Antitrust In The New Economy, Richard A. Posner Nov 2000

Antitrust In The New Economy, Richard A. Posner

Coase-Sandor Institute for Law & Economics Research Paper Series

Concern has been expressed recently that U.S. antitrust law may not be well suited to regulating the "new economy." Doctrines developed to deal with competition and monopoly in smokestack industries is not well adapted, it is argued, to dealing with the dynamic economy of the twenty-first century. What I shall argue is that there is indeed a problem with the application of antitrust law to the new economy, but that it is not a doctrinal problem; antitrust doctrine is supple enough, and its commitment to economic rationality strong enough, to take in stride the competitive issues presented by the new …

Dancing Around Employment At-Will: Can Fraud Provide Plaintiffs A Way To Hold Their Employers Liable, James E. Meadows Nov 2000

Dancing Around Employment At-Will: Can Fraud Provide Plaintiffs A Way To Hold Their Employers Liable, James E. Meadows

Missouri Law Review

For over a century, the employment at-will doctrine has formed an important part of American jurisprudence. The doctrine, and what some see as its potentially harsh results, have received strong criticism. In some states, courts have used their ability to modify the common law to alter the employment at-will doctrine by creating exceptions based on public policy, the use of employee handbooks, and face-to-face statements by managers that imply a promise of employment. The Missouri Court of Appeals for the Eastern District of Missouri recently gave discharged employees a new way to avoid the almost absolute bar of the employment …

Meeting Explores Sensor Technology For Remote, Interactive Aquatic Experiments, Kendra L. Daly Nov 2000

Meeting Explores Sensor Technology For Remote, Interactive Aquatic Experiments, Kendra L. Daly

Marine Science Faculty Publications

Oceans, lakes, rivers, and groundwater are complex, dynamic environments in which physical, chemical, and biological processes occur over varying temporal and spatial scales (e.g., eddies, nutrient fluxes, patchiness of organisms, benthic processes, and pollution). In addition, deep, remote, or hostile systems such as hydrothermal vents and polar regions traditionally are poorly sampled, but are important to understanding global biogeochemical and hydrological cycles. In the coming decades, moored, cabled, and autonomous observatories will be used to investigate a spectrum of basic processes in aquatic environments. In anticipation of the need to develop or re‐engineer sensors to measure physical, chemical, biological, and …

Comparison Of Coastal Fringe And Interior Forests As Reserves For Marbled Murrelets On Vancouver Island, Alan E. Burger, Volker Bahn, Angeline R.M. Tillmanns Nov 2000

Comparison Of Coastal Fringe And Interior Forests As Reserves For Marbled Murrelets On Vancouver Island, Alan E. Burger, Volker Bahn, Angeline R.M. Tillmanns

Biological Sciences Faculty Publications

Much of the protected habitat available to the threatened Marbled Murrelet Brachyramphus marmoratus and other old-growth associated species in the Pacific Northwest is in narrow strips along the coast (e.g., parks and scenic fringes). Using data over two years from three watersheds on southwest Vancouver Island, we show that such shoreline strip forests represent suboptimal habitat for murrelets. Murrelet detections, including circling and subcanopy behaviors, were significantly lower at 30 coastal stations (20–250 m from the shoreline edge) than at 30 interior stations (1.5–21.0 km inland). Densities of predators were significantly higher at the coastal stations. The coastal trees were …

Productivity Growth And The New Economy, William D. Nordhaus Nov 2000

Productivity Growth And The New Economy, William D. Nordhaus

Cowles Foundation Discussion Papers

The present study is the third in a series of three papers devoted to issues in the measurement of productivity and productivity growth. The major findings are as follows. First, this study shows that the new data set used here, which develops data on total output, business sector output, and “well-measured” output, and relying on income-side data, provides a useful supplement to existing data sets. Second, there has clearly been a rebound in labor-productivity growth in recent years. All three sectoral definitions show a major acceleration in labor productivity in the last three years of the period (1996-98) relative to …

New Data And Output Concepts For Understanding Productivity Trends, William D. Nordhaus Nov 2000

New Data And Output Concepts For Understanding Productivity Trends, William D. Nordhaus

Cowles Foundation Discussion Papers

The present study is the second is a series of three papers devoted to issues in the measurement of productivity and productivity growth. The contributions of the present paper are three. First, it introduces a new approach to measuring industrial productivity based on income-side data that are published by the Bureau of Economic Analysis (BEA). The data are internally consistent in that both inputs and outputs are income-side measures of value added, whereas the usual productivity measures combine expenditure-side output measures with income-side input measures. Second, because of interest in the “new economy,” we have also constructed a set of …

