Context: Cryotherapy is often applied using a standard treatment time. Use of a standard treatment time fails to consider the insulating effect subculaneous adipose tissue has during cooling of underlying muscle. If differences in adipose lissuc thickness alter I he effects of cryotherapy, then a standard application time may not produce a slamlard clTcct for all patients. Objective: The purpose of this study was to examine the effects of subcutaneous adipose tissue on cooling time during cryothcrapy. Design: A 1 x 4 factorial design was used in this study. Tree Seedling Establishment With Protective Shelters And Irrigation Scheduling In Three Naturalized Landscapes In Utah, Roger Kjelgren, Neil Chapman, Larry Rupp

We investigated the effect of irrigation scheduling and tree shelters on survival and growth of nine tree species during first-year establishment in three naturalized Utah landscapes with divergent soil and climate. Seedlings of nine species were planted at high mountain [MTS; 2180 m(7150 ft)], mountain foothils [FTH; 1350 m (4430 ft)], and alkali desert [DES; 1320 m (4330 ft)] sites. Half the trees at each site were enclosed with transluscent plastic shelters after planting, and all tress were irrigated when water loss estimated from local evapotranspiration, depleted plant-available soil water. Attribution Of Blame In Father-Daughter Incest Cases: Perceptions Of Social Workers And Case Aides, Jane E. Leclair

This exploratory study exarnined the attribution of blame in father-daughter incest cases by surveying the perceptions of 100 social workers and case aides. The random sample of 74 women and 26 men were mailed a self-repoft survey packet including two Likert-type, ordinal level scales: The Jackson Incest Blame Scale (JIBS) which measured offender, victim, societal and situational factors; and the JEL Blame Scale which measured mother blame. With a response rate of 30Vr, findings were reported in the median and mode. JIBS findings indicated most blame was aftributed to the offender, little to the victim, with varying amounts of blame …

Mission Impossible: On Baker, Equal Benefits, And The Imposition Of Stigma, Mark Strasser

In Baker v. State, the Vermont Supreme Court held that the state constitution required same-sex couples be afforded the same benefits and protections that married couples receive. While the state did not need to recognize same-sex marriage, at the very least, it needed to create a parallel system providing equal benefits. Professor Mark Strasser argues that a civil union alternative ultimately would not meet the court's requirements because it cannot possibly provide this requisite equality. His central concern is the differing treatment that same-sex marriage and domestic partnerships receive from other states. Additionally, Professor Strasser notes that such a system …

With the increased fervor surrounding the death penalty, many religious sects have re-examined their position on this issue. New statistics concerning possible discrimination in the application of the death penalty prompted several religious groups to call for a moratorium on the death penalty. In this Essay, Professor Thomas C. Berg examines how religious conservatives, especially Roman Catholics and evangelical Protestants, have dealt with the recent concerns over the death penalty. Syllable Structure Development Of Toddlers With Expressive Specific Language Impairment, Aimée Baird Pharr, Nan Bernstein Ratner, Leslie Rescorla

Psychology Faculty Research and Scholarship

A total of 35 children - 20 with expressive specific language impairment (SLI-E) and 15 typically developing (TD) peers - were compared longitudinally from 24 to 36 months with respect to their production of syllable shapes in 10-minute spontaneous speech samples. SLI-E 24-month-olds predominantly produced earlier developing syllable shapes containing vowels, liquids, and glides. TD 24-month-olds and SLI-E 36-month-olds produced approximately the same proportion of syllable types, with the exception of consonant clusters, where TD 24 month-olds produced more than SLI-E 36-month-olds. TD children at 36 months showed the greatest use of syllable shapes containing two different consonants and consonant …

In this Article, Hutchinson provides an account of the common law tradition of judging that draws upon Hans-Georg Gadamer's writings that advance the intellectual project of critical legal theory. Hutchinson contends that Gadamer's hermeneutics can be utilized to offer a more radical and transformative reading of the common law tradition and explores what it means to treat law seriously as a living rhetorical tradition. This Article explores Hutchinson's theory by concentrating on the recent U.S. Supreme Court physician-assisted suicide decision in Washington v. Glucksberg. Contrary to popular belief, career-type employment practices remain the norm in the U.S. labor market, and employers continue to shoulder risks for employees. Evidence to support this claim is drawn from a variety of sources: data on tenure and mobility; analysis of new job creation and job quality; recent employer responses to labor-market tightness; and data on wage premiums, fringe benefits, and training. Yet employees are bearing more risk today, including risk of job loss and of compensation fluctuations. This is an important change from the past. Nevertheless, there are limits—economic, demographic, and political—to the risk-shifting process.

Legitimate, law-abiding Internet pharmacies benefit modern healthcare in numerous ways; however, some Internet pharmacies conduct illegal and unsafe prescribing and dispensing practices that can endanger the health of the patients the pharmacy serves. Controversy exists over which regulatory body should govern the sale of prescription drugs over the Internet and how Internet pharmacies should be regulated. So What? The Individual Right To The Ownership Of Firearms Under The Ninth Amendment, Robert E. Bodine

Chicago-Kent Law Review

This Note argues that the Second Amendment to the United States Constitution fails to resolve the debate over the existence of a fundamental, individual right to keep and bear arms because the Ninth Amendment is in fact the proper source for that right. This Note performs a historical analysis of the creation of the Constitution, reviews the little Supreme Court precedent regarding the right, and then demonstrates how the Supreme Court has applied the Ninth Amendment in cases dealing with other issues.
