Professor Mitchell illustrates that Client-centered Representation does not simplistically reduce to a single admonition: Tell the client's story. The concept is far more nuanced than that. It incorporates a constellation of ideas. Listen to the client's story. Hear what they want. Try to be creative about ways to tell the story. Look for opportunities to bring their story into the legal process. At the same time, the attorney must join together to discuss any risks and problems which may result from various strategic choices, including the risks in even telling the story and whether those risks are worth it to …

Imperatives, Normativity, And The Law, Gregory Silverman

In this article Professor Silverman sets out to resolve the problem of legal normativity. Professor Silverman argues that legal scholars have been prevented from transcending the limited conception of law engendered by a key dogma of nineteenth century jurisprudence: the dogma that laws are a species of commands, orders, or imperatives. As a result, even as we enter the twenty-first century, legal scholars have yet to articulate a legal architectonic that properly situates the normative commitments of a society within a post-modern legal system. An adequate theory of law must offer an account of the normativity of law: an account …

Caste, Class, And Equal Citizenship, William E. Forbath

There is a familiar egalitarian constitutional tradition and another we have largely forgotten. The familiar one springs from Brown v. Board of Education; its roots lie in the Reconstruction era. Court-centered and countermajoritarian, it takes aim at caste and racial subordination. The forgotten one also originated with Reconstruction, but it was a majoritarian tradition, addressing its arguments to lawmakers and citizens, not to courts. Aimed against harsh class inequalities, it centered on decent work and livelihoods, social provision, and a measure of economic independence and democracy. Borrowing a phrase from its Progressive Era proponents, I will call it the social …

The Darkest Domain: Deference, Judicial Review, And The Bill Of Rights, Daniel J. Solove

Deference presents one of the greatest threats to liberalism in the modern age, undermining judicial review for fundamental constitutional rights such as freedom of speech, freedom of religion, and due process. In contrast to existing critiques which dismiss deference as an ideological tool wielded by conservative judges, this article explores deference more systematically and rigorously, addressing it at its conceptual underpinnings. Deference has a strong conceptual backbone rooted in the long-accepted principle that the judiciary must avoid doing what was done in Lochner - the substitution of judicial judgment for that of the policymaker or legislature. An Anthropological Approach To Modern Forfeiture Law: The Symbolic Function Of Legal Actions Against Objects, Paul Schiff Berman

In 1996, the Supreme Court issued two opinions, Bennis v. Michigan and United States v. Ursery, emphasizing the constitutionality of civil forfeiture schemes under both the Due Process and Double Jeopardy Clauses of the Fifth Amendment. These decisions, and civil forfeiture schemes generally, have faced strong criticism from scholars and civil libertarians. Among the arguments advanced against civil forfeiture has been one based on its origins. The so-called "legal fiction" underlying forfeiture is that the government is acting against the property itself, rather than against the owner. Commentators have traced this fiction to the Middle Ages. Under the law of …

School-Based Juvenile Boot Camps: Evaluating Specialized Treatment And Rehabilitation (Star), Chad R. Trulson, Ruth Triplett

Implemented in Montgomery County, Texas, STAR deviates from traditional boot camps in a variety of ways. The program is closely coupled with school jurisdictions, the juvenile court, and correctional authorities. In addition, the program is non-residential and serves status, misdemeanor, and felony juvenile offenders and mandates parental participation. STAR was initiated to address several goals: enable individuals to remain in school while reducing their disruptive behavior, use school expulsion as a last resort, improve the academic performance of participants, coordinate a joint effort between juvenile authorities and school jurisdictions, instill a sense of pride and discipline in participants, and reduce …

Criminal and deviant behavior is known to occur in all places, settings, and times. The Olympics, both Summer and Winter, are not immune to deviant behavior. This paper focuses on the specific types of deviant and criminal acts arising out of the Olympic settings and the anomic factors that possibly lead to deviance in this particular arena. The way that athletes are conformists, innovators, ritualists, and retreatists is considered along with the way that norm confusion influences the Olympic event. Also considered is the role of norm saturation in confusing the way actors interpret appropriate behavior in this setting. Implications …

Family Interaction Styles Of Children With Depressive Disorders, Schizophrenia-Spectrum Disorders, And Normal Controls, Elizabeth Hamilton, Joan Asarnow, Martha Tompson

Family interaction processes during a problem-solving task were examined in children with depressive disorders, children with schizophrenia-spectrum disorders, and a normal control group of community children screened for the absence of psychiatric disorder. Major findings were: a) children with depressive disorders were more likely than children with schizophrenia-spectrum disorders and children with no psychiatric disorder to direct guilt-inducing comments toward their parents; and b) parents of children with schizophrenia-spectrum disorders were more likely to direct harsh critical comments toward the child than were parents of depressed children or parents of normal controls. In this review, I will concentrate on two perspectives on the book. I first taught Property in the spring 1998 semester (using the third edition of Dukeminier and Krier) and am (as I write this) about to begin my second year of teaching the course. I can thus give the perspective of a new teacher of the subject. In addition, I am an economist as well as a lawyer and am deeply fascinated by legal history. This article explores my introduction into virtual research. In this article I discuss the ethical issues associated with conducting research online, such as whether or not informed consents are necessary, how to obtain them, what kinds of methods are ethical, how to handle data, and how to ensure respondents confidentially. Furthermore, I address both the positive and negative aspects of virtual research, some basic guidelines for institutional Review Boards, and the more current phenomena of online publishing in academic journals.

The use of electronic forums for research has recently been recognized and encouraged. Research via Usenet saves time, is convenient, and is accessible 24 hours per day. Moreover, electronic forums may serve as a potential research site for virtually any topic in any discipline. However, research methodology has failed to keep pace with technological advancement. Application of traditional research methods to electronic forums often are inappropriate and injurious to member-participants. The Virtual Pet Ate My Homework, Mark D. Jones

The Virtual Pet Are My Homework contains an examination of the social and psychological relationships developed by early-adolescent and pre-adolescent children around the miniature electronic devices known as tomagotchis, or virtual pets. Two sets of children, one older and one younger, were interviewed in focus group settings. The interview protocol made use of prior research on social-psychological relationships with television and computers, and employed the results of these studies as sensitizing concepts. Though the number of subjects interviewed was small, it was observed that the children cognitively differentiated between the devices and the pets represented on the device screen. …

An Assessment Of The Collective Resources Base Of Florida Community College Library Collections: A Profile With Interpretative Analysis, Anna H. Perrault, John N. Depew, Richard Madaus, Ann Armbrister, Jeannie Dixon

The Florida Community College Assessment Project is the first reported statewide assessment for community college collections using quantitative data extracted from a network information system. The collection analysis is based upon bibliometric data extracted from LINCC, the Library Information Network for Community Colleges, in Florida. The analysis of the aggregated resources base by imprint year shows that the resources of Florida community colleges are significantly out of date with outdated materials prevalent in all major subject divisions including the sciences and health sciences.