Spaceflight Effects On Single Skeletal Muscle Fiber Function In The Rhesus Monkey, Robert H. Fitts, Dominique Desplanches, Janell Romatowski, Jeffrey J. Widrick Nov 2000

Spaceflight Effects On Single Skeletal Muscle Fiber Function In The Rhesus Monkey, Robert H. Fitts, Dominique Desplanches, Janell Romatowski, Jeffrey J. Widrick

Biological Sciences Faculty Research and Publications

The purpose of this investigation was to understand how 14 days of weightlessness alters the cellular properties of individual slow- and fast-twitch muscle fibers in the rhesus monkey. The diameter of the soleus (Sol) type I, medial gastrocnemius (MG) type I, and MG type II fibers from the vivarium controls averaged 60 ± 1, 46 ± 2, and 59 ± 2 µm, respectively. Both a control 1-G capsule sit (CS) and spaceflight (SF) significantly reduced the Sol type I fiber diameter (20 and 13%, respectively) and peak force, with the latter declining from 0.48 ± 0.01 to 0.31 ± 0.02 …

A Survey Of Context-Aware Mobile Computing Research, Guanling Chen, David Kotz Nov 2000

A Survey Of Context-Aware Mobile Computing Research, Guanling Chen, David Kotz

Computer Science Technical Reports

Context-aware computing is a mobile computing paradigm in which applications can discover and take advantage of contextual information (such as user location, time of day, nearby people and devices, and user activity). Since it was proposed about a decade ago, many researchers have studied this topic and built several context-aware applications to demonstrate the usefulness of this new technology. Context-aware applications (or the system infrastructure to support them), however, have never been widely available to everyday users. In this survey of research on context-aware systems and applications, we looked in depth at the types of context used and models of …

Dna Binding Properties Of The Arabidopsis Floral Development Protein Aintegumenta, Staci Nole-Wilson, Beth A. Krizek Nov 2000

Dna Binding Properties Of The Arabidopsis Floral Development Protein Aintegumenta, Staci Nole-Wilson, Beth A. Krizek

Faculty Publications

The Arabidopsis protein AINTEGUMENTA (ANT) is a member of a plant-specific family of transcription factors (AP2/EREBP) that share either one or two copies of an approximately 70 amino acid region called the AP2 repeat. DNA binding activity has been demonstrated previously for members of this family containing a single AP2 repeat. Using an in vitro selection procedure, the DNA binding specificity of the two AP2 repeat containing protein ANT was found to be 5'-gCAC(A/G)N(A/T)TcCC(a/g)ANG(c/t)-3'. This consensus site is much longer than sites recognized by proteins containing a single AP2 repeat and neither AP2 repeat of ANT was alone capable of …

Just What The Doctor Ordered--Or Was It: Missouri Pharmacists' Duty Of Care In The 21st Century, Michele L. Hornish Nov 2000

Just What The Doctor Ordered--Or Was It: Missouri Pharmacists' Duty Of Care In The 21st Century, Michele L. Hornish

Missouri Law Review

Recent studies have suggested that up to five percent of all prescriptions filled in hospitals contain errors. Medical commentators have expressed concern that this figure may be even higher for outpatient prescription. As a result of medication errors, patients suffer uncomfortable and even traumatic results in the form of “adverse drug events,” while the health care system incurs needless costs. These adverse drug events are normally preventable, and are considered to be a current problem by hospital administrators and doctors alike. Now, courts are beginning to recognize the problem, and have suggested a solution by adopting a heightened standard of …

Learned Intermediary Doctrine In The Age Of Direct Consumer Advertising, The, Bradford B. Lear Nov 2000

Learned Intermediary Doctrine In The Age Of Direct Consumer Advertising, The, Bradford B. Lear

Missouri Law Review

Traditionally drug manufacturers have been excused from the general duty to warn consumers about the risks associated with their products by the learned intermediary doctrine. Though the doctrine has a sound grounding in public policy, drug companies have recently employed marketing strategies that undermine the usefulness of the learned intermediary rule. In Doe v. Alpha Therapeutic Corp., the Missouri Court of Appeals for the Eastern District of Missouri recently addressed whether the learned intermediary doctrine can be used as a defense when a drug company markets a product directly to consumers. This Note discusses the learned intermediary defense and its …
