Disentangling Deregulatory Takings, Jim Rossi, Susan G. Rose-Ackerman Oct 2000

Disentangling Deregulatory Takings, Jim Rossi, Susan G. Rose-Ackerman

Vanderbilt Law School Faculty Publications

Constitutional takings protections, such as those in the Fifth Amendment of the United States Constitution, create a potential for state liability for changes in regulatory policy by governments. This Article critiques takings jurisprudence in the context of two infrastructure investment issues: the stranded cost problem facing United States utility industries, which has given rise to claims of compensation for deregulatory takings; and the development of standards to protect direct foreign investment in developing countries. In both contexts, traditional legal doctrines do not adequately provide for the type of remedy sought so courts are in need of standards to assist them …

Schechter Poultry At The Millennium: A Delegation Doctrine For The Administrative State, Lisa Schultz Bressman Oct 2000

Schechter Poultry At The Millennium: A Delegation Doctrine For The Administrative State, Lisa Schultz Bressman

Vanderbilt Law School Faculty Publications

The new delegation doctrine might seem perplexing to both sides of the current delegation debate. Either it is too intrusive on administrative prerogatives or it is not nearly intrusive enough. The new delegation doctrine is difficult to comprehend only because it evinces a different focus. While the debate concentrates primarily on the legitimacy of lawmaking by administrative agencies, the new doctrine speaks more to the goal of promoting the legitimacy of law made by administrative agencies. It might even be fair to say that, in this regard, the new doctrine moves beyond the academic debate. Moreover, the new doctrine neither …

As the number, cost, and complexity of federal regulations have grown over the past twenty years, there has been growing interest in the use of analytic tools such as risk assessment and cost-benefit analysis to improve the regulatory process. The application of these tools to public health, safety, and environmental problems has become commonplace in the peer-reviewed scientific and medical literatures. Recent studies prepared by Resources for the Future, the American Enterprise Institute, the Brookings Institution, and the Harvard Center for Risk Analysis have demonstrated how formal analyses can and often do help government agencies achieve more protection against hazards …

Recent Notes About Olives In Antiquity, Wilford M. Hess Oct 2000

Recent Notes About Olives In Antiquity, Wilford M. Hess

BYU Studies

When a group of LDS scholars collaborated in 1994 under the auspices of the Foundation for Ancient Research and Mormon Studies to publish a book on the allegory of the olive tree in Jacob 5, few substantial works on olive production in the ancient world existed. Now, two new archaeological books add a wealth of information to our understanding of the importance of the olive in ancient life. Although expensive and technical, these new volumes offer further insights for anyone interested in olive culture as reflected in the scriptures, especially in the Book of Mormon.

Determination Of Wax Concentration In Sunflower-Seed Oil, Silvana Martini, M.C. Anon Oct 2000

Determination Of Wax Concentration In Sunflower-Seed Oil, Silvana Martini, M.C. Anon

Nutrition, Dietetics, and Food Sciences Faculty Publications

Isothermal crystallization of waxes was studied by using an optical setup. The induction time of crystallization was assessed as a function of wax concentration. The relationship was found to be a decreasing exponential curve. The wax content of some of the solutions prepared in the laboratory was determined by calculating the crystallization induction time. The values obtained were compared to those from different methods (cold test, microscopic, and turbidimetric methods). The results obtained with the optical setup method are similar to those obtained with other methods for concentrations greater than 100 ppm. An analysis of variance test was used to …

Eliminating Consideration Of Parental Wealth In Post-Divorce Child Custody Disputes, Carolyn J. Frantz Oct 2000

Eliminating Consideration Of Parental Wealth In Post-Divorce Child Custody Disputes, Carolyn J. Frantz

Michigan Law Review

There may be no story as old as that of the child of privilege, spoiled in the things of the world, who finally achieves happiness through coming to appreciate the simple charms of working-class life. But equal in strength are the real life stories of American parents: their drive for the accumulation of personal wealth, so frequently justified as "for the children." The place of wealth in the good life of a child is deeply controversial, and it should surprise no one to see it played out in child custody law. Under the statutes of almost all states, custody disputes …

Exploring The Creative Voice In An Academic Context, Laura Brearley Oct 2000

Exploring The Creative Voice In An Academic Context, Laura Brearley

The Qualitative Report

Who we are changes what we write about and how we write. Simply stated, if the academy is to change, if our views of reality are to be more inclusive, then we need to take a broader view of authorial voices… Tierney and Lincoln, 1997 This paper challenges the traditional paradigm of densely referenced text and the use of a passive, 'neutral' researcher's voice. It draws on current doctoral research that is using creative modes of data representation to examine managers' experiences of transition in organisational life. Within this research, ten managers from an educational institution are being tracked through …

The Federalism Cases, Leon Friedman Oct 2000

The Federalism Cases, Leon Friedman

Hofstra Law Faculty Scholarship

The Constitution is an anachronism, 200 years out of date. Although the Bill of Rights is adequate, much of the Constitution relates to a world we no longer face. Certainly it is true that the whole fight in adopting and ratifying the Constitution was between the federalists and the anti-federalists. The anti-federalists did not want a central government because a central government with a standing army could march on the States and use their weapons to impose all kinds of tyranny and deprive the States of their liberty. The whole push and pull of the Philadelphia Convention, the Constitution, and …

Annotating The News: Mitigating The Effects Of Media Convergence And Consolidation, Eric Easton Oct 2000

Annotating The News: Mitigating The Effects Of Media Convergence And Consolidation, Eric Easton

All Faculty Scholarship

This essay is a personal inquiry into the nature of media technology, law, and ethics in an era marked by the convergence of media that have been largely separate-print, broadcast, cable, satellite, and the Internet-and by the consolidation of ownership in all of these media. What inventions, practices, and norms must emerge to enable us to take advantage of this vast new information-based world, while preserving such important professional values as diversity, objectivity, reliability, and independence?

The right to know belongs not only to individuals, but to the public at large, it can (or, perhaps, must) be vindicated by government …

Legalizing Merger To Monopoly And Higher Prices: The Canadian Competition Tribunal Gets It Wrong, Alan A. Fisher Ph.D., Robert H. Lande, Stephen F. Ross Oct 2000

Legalizing Merger To Monopoly And Higher Prices: The Canadian Competition Tribunal Gets It Wrong, Alan A. Fisher Ph.D., Robert H. Lande, Stephen F. Ross

All Faculty Scholarship

This article analyzes the Canadian Superior Propane decision, apparently the first merger decision in world history to consider explicitly what to do when a merger was predicted to lead to both higher consumer prices and to net efficiencies. The article advocates analyzing the merger under a "price to consumers" or "consumer welfare" standard, rather than a total efficiency standard, and advocates that the enforcers and the courts block such mergers.

Professor Waller's Un-American Approach To Antitrust, Robert H. Lande Oct 2000

Professor Waller's Un-American Approach To Antitrust, Robert H. Lande

All Faculty Scholarship

Professor Waller asks an un-American question - what can the United States antitrust program learn from the rest of the world? This question is un-American because we in the United States rarely look to others for advice. Besides, we invented antitrust and we were practically alone in the world in enforcing antitrust for almost a century. Only during the current generation have many other nations had active and vigorous antitrust programs. Moreover, the United States is in the business of exporting our accumulated century of antitrust wisdom through a wide variety of methods, and we revel in playing this role. …
