Credit Or Debit? Unauthorized Use And Consumer Liability Under Federal Consumer Protection Legislation, Daniel M. Mroz
Credit Or Debit? Unauthorized Use And Consumer Liability Under Federal Consumer Protection Legislation, Daniel M. Mroz
Northern Illinois University Law Review
Although debit cards may closely resemble credit cards in appearance, consumer liability for unauthorized use is not similar and the payment transaction initiated through use is very different. In response to the increasing use of debit card products, consumer protection issues concerning liability for unauthorized use have been raised, new legislation has been introduced to Congress and an extremely lucrative debit card market has prospered. Sections I through IV of this comment provide an overview of the federal Truth in Lending Act and of the federal Electronic Fund Transfer Act in relation to consumer liability issues concerning the use of …
Georgia's Public Duty Doctrine: The Supreme Court Held Hostage, R. Perry Sentell Jr.
Georgia's Public Duty Doctrine: The Supreme Court Held Hostage, R. Perry Sentell Jr.
Mercer Law Review
A study published in 1994 sought to determine the single most litigated topic in Georgia local government law over the past thirty years. What legal issue of local government administration had most often confronted Georgia's appellate courts over that recent but considerable span of time? The revealed answer to that inquiry commanded serious consideration-not because of its unexpectedness but rather its unequivocal conclusiveness:
Local government liability for the alleged misconduct of officers and employees dwarfs all other subtopics. For the past thirty years, liability has extracted more time and attention from Georgia's appellate courts than any other subject of local …

Co-Parenting Influences: A Positive Report For The Millenium, Andrea Chrismer-Still
Co-Parenting Influences: A Positive Report For The Millenium, Andrea Chrismer-Still
Theses
In this correlalional study of later adolescents who experience parental divorce, six co-parenting influences were assessed in an effort to identify predictors and factors that contribute to overall satisfaction with life. Subjects completed a survey comprised of demographic information which included an adaptation of a survey (Silitsky, 1996), a Satisfaction with Life Scale (SWLS) (Diener, E. Simmons, R. Larsen, R. & Griffin, S., 1985), and a Perceived Social Support Family Scale (Pss-Fa) (Procidano, M & Heller, K., 1983). The adapted scale and the PSS-Fa measured perceptions by the later adolescent of their family of origin and their levels of()) parental …

A Study Of The Relationship Between The Ego Identity And Reported Relationship Satisfaction Of Lesbian Women In Long Term Relationships, Sheila D. Reed
Theses
This study examined the connection between ego identity and relationship satisfaction in lesbian couples. Thirty-two lesbian women in the Missouri and Illinois bi-state area responded to a demographic survey and two measurement scale questionnaires. The questionnaires used were the Relationship Assessment Scale (RAS) and the Ego Identity Scale (EIS). The results of this study did not indicate a relationship between ego identity and relationship satisfaction. The findings are discussed and suggestions are given for further research.
Firstborn Children And Their Perception Of The Family Environment In Intact And Divorced Families, Nelda Wetzel
Firstborn Children And Their Perception Of The Family Environment In Intact And Divorced Families, Nelda Wetzel
Theses
Profound structural changes in American families over the past three decades have transformed "traditional" living arrangements for children and stimulated a great deal of interest regarding children and their well-being. How firstborn children perceive their family environment is the main focus of this study (Causal-Comparative). A relationship was investigated between the family structure of intact and divorced families and firstborn's perception of the family environment. Ninety-seven firstborn children, 52 from intact families and 45 from divorced families, between the ages of 8-12, evaluated their family environment by responding to the CV/FES. Using the t test (two sided) for independent samples, …

