. This study examined the lives and personal stories of 22 college freshmen of Mexican descent from Texas and Michigan and how they transitioned and adapted their first year at Western Michigan University. This study used interviews and participant observation to examine the individuals in each cohort in order to construct their life stories.
An additional purpose was to critically examine the role of the researcher who was highly involved in the recruitment and …

Culture, Nationhood, And The Human Rights Ideal, Berta Esperanza Hernández-Truyol, Sharon Elizabeth Rush
Culture, Nationhood, And The Human Rights Ideal, Berta Esperanza Hernández-Truyol, Sharon Elizabeth Rush
University of Michigan Journal of Law Reform
This Symposium on nation and culture illustrates these LatCrit goals and advances them. The two main works and the commentaries on them are rich explorations and representations of the voices and concerns of LatCrit theory. This Foreword engages all the works by focusing on the concept of voice and silence. Part I locates the works in the axis of silence and power. Part II explores how critical theory and international human rights norms can be used to develop a progressive methodology to analyze and detect the exclusion or silencing of myriad voices. This Part develops a LatCritical Human Rights paradigm …

The Experience Of Interpersonal Forgiveness: An Empirical-Phenomenological Investigation, Halimatun Halaliah Mokhtar
The Experience Of Interpersonal Forgiveness: An Empirical-Phenomenological Investigation, Halimatun Halaliah Mokhtar
Dissertations
The purpose of this qualitative study was to investigate the lived experience of interpersonal forgiveness of individuals (known as co-researchers) by employing the empirical-phenomenological method. This study aimed at identifying, understanding, and describing the general psychological meaning (Tesch, 1990) or the essences/structures (Moustakas, 1994) of the experience of the phenomenon through the protocols of these individuals. It was also a goal of this study to develop a psychological theory of interpersonal forgiveness.
A two-interview structure was conducted with eight individuals (three males and five females) who had forgiven their significant offending others. The first interview focused on the meaning and …
The Ciceronian Rhetoric Of John Quincy Adams, Lyon Rathbun
The Ciceronian Rhetoric Of John Quincy Adams, Lyon Rathbun
Writing and Language Studies Faculty Publications
This article examines the way in which the classical rhetorical tradition inspired John Quincy Adams's public life. While rhetorical scholars have probed Adams's role as Harvard's first Boylston Professor of Rhetoric, they have not appreciated how the classical tradition in general, and Ciceronian rhetoric in particular, influenced his political career. Social scientists, on the other hand, have studied Adams's impact on Antebellum America but have not appreciated how his life-long devotion to classical rhetoric shaped his response to public issues. John Quincy Adams remained inspired by classical rhetorical ideals long after the neo-classicalism and deferential politics of the founding generation …

Portland Dialect Study - High Rising Terminal Contours (Hrts) In Portland Speech, Rebecca A. Wolff
Portland Dialect Study - High Rising Terminal Contours (Hrts) In Portland Speech, Rebecca A. Wolff
Dissertations and Theses
This study reports on the use of an intonation contour used in declarative clauses that is referred to in at least some of the literature as a "High Rising Terminal Contour" (HRTs). The intonation pattern is characterized by a final rise, which is similar to the pitch change used in yes-no questions. The purpose of this study is to document the use of this intonation pattern by residents of Portland, Oregon, in order to see what light it can shed on the HRT's status and function, especially among the young to see if it can be implicated in language change. …
A Power Structure Study Of An Urban Superintendent's Tenure In The City Of Virginia Beach, 1967–1986, Sophia V. Stubblefield
A Power Structure Study Of An Urban Superintendent's Tenure In The City Of Virginia Beach, 1967–1986, Sophia V. Stubblefield
Theses and Dissertations in Urban Services - Urban Education
This study examined the 19-year tenure of Dr. E. E. Brickell, superintendent of the Virginia Beach City School System. Specifically, the study has further developed an understanding of the role, expectations, and challenges of the position to identify factors that contributed to Dr. Brickell's tenure longevity.
The literature review conducted in this study revealed that specific factors contributing to a long tenure (more than 2.5 years) for a superintendent is inconclusive. The available data suggest that an interaction of political, environmental, and individual factors could effect the length of a superintendent's tenure.
A qualitative research design was used in this …
The Scope Of “High Crimes And Misdemeanors” After The Impeachment Of President Clinton, Neil Kinkopf
The Scope Of “High Crimes And Misdemeanors” After The Impeachment Of President Clinton, Neil Kinkopf
Law and Contemporary Problems
Kinkopf believes that the House of Representatives' decision to impeach Pres Clinton on the charge that he committed perjury before the grand jury, a charge that did not involve official conduct, was proper. Even though Pres Clinton's misconduct was not a proper basis for impeachment or conviction, his case demonstrates that if would be terribly unwise to understand official misconduct to be a necessary element of a high crime or misdemeanor.
