Stop Me If I'Ve Heard This Already: The Temporal Remoteness Aspect Of The Subconscious Copying Doctrine, Joel S. Hollingsworth

This article examines the temporal remoteness aspect of copyright law's subconscious copying doctrine. Under this doctrine, copyright infringement defendants can be held liable for infringement, even if they believe that they independently created their work, if the defendants had access to the copyrighted work, the works are practically identical, and the degree of temporal remoteness - the time between access and subsequent creation of the infringing work - was low. Embryonic testis development requires the morphogenesis of cords and growth of all cell populations to allow organ formation. It is anticipated that coordination of the growth and differentiation of various cell types involves locally produced growth factors. The current study was an investigation of the hypothesis that transforming growth factor- α (TGF-α) is involved in regulating embryonic testis growth. TGF-α has previously been shown to function in the postnatal testis. TGF-α and other members of the epidermal growth factor (EGF) family act through the epidermal growth factor receptor (EGFR) to stimulate cell proliferation and tissue morphogenesis. Source of Primers. PCR primers were designed from the published sequence for porcine vitamin D-25-hydroxylase (CYP25) cDNA (GenBank accession no. Y16417). The position of the forward and reverse primers corresponds to 506 to 530 bp and 830 to 854 bp, respectively, of the cDNA. The primer pair amplified a 348-bp fragment of the cDNA and an 862-bp fragment from the pig genomic DNA. The 862-bp fragment (Gen- Bank accession no. The most eloquent and moving words Abraham Lincoln ever uttered about any community were those "few and simple words" he spoke on the rear platform of the railroad car that lay waiting on the morning of February 11, 1861, to take him to Washington, to the presidency, and ultimately to his death. Tort Liability, Religious Entities, And The Decline Of Constitutional Protection, Scott C. Idleman

This article examines the long-term viability of the First Amendment prohibition on the adjudication of legal actions requiring the resolution of religious questions, such as disputes over theological doctrine, scriptural interpretation, or ecclesiastical law. In particular, the article focuses on tort suits against religious institutions and clergy, often stemming from the latter's alleged misconduct towards congregants or children. Part I contends that the bar on certain tort actions is actually an application of a more general prohibition on the adjudication of religious questions and examines the contours of this prohibition and its specific application in the tort context. The Effects Of Bios Life And Exercise On Total Cholesterol, Serum Low-Density Lipoprotein, And High-Density Lipoproteins, Lori Jan Inderlied-Rucks

The present study was designed to determine the effects of Bios Life, a non-prescription dietary fiber supplement, on serum lipoproteins and determine whether exercise accentuates this effect. Fifty male and female subjects (ages 30--60) participated in the study. Twenty-five subjects were exercising regularly in a supervised exercise program and the other twenty-five were sedentary. All participants where required to have a LDL-C of 130 mg/dl or higher and none were on any cholesterol lowering medications. Blood was drawn three times at baseline, before the study started, 45 days into the program and at 90 days which was the end of …

To study transmission patterns of Pneumocystis carinii pneumonia (PCP) in persons with AIDS, we evaluated P. carinii isolates from patients in five U.S. cities for variation at two independent genetic loci, the mitochondrial large subunit rRNA and dihydropteroate synthase. Fourteen unique multilocus genotypes were observed in 191 isolates that were examined at both loci. Mixed infections, accounting for 17.8% of cases, were associated with primary PCP. Genotype frequency distribution patterns varied by patients' place of diagnosis but not by place of birth. Genetic variation at the two loci suggests three probable characteristics of transmission: that most cases of PCP do …

Is meat with its high fat content the real culprit, or is it the FDA-approved growth hormones, the same hormones that have been rejected in Europe, that should bear the blame? Why is eating less meat associated with a lower incidence of many types of cancer? Could it be chemical overload? American women are about five times more likely to develop breast cancer than are women in less developed countries.

Artificial Reef Research In Broward County 1993-2000: A Summary Report, Richard E. Spieler

Broward County Department of Planning and Environmental Protection (DPEP) and Nova Southeastern University (NSU) have been collaborating on artificial reef research for the past seven years. This paper gives a brief overview of ten completed studies from 1993-2000. These studies entailed approximately 1000 hours of artificial reef construction, 2000 hours of SCUBA diving, 1300 hours of boat time and 1000 hours of data analysis. A detailed discussion of the results has been, or will be, published elsewhere (Gilliam et al., 1995; Sherman et al., 1999; Gilliam, 1999; Sherman, 2000; Sherman et al., in press a, b). In this study, we evaluated the goldfish model of hemilabyrinthectomy for investigating potential recovery-promoting drugs. In this lesion model, the unilateral removal of the labyrinth induces a postural imbalance in response to light (Dorsal Light Reflex), from which the animals can recover over time. The behavioral effects of two neuropeptides were tested–namely, of substance P and ACTH4-10, both of which are known to promote functional recovery in several other lesion models. Furthermore, the effect of MK- 801, an antagonist of the glutamatergic NMDAreceptor subtype, was tested because this substance has also been shown to exert a neuroprotective effect. After lesion …