Dielectric Plug-Loaded Two-Port Transmission Line Measurement Technique For Dielectric Property Characterization Of Granular And Liquid Materials, K. Mubarak, R. Zoughi, Aaron D. Benally, Karl Joseph Bois, Larry F. Handjojo
Electrical and Computer Engineering Faculty Research & Creative Works
There are numerous dielectric property characterization techniques available in the microwave regime each with its own uniqueness, advantages and disadvantages. The two-port completely-filled waveguide (transmission line) technique is a robust measurement approach which is well suited for solid dielectric materials. In this case, the dielectric material can be relatively easily machined to fit inside the waveguide and the subsequent measurement of the scattering parameters of this two-port device renders the dielectric properties of the material filling the waveguide. However, this technique is not well suited for measuring the dielectric properties of granular and liquid materials. These materials are used in …
A Case Study Of Process Servers In Clark County, Nevada In The District Attorney Criminal Division, Amy M. Meedel
A Case Study Of Process Servers In Clark County, Nevada In The District Attorney Criminal Division, Amy M. Meedel
UNLV Theses, Dissertations, Professional Papers, and Capstones
In 1996 the job classification of Process Server was created in the Clark County District Attorney Criminal Division in Las Vegas, Nevada. It was implemented by DA Stewart L. Bell as a cost-saving measure meant as a reclassification of the position of Investigator. Since the initial job posting, the duties appropriate to the position of Process Server have been and remain in question. No written, measurable job performance standards have been established and no consistent training or supervision provided. A review of the literature suggests wide variance in what may be considered appropriate job duties for this classification, though the …
Internally Constrained Mixtures Of Elastic Continua, Stephen M. Klisch
Internally Constrained Mixtures Of Elastic Continua, Stephen M. Klisch
Mechanical Engineering
A treatment of internally constrained mixtures of elastic continua at a common temperature is developed. Internal constraints involving the deformation gradient tensors and the common mixture temperature are represented by a constraint manifold, and an internally constrained mixture of elastic continua is associated with each unique equivalence class of unconstrained mixtures. The example of intrinsic incompressibility of each constituent first proposed by Mills is discussed.

Physiological And Genetic Mechanism(S) Of Cold Acclimation In Rhododendron, Chon Chong Lim
Physiological And Genetic Mechanism(S) Of Cold Acclimation In Rhododendron, Chon Chong Lim
Graduate Theses, Dissertations, and Problem Reports (ETD)
An in vitro laboratory protocol for assessing cold hardiness (CH) in rhododendrons based on electrolyte-leakage was developed. The raw leakage data were transformed into percent-adjusted injury, which showed high correlation with injury data based on visual observations. The percent-adjusted injury data---fitted to the Gompertz function coupled with the Jackknife method---allowed for reliable and statistically sound estimations of Rhododendron leaf freezing-tolerance (LFT). Utilizing this method, Tmax values for Rhododendron cultivars, species, and populations were determined and ranked relatively. Our observation of a continuous distribution of LFT in F2 and backcross (BC) populations derived from a R. catawbiense x R. fortunei cross …

Performance Evaluation Of Exhaust Aftertreatment Devices Used For Emissions Control On Diesel Engines Employed In Underground Coal Mines, Daniel K. Carder
Graduate Theses, Dissertations, and Problem Reports (ETD)
This study was initiated to assist the WV Diesel Equipment Commission in its promulgation of initial rules, requirements, and standards governing the operation of diesel-powered equipment in underground coal mines. Four different engines and various exhaust after treatment devices that represent current levels of in-use technology were selected for performance evaluation. Both eddy-current and water-brake dynamometers were used to load the engines according to an ISO 8-Mode test cycle. Experimental emissions data, sampled from a full-flow dilution tunnel, suggests that particulate traps can reduce the mass emission rates of particulate matter (DPM) by nearly 90%, while reductions in fuel sulfur …

Bending Behavior Of Concrete T-Beams Reinforced With Glass Fiber-Reinforced Polymer (Gfrp) Bars, Rajesh Kumar Kalluri
Graduate Theses, Dissertations, and Problem Reports (ETD)
Concrete slabs are integrally cast with girders or stringers (stiffening system) resulting in floor slabs, bridge decks, footers, retaining structures and others. A portion of slab between a stiffening system acts as flange and bends in unison with the stiffening system, i.e., classic T-beam action. The emphasis of this study is to determine the effective flange width, failure modes, deformability factors, pre- and post-cracking deflections and crack widths at first crack and at ultimate failure of T-beams.;Eight concrete T-beams with two different flange widths and two reinforcement configurations were tested under four point bending to study the factors cited above. …

Methods And Techniques For Production Of Genetically Modified Maize At Monsanto Global Seed, Michelle Renee Mcgehee
Methods And Techniques For Production Of Genetically Modified Maize At Monsanto Global Seed, Michelle Renee Mcgehee
Honors Theses
The development of transgenic plants for agricultural purposes consumes much time and energy but is well worth the battle. From the laboratory perspective, hours are spent trying to force plant cells to uptake new DNA. Several methods are available for this practice, including Ti-plasmid mediated transformation, microprojectile bombardment, and electroporation. Each method depends primarily on the organism one wishes to transform. Once the gene of interest has been inserted, the seed from these transgenic plants goes to pilot stations to be grown in nurseries and yield production fields and tested for resistance against many elements. The final product is put …

