The Faa: A Tombstone Agency? Putting The Nickname To The Test, Rebecca K. Lutte, Brent D. Bowen

Aviation Institute Faculty Publications

The purpose of this research was to investigate Federal Aviation Administration (FAA) activity before and after six catastrophic airline accidents to examine the alleged reactive policysetting reputation of the FAA. Actions reviewed were regulatory, inspection, and enforcement activities. The study revealed that change in agency activity does occur following an accident. The location of the event appears to influence the direction of change. When accidents occurred within the United States, FAA activity increased following the accident. The opposite occurred for airline accidents outside the U.S. The increase in FAA activity following U.S. based events, supports the reactive, 􀀀tombstone agency􀀀 reputation …

On August 22, the United Nations certified the process and the results of the Landmine Impact Survey conducted in Yemen. This survey is the first of its kind to be performed in accordance with international standards and marks a revolutionary event in the field of humanitarian mine action. The enhanced quality of information gained through the impact survey will change the way that resources are allocated and operational plans developed. Sophisticated analysis can now take place in support of decision-makers at all levels and progress measured in terms of real value to affected populations.

Years of conflict along the borders of Thailand have resulted in countless landmines buried along the Thai-Cambodia, Thai-Laos, Thai-Malaysia and Thai-Myanmar borders. The number of booby-traps, UXO and landmines in Thailand is unknown. Surveys made by the Royal Thai Army and Navy indicate that the land of 19 provinces are landmine-infested. Approximately, 796 square kilometers of the land cannot be utilized, affecting the livelihood of 400,000 people residing in these areas.

There are three ways to improve the mine action process to allow displaced people to return to their land sooner and with less risk of injury. Naturally, a major increase in aid funding would achieve a similar result using the existing process. Three main avenues to achieve improved outcomes with the same level of funding are as follows:

  • Improving the technology, cost effectiveness and reliability of the mine clearance process,
  • Applying risk management approaches to manage mine contamination problems, and
  • Utilizing local resources and seeking alternative sources of funding more effectively.

Mercy Corps International, a non-profit voluntary agency, is one of the United States most resourceful international charities, contributing close to 94 percent of its resources to the most vulnerable areas in the world. Since 1979, when Mercy Corps was founded as Save the Refugees Fund, it has dispersed over $450 million in assistance to people in more than 68 countries. With the support of several prominent Americans, Save the Refugees Fund was able to expand its efforts to assist not only the Cambodian refugees who attempted to flee by boat but also vulnerable people in other nations. The International Rescue Committee (IRC), founded at the request of Albert Einstein to assist opponents of Adolf Hitler, helps people fleeing racial, religious and ethnic persecution as well as those uprooted by war and violence. The IRC, with a staff from 40 countries, is a global organization. International institutions, governments and individual donors support the organization. Recently, the European Commission and individual European nations contributed substantial funding to assist IRC humanitarian aid projects.

"Great nations, like great men, should keep their word."' Justice Black, in his dissent in Federal Power Commission v. Tuscarora Indian Nation, encapsulated the failures of two centuries of the United States' relationship with its native Indians. Since establishing the first tentative treaties of the Revolutionary era, the United States has made many broad promises to the Indians. These promises, detailed first in treaties and later in statutes, drew the government and the Indians into a fiduciary relationship. Appropriately constructed measures of the quality of life and the quality of the business environment should be important determinants of the growth and composition of population across urban areas. This paper examines that question by extending theoretical measures of household quality of life to construct the first ever measure of the quality of the business environment? the value that firms place on the basket of amenities in a metropolitan area. An annual panel of quality of life and quality of business environment values for 37 cities in the United States is then constructed for the 1977 to 1995 period.

Opting Out Of Regulation: A Public Choice Analysis Of Contractual Choice Of Law, Erin A. O'Hara

Vanderbilt Law Review

This Article uses public choice theory to analyze the function of choice-of-law clauses in contracts. Choice-of-law clauses are now quite common and are increasingly enforced, especially with the proliferation of international and Internet transactions. Because these clauses can be used by parties to avoid regulation, academics are now vigorously debating the extent to which this contractual opt out should be permitted. The Article presents a positive political theory of the interplay of legislative action and the enforcement of choice of law. There is little doubt that, after a century's exposure, Chinese have absorbed and understand quite clearly the greater meanings of the realm of sport-the connections between competitive athletic endeavor, imperialist bluster, and economic standing in the world community. After Drye: The Likely Attachment Of The Federal Tax Lien To Tenancy-By-The-Entireties, Steve R. Johnson

On December 7, 1999, the United States Supreme Court unanimously decided Drye v. United States, a case likely to be a landmark in federal tax lien law. Drye clarified what had been muddied by previous Supreme Court and lower court decisions: the proper relation between state law and federal law in tax lien attachment cases. That clarification will permit-indeed, compel-greater analytical precision as future courts address tax lien cases. This Article discusses one such line of cases.

Kyojiro Someya, Professor emeritus of Waseda University, died suddenly before dawn on January 3, 2000, as he neared the age of 77. He had completed the correction of proofs of his last book, Accounting and Management of Cash Flow, on the day before, but to our regret could not write the preface. His academic achievements were his brilliant activities at home and abroad and his publication of over 90 books, including 24 coauthored, and more than 200 papers.
