Grotius Repudiated: The American Objections To The International Criminal Court And The Commitment To International Law, Marcell David

This article analyzes the American objections to the Statute. Part I describes the historical precedents for a permanent international criminal court and the drafting process undertaken. Part I concludes with a summary of the sections of the Statute which are implicated by the American objections. These statutory sections include the Statute's definitions of crimes, the role of the Prosecutor, the Court's anticipated relationship with the U.N. Security Council, and the Court's anticipated jurisdiction over states not party to the Statute. Part II selects three recent or current instances where the United States has used armed force, and analyzes the claims …

Traditionally, populists have claimed the Second Amendment as their particular cultural property; by contrast, outgroups and elites have found the Amendment somewhat culturally alien. Recently, some outgroup members have argued that their groups ought to embrace the Amendment because the right to keep and bear arms can be a valuable way of resisting populist oppression. This Article explores this changing multicultural landscape of the Second Amendment It recognizes that in particular instances and in the short term, outgroups might need to arm themselves against hate violence. It argues, however, that only a consensus culture on the use of violence will …

Experiments in ship camouflage during World War I were necessitated by the inordinate success of German submarines (called "U-boats") in destroying Allied ships. Because it is impossible to make a ship invisible at sea, Norman Wilkinson, Everett L. Warner and other artists devised methods of course distortion in which high-contrast, unrelated shapes were painted on a ship's surface, thereby confusing the periscope view of the submarine gunner.

Of growing debate among those concerned with American political culture and democratic theory is the modern conception ofliberal democratic theory. This work attempts to broaden our understanding ofdemocracy. I will argue that modern liberalism has narrowed our conception of individual liberty. This narrowed focus has produce a reliance on the use ofpublic regulation and interest group pressure as substitutes for civic engagement. In an attempt to move past a mere critique of narrow liberalism, this essay will develop a research design and an empirical test to measure our current political culture's support for a robust democracy and its future prospects …

Economic sanctions have proliferated in the last half of the twentieth century, and become the "first choice" of policymakers seeking tools to address many complex international issues. A key feature of these various sanctions programs is the use of a blacklist, to bring third party agents, controlled entities, and corporate cloaks operating elsewhere within the ambit of the sanctions aimed at a particular country or destination. These blacklists have now grown to include several thousand individuals and entities. Throughout the military history of the twentieth century, the role of aerospace forces has become more predominant. Today, wars typically start, are prosecuted, and reach their decisive culminating point--whether surrender of a foe, agreement to a ceasefire, or the ceasing of combat operations--thanks to air action. Given these circumstances, to lose control of the air is to lose a war, particularly in an era (as we now are in since the end of the Cold War) when deployable overseas forces are small, and, thus, particularly vulnerable to the tremendous leverage an opponent gains by sudden and swift air attack. Clear And Present Danger: Enforcing The International Ban On Biological And Chemical Weapons Through Sanctions, Use Of Force, And Criminalization, Michael P. Scharf

Currently there are two means of enforcing the international prohibition of chemical and biological weapons. First, the international community can induce compliance through imposition of sanctions, such as trade embargoes, freezing of assets and diplomatic isolation. Second, when sanctions fail, States can individually or collectively respond to the threat of chemical or biological weapons by using military force. After exploring the potential strengths and weaknesses of these approaches, this article examines the desirability of supplementing them with a third approach based on the criminal prosecution of persons responsible for the production, stockpiling, transfer, or use of chemical and biological weapons.

When the Black Panthers screamed of an armed black populace on the verge of a revolution in 1966, the California Legislature responded with a gun control statute. While many journal articles have been written on the topic of race and guns, none have examined the history and motivations behind the California Legislature's decision to enact a gun control statute in 1967 for the purpose of disarming the members of the Black Panther Party. Notwithstanding complaints about incoherence in Establishment Clause doctrine, courts by and large administer the Clause responsibly. They do so by mediating between a number of powerful considerations, none of which can ever be entirely disregarded. These considerations include, but are not limited to, separation of church and state, the value of religiosity, the imperative of affording equal treatment to religious and similarly situated nonreligious entities, and the proper role of courts in a democratic political system. This is not to say that courts cannot overstep their bounds and provoke an adverse reaction from other powerful elements within the polity. It …

A dilatometer based on the cantilever beam concept has been developed. The dilatometer is easy to use and capable of measuring transverse strain response of soft polymer films in a broad strain range (from 10(-7) to 10(-1)) without mechanical constraining of the sample. It is capable of detecting strain over a relatively wide frequency range from mHz to above 100 Hz under different load and temperature. Using the setup, the electric field induced transverse strains of the electrostrictive poly(vinylidene fluoride-trifluoroethylene) copolymer films were characterized which shows that a large transverse strain can be achieved in this class of polymer. We present the results of modeling of nanosecond pulse propagation in optically absorbing liquid media. Acoustic and electromagnetic wave equations must be solved simultaneously to model refractive index changes due to thermal expansion and/or electrostriction, which are highly transient phenomena on a nanosecond time scale. Although we consider situations with cylindrical symmetry and where the paraxial approximation is valid, this is still a computation-intensive problem, as beam propagation through optically thick media must be modeled. We compare the full solution of the acoustic wave equation with the approximation of instantaneous expansion (steady-state solution) and hence determine the regimes of validity …

Electrical and Computer Engineering Faculty Research & Creative Works

A cascaded two-level power converter is proposed which utilizes two six-transistor inverters and is capable of producing voltages which are identical to those of three-level and four-level converters. Since the machine voltages are the same, the converter performance is the same as is verified through laboratory tests. The advantages and disadvantages of the proposed cascaded converter are explored. The proposed converter is simpler to construct and offers more nonredundant switching states per number of active semiconductors than standard multi-level converters

Most recent Alexander historians - especially those writing after Stonewall - assume that the friendship of Alexander the Great and Hephaistion Amyntoros was not purely platonic.² Despite this, the names of Alexander and Hephaistion rarely find their way into modem lists of ancient lovers, nor are they much mentioned in studies of Greek homoeroticism³ - perhaps because they fail to fit the model first detailed by K.J. Dover in 1978. This dichotomy is a curiosity of recent specialization in classics. Alexander historians assume the affair while historians of Greek sexuality ignore it. In any case, the matter of …
