In all the debate about the burgeoning number of youth incarcerated in California juvenile justice systems or living in foster care because of abuse and neglect, few have recognized the growth of an immense and insidious crisis affecting the children supervised by the juvenile court. The crisis lies in the overwhelming number of children - court dependents and delinquents alike - who suffer from educational deficiencies and disabilities. This Article addresses the educational needs of both juvenile delinquents and dependents (victims of child abuse and neglect). Constitutionality Of State And Local Selective Purchasing Legislation: A 9-0 Supreme Court Decision In Favor Of And In Defeat Of Plaintiff, Rebecca S. Hartley

In a 9-0 decision handed down in 2000, the Supreme Court struck down a Massachusetts selective purchasing law that restricted state agencies from trading with companies doing business in Burma. The Court based its decision on the narrow grounds that the law violated the Supremacy Clause of the U.S. Constitution. In the wake of so limited a decision, a number of constitutional questions remain unanswered regarding the rights of states to enact laws intruding upon federal foreign affairs.

The threat of the use of a biological agent as a weapon presents the American public with a potential for catastrophic consequences with massive loss of life and economic disaster. Reducing the effect of a biological warfare attack requires resources beyond those found within local or state governments. The integration of appropriate federal assets in a timely fashion will significantly reduce casualties and economic loss. Military medical assets support the federal response. Managing the consequences of a domestic biological warfare attack is a new role for the military, requiring different support packages than those configured to support the war fight. …

The decision in Kass illustrates a situation where well-founded common law contract principles were applied to a novel reproductive issue in order to respond to rapidly evolving technological progress. However, this legal dilemma presents a variable that warrants special attention. Slippery When Wet: The Effects Of Local Alcohol Access Laws On Highway Safety, Reagan Anne Baughman, Michael Edward Conlin, Stacy Dickert-Conlin, John V. Pepper

This paper examines 237 instances of policy changes related to alcohol sales and consumption enacted in Texas communities between 1975 and 1996 to determine their effect on the incidence of alcohol-related motor vehicle accidents. These policies are categorized by location where the alcohol is consumed after sale (on the premises or off) and the type of alcohol available for consumption (beer and wine or hard liquor). After controlling for both county and year fixed effects, we find evidence that (i) the sale of alcohol for consumption on the premises (in bars and restaurants) is associated with a sizeable increase in …

Worldwide Population Aging: Endogenous Policy Formation And Capital Market Transmissions In The Presence Of Symmetric Demographic Shocks, Mehmet Serkan Tosun

This paper examines the transition effects of population aging in more developed regions that is also expected to occur in developing regions in the near future. We address these effects by exploring the influences of internationally mobile capital and a politically responsive fiscal policy in a two-country overlapping generations model. Our results show that the combination of capital mobility and endogenous fiscal policy play an important role in how economies respond to population aging. Capital mobility has consumption smoothing effects but endogenous fiscal policy is the key factor in creating asymmetries between countries. The interaction of the two may even …

A fundamental property of a progressive income tax is that it provides implicit insurance against shocks to income by dampening the variability of disposable income and consumption. The Economic Recovery Tax Act of 1981 (ERTA) in combination with the Tax Reform Act of 1986 (TRA86) greatly reduced the number of marginal tax brackets and the maximum marginal rate, which limits the stabilizing effect of the tax system on household consumption when pre-tax income fluctuates. We examine the effect of the federal income tax reforms of the 1980s on the associated degree of automatic stabilization of consumption. The empirical framework derives …
