The urbanized shore areas of Long Island Sound in the vicinity of New Haven, Connecticut (USA) have a long history of exposure to point and non-point sources of pollution, New Haven having been one of the birthplaces of the industrial revolution. As an unintended consequence of such activities, the region's sedimentary systems have incorporated a complex mixture of organic and inorganic contaminants. With its long and varied pollution history and the multiplicity of sedimentary environments (fluvial, estuarine, intertidal, marsh, etc.) present in a compact geographical area, the region is ideal natural laboratory for field testing new contamination assessment techniques. Breaking Down The Boundaries Of Malpractice Law, Philip G. Peters Jr.

Historically, courts have treated professional malpractice cases as unique. When disputes that would otherwise have been governed by tort rules of general application have arisen in the context of medical treatment, courts have routinely constructed special rules for the resolution of those disputes. Recent evidence suggests that this penchant for special rules may be weakening and that malpractice law may be slowly melting back into the sea of tort doctrine. Recent studies have suggested that up to five percent of all prescriptions filled in hospitals contain errors. Medical commentators have expressed concern that this figure may be even higher for outpatient prescription. As a result of medication errors, patients suffer uncomfortable and even traumatic results in the form of “adverse drug events,” while the health care system incurs needless costs. These adverse drug events are normally preventable, and are considered to be a current problem by hospital administrators and doctors alike. Traditionally drug manufacturers have been excused from the general duty to warn consumers about the risks associated with their products by the learned intermediary doctrine. Though the doctrine has a sound grounding in public policy, drug companies have recently employed marketing strategies that undermine the usefulness of the learned intermediary rule. In Doe v. Alpha Therapeutic Corp., the Missouri Court of Appeals for the Eastern District of Missouri recently addressed whether the learned intermediary doctrine can be used as a defense when a drug company markets a product directly to consumers. For almost thirty years, courts have been experimenting with the tort of First-Party Bad Faith. As a consequence, insurance companies are receiving mixed signals about how careful they should be when assessing their first-party claims. This becomes even more confusing when one considers that only half of the states have accepted First-Party Bad Faith. In this Note, Dominick Capozzola argues first that all of the states should accept the tort of First-Party Bad Faith. Current public policy is based on two fundamental principles: equity and efficiency. Equitable programs contribute to balancing the needs and desires of the various groups in society; whereas efficient programs are those that serve to increase the net value of goods and services available to society. Benefit-cost analysis is a tool developed to determine whether a program produces effects that justify the costs incurred to operate the program. The benefit-cost model presented in this monograph requires the reader to:

  1. Understand the concept of an analytical perspective;
  2. Move beyond viewing benefit-cost analysis as a simple ratio of benefits to costs;

In contrast to dutifully killing the enemy, a soldier is not supposed to rape a woman, at least in theory. But rapes occur in war. They always have, and often in settings and upon a scale that is difficult to comprehend. Accordingly, rape in times of war has a direct effect upon the society where the conflict takes place. Position Of Γ-Chain Carboxy-Terminal Regions In Fibrinogen/Fibrin Cross-Linking Mixtures, Kevin R. Siebenlist, David A. Meh, Michael W. Mosesson

There are conflicting ideas regarding the location of the carboxyl-terminal regions of cross-linked γ-chain dimers in double-stranded fibrin fibrils. Some investigators believe that the chains are always oriented longitudinally along each fibril strand and traverse the contacting ends of abutting fibrin D domains (“DD-long” cross-linking). Other investigations have indicated instead that the chains are situated transversely between adjacent D domains in opposing fibril strands (transverse cross-linking). To distinguish between these two possibilities, the γ dimer composition of factor XIIIa-cross-linked fibrin/fibrinogen complexes that had been formed through noncovalent D/E interactions between fibrinogen D domains and fibrin E domains was examined. This survey period is most notable for the diversity of cases touching upon trial practice and procedure decided by the Georgia appellate courts. Among those were cases fleshing out the permissible parameters of attorney-client contractual relations, scaling back the malpractice affidavit pleading requirement, defining further what constitutes a doctor-patient relationship, interpreting the wrongful death act to determine who can properly bring a claim, and declining to apply the self-contradictory testimony rule to a party's expert witness. The law of negligence imposes few affirmative duties on actors in society. In the medical profession specifically, negligence law traditionally contains no requirement that a physician provide medical treatment to those in need absent an existing relationship between the doctor and patient. Yet there has long been the sense that doctors owe a higher duty to the public, and courts are finding ways to redefine the doctor-patient relationship to allow plaintiffs greater access to claims for a physician’s failure to render care.
