Nostalgic Federalism, Judith Olans Brown, Peter D. Enrich
UC Law Constitutional Quarterly
Among the most significant decisions of the Supreme Court over the past decade have been those limiting the scope of congressional authority to act in ways that infringe on the responsibilities and prerogatives of the states. In this article, we review four clusters of such cases - those constraining Congress' powers under the Commerce Clause, those refraining the parameters of section five of the Fourteenth Amendment, cases clarifying the limits on federal authority implicit in the Tenth Amendment, and those expanding the reach of state sovereign immunity. Seeing Childhood In Art Education, Paul Duncum
Journal of Social Theory in Art Education
Art education theory and practice sees children as constructivist learners, but postmodern theory teaches us to see children with multiple and fragmented identities. Postmodern theory is used to examine childhood as a site of divergent discourses concerned with persistent adult attempts to control both actual children and the concept of childhood. Many alternative conceptions find pictorial form in the mass media, from abused child to nightmarish threat. This paper focuses on the idea of children as rabid consumers. It examines television advertisements aimed at children, especially by McDonald’s, Mattel and Cap Toys. Implications for the classroom as well as art …

The effect of the intravenous injection of amitraz (0.1 mg/kg) to horses on cardiac activity, respiratory rate, intestinal motor activity, rectal temperature, sweating and masticating was evaluated and compared to the effect of intravenous administration of xylazine (1mg/kg, iv) on heart rate, respiratory rate and intestinal activity. Amitraz caused a significant decrease in heart activity, respiratory rate and intestinal movements, but these effects were not as pronounced as those caused by xylazine. Amitraz also caused a significant relaxation of the rectal smooth muscle, and an apparent increase in sweating and in the frequency of horses found masticating hay. Rectal temperature …

Religious Clubs In The Public Schools: What Happened After Mergens?, Dena S. Davis

The Equal Access Act, upheld by the Supreme Court in Board of Education v. Mergens, requires public secondary schools to allow access to religiously based student groups on the same basis as other student clubs. Mergens presents many challenges to civil libertarians, who may find their traditional sympathies aligned on both sides of the issue. This article seeks to throw light on some of those issues by reporting on a research project that ascertained the actual effect of the Act on public high schools in Ohio.

The main research focus of this study was on the regional differences in understanding of two groups of high school science students for a complex environmental scientific phenomenon known as the Dead Zone of the Gulf of Mexico. Participating high school students were drawn from Dead Zone source and effect areas---Iowa chemistry students and Louisiana environmental science students. Students were given a pre- and postinstructional survey concerning environmental issues---including the issue of the Dead Zone or hypoxia of the Gulf of Mexico. There has been extensive research concerning various instructional procedures for the acquisition of spelling skills. Many research-based principles of effective spelling instruction have emerged from one of two contrasting models for the development of spelling competence. Traditionally, spelling has been taught with textbooks and workbooks. Students followed a structured program with the goal oflearning to spell the weekly list of words. According to the traditional model, spelling is taught as a separate curriculum. Advocates for spelling reform suggest spelling instruction should be based on the understanding of the developmental nature of the child. This project report provides guidelines and strategies …

The process by which literacy develops in children and ways to promote literacy development were studied. The review of related literature showed support that children's literacy development begins in infancy, that it develops through a set of stages, and that active involvement of parents and caregivers does promote literacy development. A handbook for parents of children from preschool through elementary school was created. The handbook includes a continuum of literacy development and activities to encourage its growth.

The significance of phonemic awareness in initial reading acquisition was researched. The research suggests that those children without phonemic awareness will struggle with learning to read. A handbook for educators was created to compliment existing curriculum. This handbook contains songs and activities either extracted from or modeled after those that had already been field tested in many classrooms.

The purpose of this project was to develop a model music curriculum for elementary-level students in Taiwan. With the current music curriculum utilized recently in Taiwan, this project will help the elementary-level students to develop their music potentials. In addition, teachers can educate students according to their level oflearning at different periods of time. To accomplish this purpose, a review ofrelated literature was conducted. Additionally, selected materials were obtained and adapted for use.

Howard Gardner's theory of Multiple Intelligences involves eight different ways to learn (linguistic, logical-mathematical, visual-spatial, bodily-kinesthetic, musical, naturalistic, interpersonal and intrapersonal). These categories of intelligence, along with the guidelines of Washington State's Essential Academic Leaming Requirements, were applied to thirty lessons that were derived from the fifth grade curriculum at Tieton Middle School in Tieton, Washington. The lessons reflect the fields of reading, writing, mathematics, science, social studies and health/fitness.
