Despite the continuing "war on drugs," the last decade has witnessed the creation and nationwide spread of a remarkable set of institutions, drug treatment courts. In drug treatment court, a criminal defendant pleads guilty or otherwise accepts responsibility for a charged offense and accepts placement in a court-mandated program of drug treatment. The judge and court personnel closely monitor the defendant's performance in the program and the program's capacity to serve the mandated client. The federal government and national associations in turn monitor the local drug treatment courts and disseminate successful practices. Ruling Sexuality: The Political Legitimacy Of Isabel Of Castile, Elizabeth Lehfeldt

This article examines the gendered construction of power during the reign of Isabel of Castile (1474-1504). The construction of her political legitimacy was based on her manipulation of her gender and sexuality intended to contrast with the perceived shortcomings of her brother, Enrique IV. Enrique's critics had impugned his sexuality and attacked his inability to deliver Spain into a golden age. By aligning Isabel with sexually chaste models and emphasizing her ability to redeem Spain both because of and despite her gender, Isabel's partisans crafted an image that allowed her to transcend the misogynist tropes that attacked female rule.

“Waive” Goodbye To Tort Liability: A Proposal To Remove Paternalism From Product Sales Transactions, Richard C. Ausness

This Article argues that waivers of tort liability should be permitted in connection with product sales. Currently, sellers cannot limit their liability under tort law for personal injuries caused by defective products even though such waivers are allowed, albeit reluctantly, under principles of negligence and warranty law. Existing principles of products liability law should be modified, either by legislation or by court action, to allow at least limited use of these waivers.

This first issue of The SIT Occasional Papers Series hardly resembles most publications of its type. Describing our institution, an idea proposed by Tidiane Gadio, a member of the original Editorial Board, turned out to be a far weightier task than expected. Nonetheless, it proved to be an interesting way to help staff and faculty from the various departments of World Learning, as well as our constituencies, gain a comprehensive view of this fascinating organization, to learn about all of its parts, and to tell our story like it has never been told before — to ourselves and to others. …

The paper analyzes the survey methods applied by them. The task of easing data collection should be regarded as a continuous process. This is relevant even to the most developed economies with sophisticated technology for data collection and processing. The Marshall case is the latest in a long series of Supreme Court of Canada decisions concerned with the interpretation of treaties between the Crown and aboriginal peoples in Canada. While the majority and minority judgments agreed on the principles of treaty interpretation to be applied in the case, the significant divergence in opinion between the majority and minority decisions provides important commentary on the differences between articulating and applying these principles. The Marshall case is also noteworthy for the manner in which it addresses similarities and differences pertaining to aboriginal and treaty rights. Because of these various traits, the …

In the half-century ending about the time of Confederation a dozen writers addressed awkward questions about an earlier generation's dispossession of Maritime Amerindians from land and resources: had it been lawful; if so, how; if not, what should be done? In the main they approached it as an abstract question, divorced from those particulars of local history that would become the focus of late-20th-century investigation. The creation of the Canadian Judicial Council in 1971 and the gradual disappearance of county and district court judges into the superior court judiciary filled a lacuna in the Constitution Act, 1867. The tenure of county court judges was less secure than that of superior court judges, which was constitutionally entrenched and protected. The Judges Act, passed originally to provide for the removal of county court judges, articulated a mechanism which was extended to superior court judges at about the same time as county and district courts were beginning to disappear from the Canadian judicial scene. For unknown reasons horses went extinct on the North American continent approximately ten thousand years ago and were subsequently reintroduced by Spanish settlers in the 1400's. As European settlers moved westward, horses were perceived as competition for grasslands and their numbers were curtailed. Wild horses were granted Federal protection in 1959 with the passage of the 'Wild Horse Annie' law and further protected with the passage of the Wild, Free-Roaming Horse and Burro Act of 1971. Through the Department of the Interior, the Bureau of Land Management was charged with management of wild horses on public lands. Physical searches of …

Sea turtles appeared more than 200 million years ago in the late Triassic period. They grow very slowly, taking an average of 25 years to reach sexual maturity, with a life span averaging 40-50 years. From May to October green sea turtles (Chelonia mydas) emerge during the night and follow light cues toward the sea. Recently, beachfront development has increased hatchling mortality rate. When hatchlings emerge from nest, high densities of artificial lights lead them toward the land where they either desiccate and die, or are preyed upon. Deposition And Uptake Availability Of Lead Shot For Waterfowl At Honeybee Pond Within The Overton Wildlife Management Area, Nevada, Usa, Jason Eckberg

Lead shot has been banned for hunting waterfowl since 1974, but lead poisoning continues to be a major problem in many waterfowl habitats. In December of 1999, soil samples were collected from the Honeybee pond at the Overton Wildlife Management area to determine the lead pellet concentration and the availability of lead shot to waterfowl. There were no shot pellets recovered from the thirty-one samples taken from the pond. Based on this information waterfowl do not appear to be exposed to lead in the pond areas at OWMA.

During the summer of 1999, soil samples were taken from the Overton Wildlife Management Area (OWMA), located in the Moapa Valley of Clark County, Nevada. Although lead shot has been banned for the hunting of waterfowl since 1986, it is still legal for upland game hunting. The field sampled serves primarily as a dove hunting area and is cultivated. A large sample size was taken to indicate the short-term effects of the deposition of lead shot in the area and a small sample size, the long-term. Lead shot was recovered from 64% of the small samples and the estimated concentration …

Reconciling Trade And Environment: A Legal Analysis Of European And North American Approaches, Bradly J. Condon
Cardozo Journal of International and Comparative Law
The article examines the differing approaches of the European Union (EU) and the North American Free Trade Agreement (NAFTA) in reconciling trade liberalization with environmental protection. While the EU employs a proportionality principle that prioritizes environmental protection over trade in cases of conflict, NAFTA uses a least-trade-restrictive principle to balance these interests. The analysis highlights that both systems reflect distinct political, economic, and legal frameworks but could benefit from learning each other's strengths and addressing their respective weaknesses.

Coryneform bacteria are frequently isolated from bovine mastitis and these infections are associated with economic losses. Corynehacterium bovis, a lipid requiring species, has been the most frequently isolated coryneform from the milk of infected bovine mammary glands. However, the taxonomic status of this organism is uncertain. In the current study, a polyphasic approach was used to identify coryneform bacteria isolated from bovine mastitis and determ ine the phylogenetic relationships among the identified species. A total of 212 coryneform bacteria isolated from bovine mastitis was obtained from mastitis reference laboratories in the United States and Canada. Presumptive identification based upon …
