Legalizing Oral History: Proving Aboriginal Claims In Canadian Courts, Kent Mcneil, Lori Ann Roness Jan 2000

Legalizing Oral History: Proving Aboriginal Claims In Canadian Courts, Kent Mcneil, Lori Ann Roness

Articles & Book Chapters

Large areas of Canada are still subject to land claims by the Aboriginal peoples, who include the Indian, Inuit, and Metis. These claims arise mainly in regions where land-surrender treaties were not signed in the past, notably in British Columbia, Quebec, the Atlantic Provinces, and the North. Most of them get resolved through negotiation and agreement, but a few end up in court. When that happens, the onus is on the Aboriginal peoples to prove their claims in accordance with the requirements of the Canadian legal system. This article will examine some of the difficulties Aboriginal peoples encounter when they …

Three Issues For The City In The 21st Century, Richard Briffault Jan 2000

Three Issues For The City In The 21st Century, Richard Briffault

Faculty Scholarship

The title for this year’s program of the Section on Urban, State and Local Government Law of the Association of American Law Schools is The City in the 21st Century. These three articles provide a stimulating introduction to three issues that are likely to be central to the study of the city in the twenty-first century-as they were in the twentieth century and in the nineteenth century: the interplay of local and regional forces in land development, the battles among interest groups to control city hall, and the role of local government in promoting local economic development. These issues are …

Gang Loitering, The Court, And Some Realism About Police Patrol, Debra A. Livingston Jan 2000

Gang Loitering, The Court, And Some Realism About Police Patrol, Debra A. Livingston

Faculty Scholarship

When the Supreme Court voted to review the decision of the Illinois Supreme Court holding Chicago's "gang loitering" ordinance invalid on federal constitutional grounds, it seemed plausible that City of Chicago v Morales would be the occasion for a major statement from the Court on a set of complex issues – issues including not only the nature of the police officer's authority to maintain order in public places, but also the relative roles of politics and judicial decision making in delineating both the limits on this authority and the latitude left to police to employ discretion in its exercise. After …

Can An Optical Plankton Counter Produce Reasonable Estimates Of Zooplankton Abundance And Biovolume In Water With High Detritus?, X. Zhang, M. Roman, A. Sanford, H. Adolf, C. Lascara, R. Burgett Jan 2000

Can An Optical Plankton Counter Produce Reasonable Estimates Of Zooplankton Abundance And Biovolume In Water With High Detritus?, X. Zhang, M. Roman, A. Sanford, H. Adolf, C. Lascara, R. Burgett

CCPO Publications

The Optical Plankton Counter (OPC) has been used in oceanic and fresh waters to estimate zooplankton abundance and biovolume. However, it is not clear whether the OPC can produce accurate estimates of zooplankton abundance and biovolume in waters with high detritus. In order to test the capability of the OPC to estimate zooplankton abundance and biovolume in Chesapeake Bay, two sets of laboratory experiments were conducted using water with high detritus concentrations collected from the upper Choptank estuary of Chesapeake Bay and laboratory cultured Artemia. Our results suggest that the OPC is able to produce accurate estimates of zooplankton biovolume …

Some New Observations On The Cytopathology Of Fin Erosion Disease In Winter Flounder Pseudopleuronectes Americanus, Joel E. Bodammer

Fisheries, Animal and Veterinary Sciences Faculty Publications

A light and electron microscopic study was conducted on dorsal fin tissues adjacent to acute fin erosion lesions in winter flounder from 2 polluted sites (New York Bight region and New Haven Harbor) on the northeast Atlantic Coast. The objective of this work was to evaluate these minimally affected, lesion-associated tissues which may precede the acute or severe stages of the disease. The following 4 types of pathological conditions were found in the epidermis of diseased fish from the 2 polluted sites: (1) epithelial cell hyperplasia; (2) mucous cell hyperplasia and hypertrophy; (3) spongiosis; and (4) focal necrosis. The latter …

The 1960 Presidential Election In Florida: Did The Space Race And The National Prestige Issue Play An Important Role?, Randy Wade Babish Jan 2000

The 1960 Presidential Election In Florida: Did The Space Race And The National Prestige Issue Play An Important Role?, Randy Wade Babish

UNF Graduate Theses and Dissertations

The landmark launch of Sputnik on October 4, 1957, and the subsequent perception that the United States trailed the Soviet Union, not only in space but also in missiles, plagued the Eisenhower Administration for the rest of the decade. The Democratic Party strategy for the 1960 presidential election included using the space race, the alleged missile gap, and declining American prestige abroad to illustrate the need for new leadership in the White House. Senator John F. Kennedy, the Democratic nominee, effectively raised these issues throughout the general election to support his "New Frontier" program and won by the narrowest popular …

Symposium Presentation: Doing Internet Co-Branding Agreements, Eric Goldman Jan 2000

Symposium Presentation: Doing Internet Co-Branding Agreements, Eric Goldman

Faculty Publications

Co-brand agreements are what I do. I am the self-titled "King of CoBrands," as this is what I've been doing with my life.

So, let's talk a little about co-branding agreements and about why they might matter. First let's define our terms.

Now, where there used to be one site, the provider site, there will be two sites, the provider site and co-branded site, which contains the branding of the portal, but contains all the same functionality, or similar functionality, as is in the provider's site.