Taking R&E To The Next Level, Thomas W. Blaine, Stephen Hudkins, Charles R. Taylor
Journal of Extension
During the late 1980s, the business retention and expansion (R&E) program emerged as one of the most successful programs in Ohio State University Extension's Community Development area. As the economic recovery of the early 1990s turned into an economic expansion, business and civic leaders began to shift focus from general R&E efforts to issues related to labor force preparedness. A survey of businesses in Portage County undertaken four years after completion of an R&E program reveals that, while employers believe that local resources are available to help improve basic math and communication skills of employees, those skill levels are still …

An Environmental History Of The 19th Century Marquette Iron Range, Doug Ottke
An Environmental History Of The 19th Century Marquette Iron Range, Doug Ottke
Theses and Dissertations
The history of the Marquette Iron Range in the upper peninsula of Michigan is integrally linked to the environment. The natural features of the Marquette Range defined the mode of production on the Range, and conversely, as human systems became more adept in these modes of production they became the most important modifiers of the natural systems.
Settlement on the Marquette Iron Range was closely related to two factors of natural environment: the iron ore formations and the hardwood forest. The distribution of three iron ore formations—principally the Negaunee, but also the Bijiki and other Iron- formations within the Michigamme …

Let's Make Lawyers Happy: Advocating Mandatory Pro Bono, Donald Patrick Harris
Let's Make Lawyers Happy: Advocating Mandatory Pro Bono, Donald Patrick Harris
Northern Illinois University Law Review
Proponents of mandatory pro bono argue that lawyers have an obligation to provide free services because, among other things, the practice of law is a profession. Proponents further argue that mandatory pro bono is justified because lawyers enjoy a "monopoly" of the legal system, and with that monopoly comes an obligation to provide public service. Additionally, they argue there is a strong tradition of providing public service suggesting continued commitment to pro bono service and an attorney has a moral obligation to see that those already handicapped do not suffer the cumulative disadvantage of being without proper legal representation. Opponents …

Looking Ahead To Ethics 2015: Or Why I Still Do Not Get The Aba Model Conflict Of Interest Rules, Richard E. Flamm
Northern Illinois University Law Review
Ideas about what constitutes ethical conduct--and, more specifically, about what the law governing lawyers should be--would appear to be in a perpetual state of flux. Whether because of perceived problems with existing ethical rules, changes in the way law has come to be practiced, or a melange of other reasons including political expediency, it seems that a call goes out every fifteen years or so-for a reappraisal of the rules regulating the way lawyers conduct their affairs. One such call, put out in the late 1960s, ripened into the ABA Model Code of Professional Responsibility (1970). Thirteen short years later …
Recovering The Original Fourth Amendment, Thomas Y. Davies
Recovering The Original Fourth Amendment, Thomas Y. Davies
Michigan Law Review
Claims regarding the original or intended meaning of constitutional texts are commonplace in constitutional argument and analysis. All such claims are subject to an implicit validity criterion - only historically authentic assertions should matter. The rub is that the original meaning commonly attributed to a constitutional text may not be authentic. The historical Fourth Amendment is a case in point. If American judges, lawyers, or law teachers were asked what the Framers intended when they adopted the Fourth Amendment, they would likely answer that the Framers intended that all searches and seizures conducted by government officers must be reasonable given …

Three-Dimensional Structure Of The Gly121tyr Dimeric Form Of Ornithine Decarboxylase From Lactobacillus 30a, Jacqueline Vitali, Donald Carroll, Rochika G. Chaudhrya, Marvin L. Hackert
Physics Faculty Publications
Ornithine decarboxylases catalyze the conversion of ornithine to putrescine at the beginning of the polyamine pathway. Ornithine decarboxylase (ODC) from Lactobacillus 30a is a 990612 Da dodecamer composed of six homodimers. A single point mutation (Gly121Tyr) was found to prevent association of dimers into dodecamers. The dimeric protein has been crystallized at pH 7.0 in the presence of guanosine triphosphate (GTP). Crystals belong to space group P3221, with unit-cell parameters a = 111.8, c = 135.9 Å and one monomer in the asymmetric unit. The structure was determined by molecular replacement and refined using simulated annealing to …
