The Influence Of Grammatical Gender On Hindi And German Speaker's Sex Categorization, Jaralvilai Charunrochana Jan 1999

The Influence Of Grammatical Gender On Hindi And German Speaker's Sex Categorization, Jaralvilai Charunrochana

Manusya, Journal of Humanities

According to the Linguistic Relativity Hypothesis, the grammatical system of a language influences the perception and categorization of the reality of its speakers. Gender, as a grammatical category, should have such an influence, too. Gender is a grammatical category found in many languages, especially Indo-European languages. It concerns the categorization of nouns in those languages into groups: masculine, feminine, and, in languages with three genders, neuter. There is still much divergence of opinion as to the origin and connotation of gender. Some linguists and grammarians believe that gender is merely a meaningless form (Fodor 1959). Some believe that gender has …

Policy Research In Higher Education: Data, Decisions, Dilemmas, And Disconnect, Edward R. Hines

Mid-Western Educational Researcher

This address dichotomized academic research and policymaking as two separate, distinct, and often conflicting worlds or cultures. Higher education as a field of study was used as a case example illustrating academic research, and state legislative politics illustrated the world of policymaking. Suggestions were made for finding ways of communicating between the two cultures, and specific recommendations were included.

Discontinuous Tradition Of Sentencing Discretion: Koon's Failure To Recognize The Reshaping Of Judicial Discretion Under The Guidelines, The, Ian Weinstein Jan 1999

Discontinuous Tradition Of Sentencing Discretion: Koon's Failure To Recognize The Reshaping Of Judicial Discretion Under The Guidelines, The, Ian Weinstein

Faculty Scholarship

Can a judge exercise discretion and follow the law? Some think it impossible, seeing discretion as the opposite of law. Others have harmonized the two ideas, viewing discretion as the exercise of judgment according to and within the bounds of the law. Those who decry judicial discretion urge legislatures to enact more specific laws and leave less room for the vice of inconsistent results. Those who defend discretion would channel it to achieve the virtue of individualized justice. The tension between individualization and uniformity in the law is often unnecessarily heightened by an inadequate analysis of judicial discretion. The exercise …

Struggle, Aspiration, And Obsession: The Discourse Of Diet, Emily K. L. Jahn

Masters Theses

Research has shown that members of society are generally dissatisfied with their current weight. This study examines how individuals socially construct meanings of the word diet and the dieting process. Participants (n=443) were males and females who ranged in age from 7 to 68. Each were given a diet questionnaire to complete. The older groups were given the Multidimensional Health Locus of Control (MHLC) Scale in addition to the survey. The text for analysis was obtained by the surveys and four focus groups. The resulting data indicated that both males and females perceive the word diet means "to lose weight." …

Rethinking Genocidal Intent: The Case For A Knowledge-Based Interpretation, Alexander K.A. Greenawalt Jan 1999

Rethinking Genocidal Intent: The Case For A Knowledge-Based Interpretation, Alexander K.A. Greenawalt

Elisabeth Haub School of Law Faculty Publications

From its initial codification in the 1948 Convention on the Prevention and Punishment of Genocide to its most recent inclusion in the Rome Statute of the International Criminal Court, the international crime of genocide has been defined as involving an "intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such." The predominant interpetation of this language views genocide as a crime of "specific" or "special" intent, in which the perpetrator deliberately seeks the whole or partial destruction of a protected group. This Note pursues an alternate approach. Relying on both the history of …

The Architectonics Of Information: Ancient Topical Thought And Postmodern Information, Catherine L. Hobbs

The Journal of the Assembly for Expanded Perspectives on Learning

This paper examines the usefulness of thought patterns from ancient rhetoric as they have been appropriated historically and as potentially applicable concepts for the present and future in today's interlinked electronic environment.

An earlier version of this paper, first delivered as part of a panel at the Rhetoric Society of America meeting at Tucson in May 1 996, was delivered and published as "The Architectonics of Information: Ancient Topical Thought and Postmodern Cognition" in Proceedings of the Mid-America Symposium on E merging Computer Technologies, October 1 996. (The published papers are available in "Information Problems" at http://www.ou.edu/cas/english/agora/). I would like …

The Limited Public Offer In German And U.S. Securities Law: A Comparative Analysis Of Prospectus Act Section 2(2) And Rule 505 Of Regulation D, David B. Guenther Jan 1999

The Limited Public Offer In German And U.S. Securities Law: A Comparative Analysis Of Prospectus Act Section 2(2) And Rule 505 Of Regulation D, David B. Guenther

Michigan Journal of International Law

This Note examines the "limited circle of persons" exception in section 2(2) of the Prospectus Act in comparison to similar provisions of U.S. federal securities law, particularly Section 3(b) of the Securities Act of 1933 (the "Securities Act") and Rule 505 of Regulation D ("Rule 505"). Comparison of the Prospectus Act to U.S. securities law seems both warranted and useful. Certain aspects of German securities law are broadly modeled on U.S. precedents. U.S. securities laws reflect more than sixty-five years of experience defining (and re-defining) public and limited public offers and private placements. U.S. securities regulators have also displayed in …

Locational Differences In The Underlying Characteristics Of Poverty, Brian Cushing, Buhong Zheng Jan 1999

Locational Differences In The Underlying Characteristics Of Poverty, Brian Cushing, Buhong Zheng

Regional Research Institute Working Papers

We explore how poverty differs between urban and rural areas and among U.S. regions, using metropolitan versus nonmetropolitan to proxy urban versus rural. Our study focuses on social and demographic characteristics, rather than economic characteristics. We are concerned with which personal characteristics appear to increase the risk of poverty, regardless of whether these characteristics manifest themselves through unemployment, low-wage employment, or some other economic problem that ultimately leads to poverty. Using data for the working-age population from the one percent Public Use Microdata Sample of the 1990 Census of Population and Housing, we find significant differences in predictors of …

The Fact And Fiction Of Vikings In America, Karri L. Springer Jan 1999

The Fact And Fiction Of Vikings In America, Karri L. Springer

Nebraska Anthropologist

Many people do not fully understand the stories, history, archaeology or evidence for Viking presence in North America. This paper evaluates the stories against the scientific evidence found to date. Archaeologists, although qualified to discuss all sides of the arguments, rarely do, because of the lack of career rewards for doing so. However, the problems associated with hoaxes should be important to all archaeologists interested in maintaining credibility with the public. Viking legends are well suited for such evaluation. The Kensington runestone hoax is emphasized in this evaluation while other Viking hoaxes are overviewed. Relevant evidence from archaeological sites in …

The Daishonin’S Path: Applying Nichiren’S Buddhist Principles To American Legal Education, John W. Teeter Jr

Faculty Articles

The fundamental aspects of Nichiren Daishonin's teachings merit modern attention. The Daishonin was a tireless mentor for his disciples, and his call for compassion, critique, courage, and wisdom are essential for law students and teachers alike. A remarkable man, the Daishonin's perceptions ought to inform the way professors teach and advise their students, and encourage others to reflect on their own sources of spiritual sustenance and examine the contributions they can make toward deepening the relevance, meaning, and joy of legal education.

The Daishonin emphasized the primacy of The Lotus Sutra, which declares that all living beings inherently possess the …