Then the portal will drive traffic to this co-branding site, for purposes that we'll …

A Determination Of Parentage, Mating System, And Genetic Diversity In A Captive Population Of The Straw-Colored Fruit Bat (Eidolon Helvum), Jan Zinck Jan 2000

A Determination Of Parentage, Mating System, And Genetic Diversity In A Captive Population Of The Straw-Colored Fruit Bat (Eidolon Helvum), Jan Zinck

Dissertations and Theses

Small populations tend to lose genetic variability. The magnitude of this loss is influenced by the number of founding individuals, the genetic diversity of the founders, and the species mating system. Genetic variability is the basis of adaptive evolution, and the loss of genetic variability may have harmful effects on development, growth, and survival. Therefore, a primary management goal for small, captive populations is the retention of genetic variability. Of considerable importance to conservation biology is the determination of parentage, from which mating, genetic, and demographic information can be derived. Microsatellites provide a robust molecular evolutionary tool for the study …

Tell Hesban And Vicinity In The Iron Age, Paul J. Ray Jan 2000

Tell Hesban And Vicinity In The Iron Age, Paul J. Ray

Dissertations

Problem. Tell Hesban is a major archaeological ruin in central Transjordan. It was excavated from 1968-76 by Andrews University. However, almost 25 years after the termination of this endeavor, a final report dealing with the Iron Age remains has not yet appeared. Although relatively little remains from the Iron Age, which is the earliest period represented on the tell, an understanding of what is left is nevertheless important for comprehending the role the site played in the region at this time.

Method. A historical research design has been used in this study. The excavated architectural and soil/debris layers were analyzed …

Profiles Of The Highly Invasive Plants In Oregon Including Lists Of Oregon’S Invasive And Naturalized Plants, Rebekah Jane Harper Jan 2000

Profiles Of The Highly Invasive Plants In Oregon Including Lists Of Oregon’S Invasive And Naturalized Plants, Rebekah Jane Harper

Dissertations and Theses

The study and control of invasive species are important issues in restoration ecology and land management. Invasive species are among the top contributors to habitat degradation worldwide. Unfortunately, information concerning invasive species and methods for their control is limited and widely scattered throughout the literature.

A comprehensive list of the naturalized and invasive species found in Oregon is important for monitoring invasive and potentially invasive species. It also provides a base of information for people interested in investigating invasive species; however, no such state-wide list existed for Oregon before this work.

Profiles for highly invasive species should provide information concerning …

Lawn Dogs And Other Stories, Heather Gaddy Jan 2000

Lawn Dogs And Other Stories, Heather Gaddy

Dissertations and Theses

The wife reminds herself that she must breathe. To find a steady center in the chaos that is her confused rage; this will help to transform her lack of control into that enviable ability to gracefully cope. She knows this from somewhere deep inside of herself, and she also read about it in a book. She takes a big breath, but the calm eludes her. She finds other ways to keep the moment in hand. Counting the husband's movements, watching the crows fly and making decisions about her future according to how they land, combing her hair too hard. Amazingly, …

No studies have been published on Earobics I to this date.

In this study, the effectiveness of Earobics I was analyzed with …

Poetry, Life, Literature, Lawrence Kimmel Jan 2000

Poetry, Life, Literature, Lawrence Kimmel

Philosophy Faculty Research

The question and theme of the poetry of life reaches deep into the essential questions of human existence. In the sense that poetry is the central core of literature, it is essential to the meaning of our lives. This question does not necessarily place human life, nor indeed biological life at the center of inquiry. We will examine the sense in which life itself is poetry, and great literature--in this essay we will refer only to that--is recognized by its capacity to capture and express that poetry. When it does this it penetrates to the heart of human accord and …

Scanning And Transmission Electron Microscopy Of Various Plant And Animal Tissue, Robert Stockley Jan 2000

Scanning And Transmission Electron Microscopy Of Various Plant And Animal Tissue, Robert Stockley

A Study In Computer Animation, Sean A. Woods

Honors Capstones

This capstone project was focused on obtaining a basic understanding of both the technical and creative processes involved in creating a computer animation. The process of obtaining this understanding involved practice in creating small sample still images, animations, stories, and storyboards in order to learn the basics of the chosen computer graphics package, 3D Studio Max. After these practice projects were completed, I applied what I had learned to a final, 30 second computer animation of my own design. The thesis materials include my practice and final stories and storyboards, a CD containing my practice images and animations, as well …

A Traditional Lakota Zoological Folk Taxonomy : An In Depth Study Of Biological And Cosmological Views Of Animal Classification And Nomenclature Among The Lakota, Gerald R. Scott

Honors Capstones

The focus of this work is to record and clarify the traditional views of the Lakota People, in regards to how they name and classify their zoological world. The focus for many ethnozoologists is to study how mankind conceptualizes his natural environment. A number of scholars in ethnozoology have tried to show cross cultural links to possibly explain similarities in the way mankind names and classifies objects in his natural environment. The idea of there being recognizable groupings of animals is found in all languages. These are referred to as ethnozoological categories. According to some scholars (Berlin, Breedlove, and Raven …

Africanized Honey Bee Colonization In The Human Domain: Issues Of Environmental Anthropology In Southern Nevada, Daniel Edward Lebas Jan 2000

Africanized Honey Bee Colonization In The Human Domain: Issues Of Environmental Anthropology In Southern Nevada, Daniel Edward Lebas

UNLV Retrospective Theses & Dissertations

Environmental anthropology seeks to identify issues and propose resolutions when humans are directly affected by environmental consequences or indirectly by policies that may marginalize the concerns of certain populations. Africanized Honey Bees created both environmental and policy consequences in southern Nevada. Identification of the issues was accomplished with literature review, participant observation, informal interview, and conferencing with academic and agency officials related to the human/bee problem. The controversy in risk assessment has implications for urban residents in southern Nevada. Both agricultural and urban environments may be economically and politically impacted by the colonization of feral Africanized Honey Bees. Urban populations …
