For The Misdemeanor Outlaw: The Impact Of The Ada On The Institutionalization Of Criminal Defendants With Mental Disabilities, Michael L. Perlin

Articles & Chapters

This article argues that the Supreme Court's decision in Olmstead v. L.C., 119 S. Ct. 2176 (1999), finding a qualified right to community treatment and services for certain institutionalized persons under the Americans with Disabilities Act (ADA), causes us to reconceptualize state policies that mandate that all defendants in four categories - those being evaluated for competency to stand trial, those found permanently incompetent to stand trial under the Supreme Court's decision in Jackson v. Indiana, 406 U.S. 715 (1972), those being evaluated for insanity, and those found not guilty by reason of insanity - be treated and housed in …

A Preferred Vision For Administering Secondary Schools : A Reflective Essay, Cora J. Turner Jan 2000

A Preferred Vision For Administering Secondary Schools : A Reflective Essay, Cora J. Turner

Graduate Research Papers

What is Leadership? Is leadership the use of power and authority to make decisions? Is leadership a skill learned over time to facilitate the process of change? These are questions which must be pondered. 1 Leadership is a process which involves the skill of communicating with others through teamwork to carry out a vision. Leadership is an influenced relationship between the leader and follower in pursuit of a common goal. As the mission and goals are defined, the organization has the opportunity to become efficient and effective. The leader-follower relationship is based on influence, change, mutual purpose, and commitment.

Two Takeovers In Wild Hamadryas Baboons, Larissa Swedell Jan 2000

Two Takeovers In Wild Hamadryas Baboons, Larissa Swedell

Publications and Research

Hamadryas baboons exhibit a multi-level social structure in which several one-male units, each consisting of a ‘leader’ male and one or more females, comprise a band’ and two or more bands comprise a troop. Cohesion of each one-male unit is maintained by aggressive herding by its leader male [1]. Here I describe the consequences of 2 takeovers in a band of wild hamadryas baboons. I report evidence of infant mortality following takeovers, changes in female reproductive condition within 2 weeks after takeovers, and the reacquisition of a female by a deposed leader male, none of which has been previously reported …

Tribal Law As Indigenous Social Reality And Separate Consciousness [Re]Incorporating Customs And Traditions Into Tribal Law, Christine Zuni Cruz

Tribal Law Journal

Tribal Law as Indigenous Social Reality and Separate Consciousness-[Re]Incorporating Customs and Traditions into Tribal Law by Christine Zuni Cruz explores the reflection of traditional legal concepts and values in enacted laws of indigenous nations. The premise of this article is that "an indigenous nation's sovereignty is strengthened if its law is based upon its own internalized values and norms." Zuni-Cruz's article questions the impact of enacted western laws on indigenous communities' people and culture.

Law And Child Labour In Malaysia : A Case Study In Balakong New Village, Hoon Peow See Jan 2000

Law And Child Labour In Malaysia : A Case Study In Balakong New Village, Hoon Peow See

Student Works (2000-2009)

Child Labour is a widespread global phenomenon. Many international organisations, particularly the United Nations and International Labour Organisation have included the abolition of child labour in their agenda. In Malaysia child work is regulated by the Children and Young Persons (Employment) Act 1966. This Act is designed to protect children at work against exploitation and work hazards. However, this Act does not seem to be effective. This study is an attempt to show that the ineffectiveness of the law could be due to its inability to respond to local social and cultural factors, which influence the practice of child labour. …

Social And Economic Determinants Of Age At First Marriage Among Women In Peninsular Malaysia, Nor Haliza Abdul Rahman Jan 2000

Social And Economic Determinants Of Age At First Marriage Among Women In Peninsular Malaysia, Nor Haliza Abdul Rahman

Student Works (2000-2009)

This research paper examines the changing trend and differentials in age at first marriage among Malaysian women, based on data from the 1994 Malaysian Population and Family Survey. Trends and patterns of age at first marriage across cohorts are analysed in relation to a number of socio-demographic variables. The salient findings of the study reveal that women's pre-marital work and education are the two most important factors influencing the timing of marriage of women in Peninsular Malaysia. Age at first marriage is still lowest among the Malays, the Muslims, those with no schooling and living in rural areas as well …

Resettlement, Development And Gender : The Case Of The Kadazandusun Of Kampung Tampasak, Penampang, Sabah, Ooi Lin Yong Jan 2000

Resettlement, Development And Gender : The Case Of The Kadazandusun Of Kampung Tampasak, Penampang, Sabah, Ooi Lin Yong

Student Works (2000-2009)

The resettlement of the Kadazandusun indigenous community of Kampung Tampasak in Penampang, Sabah due to the compulsory acquisition of their land for the construction of the Babagon Dam has brought about various changes in their lives. Consequently, members of the resettled community begin to experience increased social, economical, cultural and psychological stresses, which together with the loss of their anccstraJ lands and resources have accentuated their stresses. Resettlement demands the restructuring of homes, livelihoods, value systems and culture; the community views this restructuring as a threat to their identity as indigenous peoples. This study shows that the burden of change …

John Witte, Jr.
Religion and the American Constitutional Experiment:
Essential Rights and Liberties
Westview Press 2000

From the Review

This is a great time for students of the First Amendment's Religion Clauses and of what Professor John Witte calls the American "experiment" with religious freedom. We've been blessed these past few years with an in-print seminar - an upper-division offering, team-taught by faculty heavyweights - on this experiment, its products and prospects, and the values that have shaped it. Our teachers and texts have included, to name just a few, Professor Steven Smith's Foreordained Failure: The Constitutional Quest for a …

Law And Theology: Reflections On What It Means To Be Human From A Franciscan Perspective, John J. Coughlin Jan 2000

Law And Theology: Reflections On What It Means To Be Human From A Franciscan Perspective, John J. Coughlin

Journal Articles

When I was first asked in March of 2000 to speak at this conference on the topic of "law and theology," many thoughts crossed my mind. I could address: the role of religion in American political life, euthanasia, medieval canon law and theology, the death penalty, the Jewish origins of the Pauline perspective on law, the ethics of DNA experimentation, Muslim theology and law, the relation between Marxist political theory and Christian eschatology, or several other "light" issues. Upon second thought, perhaps a more straight-forward approach would be beneficial. I might review the plan of salvation history, and then as …

Teacher Training Through Literature: Building Teacher Awareness On The Process Of Shift In Identity On Esl Learners., Luis Ruiz J. Vazquez Jan 2000

Teacher Training Through Literature: Building Teacher Awareness On The Process Of Shift In Identity On Esl Learners., Luis Ruiz J. Vazquez

Graduate Theses, Dissertations, and Problem Reports (ETD)

In this work I defend the notion of the necessity for ESL learners to undergo some sort of identity shift process. This process would be a smooth and gradual evolution by reason of which ESL learners (and, by extension, learners of any foreign language) would develop a second identity that would encompass all the aspects associated to the L2 of their choice, apart from its exclusively linguistic and structural components. I introduce mainly the necessity of building awareness among teachers, especially—but not exclusively—among monolingual foreign language instructors. The strategy that I propose to promote this awareness is the guided reading …
