Left Out In The Cold: The Problem With Aboriginal Title Under Section 35(1) Of The Constitution Act, 1982 For Historically Nomadic Aboriginal Peoples, Brian J. Burke

In R. v. Adams and Delgamuukw v. British Columbia, the Supreme Court of Canada made statements to the effect that certain historically nomadic Aboriginal groups may be unable to make out a claim for Aboriginal title under section 35(1) of the Constitution Act, 1982. In light of the anthropological evidence relating to the close connection some of these groups enjoyed with the lands they occupied, a serious injustice may arise if these groups are indeed barred from an Aboriginal title claim. Research shows that knowing what preservice teachers believe about teaching and learning helps their instructors to reinforce those beliefs that are compatible with current approaches in education and challenge those that promote the perpetuation of antiquated and ineffective teaching practices. The purpose of this quantitative study is to examine the relationship between family structure and children's academic achievement, and to assess the roles of income and parental control in this relationship. The present study involves secondary analysis of data from the National Survey of Families and Households (Sweet & Bumpass, 1996) The National Survey of Families and Households (NSFH) is a national random sample survey conducted in two waves that covers a wide variety of issues on American family life. The role of depersonalization is the central focus of this study. A major issue in examining the role of depersonalization is whether the present concept of burnout is an appropriate indicator of bumout for police officers. The commonly accepted conception of burnout is a process of emotional exhaustion that leads to depersonalization, followed by a reduction in work accomplishment. Depersonalization, by this conception, is a symptom of burnout. By definition,depersonalization is the psychological distancing of emotional and psychological trauma in stressful situations—a coping technique.

Throughout recorded Chinese history, regions of the country populated by persons of non-Han ancestry often fluctuated significantly in population numbers and in their political and commercial influence. However, at all times they were considered as important contributors to the nation. Many of these peoples had moved from their homelands, settled in China and had intermarried with Han Chinese. Over the generations they became accepted as fully-fledged Chinese citizens although, in many instances, they retained their traditional customs and religious practices, and frequently their own language. Wadjela and Nyungar experts (of managerial, administrative, service staff), from the same South-West city location in Western Australia were randomly chosen from the non-government human service field for separate workshops and asked the question “what makes a non-government human service organisation effective?" The purpose was to compare the group consensus answer between the two separate workshop groups. The Nyungars are the Indigenous people in the South-West of Western Australia and the Wadjelas are the Non-Indigenous people living in the same area. This research is an investigation into the implementation of drama in early childhood education conducted in one Perth metropolitan primary school, over a three-week period. The six drama lessons were taught by the researcher/practitioner in a Pre-primary and a Year One class. These students were chosen for their limited exposure to the Drama in Education experience. The expectation was of a less conditioned response both in their conduct and expression within the drama environment. Some UFO researchers (ufologists) claim that being abducted by aliens can be compared with shamanic initiation experiences in traditional societies in that both types of experience may be similarly transformative, leading to a more spiritual or animistic world-view, a deep concern for the environment and the development of paranormal abilities such as healing. This study on the use of teaching portfolios arose from a number of converging trends and policy initiatives within the higher education sector that led to demands for the improvement of, and a more reflective scholarly approach to, university teaching. In Australia, and overseas, institutions have responded to these demands by implementing teaching development and evaluation programs for academic staff that arc based on the use of portfolios. In this article, Professor Kennedy examines the tremendous increase in the severity of punishment in America in recent decades. He posits that criminal punishment has come to serve as a new civic religion of sorts for a society worried about its ability to cohere. The depth of our anxieties about our social solidarity, Kennedy argues, expresses itself in our monstrous conceptions of crime and in the corresponding severity of our punishment. To determine the extent to which Aboriginal title-holders enjoy control over Aboriginal title lands, it is necessary to explore fiduciary doctrine, for the application of this doctrine to the question of legislative infringement determines the limits within which Aboriginal title-holders can expect to see their interests respected. In Delgamuukw the Supreme Court of Canada adopted and applied an understanding of the Crown-Aboriginal fiduciary relationship it developed in Gladstone. This case study examined lower secondary student attitudes towards social studies and identified the factors that influenced attitudes in one Catholic secondary school located in the Perth metropolitan area. A total of 4 75 students were enrolled in Years 8 to 10 at the school in 1999. A modified version of Student Attitudes Towards Social Studies (Moroz 1996) questionnaire with 94 items, was utilised to gauge secondary student attitudes towards the learning area. The increase in Indigenous participation in university courses in recent years has not been matched by an increase in graduation. In the mainstream university population, student success has been linked to approaches to learning, which are linked to conceptions of learning. This study investigates what conceptions of learning Indigenous students identify at the beginning of their university career. Thirty six students completed a 'Reflections on Learning Inventory' developed by Meyer (1995).
