The New Establishmentarianism, Michael W. Mcconnell

Chicago-Kent Law Review

This Article responds to the notion that government should identify and enforce a set of common beliefs and values, which McConnell calls "establishmentarianism." McConnell argues that establishmentarianism is inferior to the view that the values of society must emerge from the free institutions of civil society (liberalism). In doing so, McConnell explores the irony that modern insistence on diversity can go beyond mere tolerance of dissenting viewpoints and undermine the diversity and pluralism of society as a whole. Pluralism consists of a variety of different groups; an insistence on pluralism within groups has a homogenizing effect. Specifically, the Article addresses …

No Time Is The Right Time: The Supreme Court's Use Of Ripeness To Block Judicial Review Of Forrest Plans For Environmental Plaintiff's In Ohio Forestry Ass'n V. Sierra Club, Eacata Desiree Gregory

Chicago-Kent Law Review

This Comment examines the Supreme Court decision that resolved the split in the circuits over the justiciability of Land and Resource Management Plans, or Forest Plans, which the Forest Service prepares. In Ohio Forestry Ass'n v. Sierra Club, the Court denied the Sierra Club's challenge to the Forest Plan for Wayne National Forest, holding that the issues were not ripe for review absent site-specific, on-the-ground activities. Gregory argues that the Court's decision reflects the continuing use of justiciability doctrines, such as ripeness, to restrict environmental plaintiffs' access to the courts. The articles and commentaries in this Symposium are excellent points of departure for reflecting upon the advances thus far achieved in the evolution of this still very young community of scholars. The articles and commentaries that follow this brief Introduction comprise the second "free-standing" law review Symposium on LatCrit theory organized specifically in response to student interests and initiatives. The timing is fitting, for this Symposium also coincides with the fifth anniversary of LatCrit theory's emergence in the American legal academy. Hate Exposed To The Light Of Day: Determining The Boy Scouts Of America's Expressive Purpose Solely From Objective Evidence, Cara J. Frey

In the 1980s, the U.S. Supreme Court took considerable steps toward decreasing the uncertainty surrounding an organization's associational freedoms by requiring an organization seeking to exclude individuals solely based on status to prove that its expressive purpose would be undermined if it included such members. However, these Supreme Court cases failed to establish any consistent approach to determining an organization's expressive purpose. Problems have arisen most acutely with the claims of gays seeking to be included in the Boy Scouts of America (BSA), an organization with a multifaceted and vague message. Factor Analysis Of Theological Constructs Related To Fatalism And Free Will, M. Ardell Broadbent

Issues in Religion and Psychotherapy

A questionnaire was used to determine to what degree members of the Church of Jesus Christ of Latter-day Saints endorse doctrinal statements concerning foreknowldge and determinism. A factor analysis of the questionnaire results confirmed lay constructs about an apparent polarization between members who hold strictly literal interpretations of omniscience and omnipotence as opposed to those who hold interpretations further removed from mainstream Christendom but whose positions are validated by LDS doctrine. The relation of demographic variables to the constructs was explored. The existence of simultaneously held conflicting beliefs was confirmed. Some implications for LDS therapists are discussed. The "real world" means different things to different people. To many in the Boise State community, it refers to the "real education" students receive because of the university's location in the state capital as well as its proximity to corporate headquarters, high-tech businesses, cultural centers, major hospitals and a vast expanse of wilderness. But not everyone agrees that the university's "Real Education for the Real World" slogan is an apt depiction. Settlement Patterns And The Origins Of African Jamaican Society: Seville Plantation, St. Ann's Bay, Jamaica, Douglas V. Armstrong, Kenneth G. Kelly

Faculty Publications

Archaeological and historical research at Seville Plantation, Jamaica, are used to explain changes in settlement patterns within the estate's African Jamaican community between 1670 and the late nineteenth century. Sugar plantations, such as Seville, are marked by well-defined spatial order based upon economic and power relations that was imposed upon enslaved communities by planters and managers. Archaeological evidence is used to explore how enslaved Africans modified this imposed order and redefined boundaries in ways that correspond with the development of a distinct African Jamaican society.
