I remember the impotence I felt on the eve of the Gulf War in January 1991. No one could have known at that moment what a brief conflict it would be. Alternative Liability In Litigation Malpractice Actions: Eradicating The Last Resort Of Scoundrels, Lawrence W. Kessler

During the past 40 years there has been a major expansion in the duty of care owed to individuals by professionals. Attorneys, however, have avoided many of these new duties, able to violate a high standard of representational care with impunity. This article lays out the pattern of doctrinal change in medical malpractice and proposes similar modifications to litigation malpractice law. Using medical malpractice as a standard of comparison throughout, an argument is made that eliminating the "panoply of causation defenses" and other traditional elements of litigation malpractice will encourage the bar to both better protect clients and benefit the …

International Criminal Defence Ethics: The Law Of Professional Conduct For Defence Counsel Appearing Before International Criminal Tribunals, Michael Bohlander

San Diego International Law Journal

This Article presents an overview of the Codes and relevant Rules of Procedure and Evidence of the ICTY and the ICTR, as well as an analysis of their provisions. The ICTR's Code of Conduct is almost identical to the ICTY's Code of Conduct. Primarily, this Article examines ICTY law. This Article closes with an outlook on the future of criminal defence before international criminal tribunals. As of yet, there is no provision for the professional conduct of defence counsel before the International Criminal Court (ICC).

Alcohol Control By Referendum In Northern Native Communities: The Alaska Local Option Law, Matthew Berman, Teresa Hull

ISER Reports

When Alaska became a state in 1959, state laws removed control of alcohol regulation from the federal government and Native communities. In 1981, however, the state legislature changed alcohol laws to give residents broad powers to regulate how alcohol comes into their communities via a local option referendum. By mid-1999, 112 small communities had held 197 alcohol control elections under the state law. Sixty-nine percent of these elections added new restrictions on alcohol, while 13% removed restrictions previously imposed. The remaining 18% of elections did not receive a majority vote needed to change the existing status. Most communities passing local …
