Shrinkwrap And Clickwrap Agreements: 2b Or Not 2b?, Garry L. Founds Dec 1999

Shrinkwrap And Clickwrap Agreements: 2b Or Not 2b?, Garry L. Founds

Federal Communications Law Journal

Several problems plague typical mass-market software licensing agreement, specifically that the public is powerless to negotiate and the terms often are perceived as exceedingly broad and restrictive. The Uniform Computer Information Transactions Act is designed to remedy those problems and establish the general enforceability of such agreements, with certain qualifications related to unconscionability, assent, and other caveats. UCITA, however, does not resolve, or even purport to resolve, the tension between federal copyright law and state contract law. This Note analyzes UCITA's attempt to resolve the enforceability issue; argues for an approach to preemption that promotes clarity and preserves the objectives …

Administrative Law, Mark H. Cohen, David C. Will

Mercer Law Review

This Article covers important developments in Georgia administrative law for the two-year period from June 1, 1997 through May 31, 1999. Because administrative law has been omitted from major consideration in the Annual Survey of Georgia Law since 1987, this Article is an attempt to cover an additional period of review, which, the authors hope, will be continued in future surveys. This Article includes cases as well as a discussion of two significant legislative enactments during the survey period.

Workers' Compensation, H. Michael Bagley, Daniel C. Kniffen, Katherine D. Dixon, Marion Handley Martin

Mercer Law Review

For the second year in a row, the survey period passed without dramatic legislative changes to Georgia's Workers' Compensation Act ("the Act").' Georgia's appellate courts, however, were active once again in examining the exclusive remedy doctrine and interpreting the Act's subrogation provisions.

Simulation Model For Maize Crop Growth Based On Acquisition And Allocation Processes For Carbohydrate And Nitrogen, O. Bonato, F. Schulthess, J. Baumgärtner Dec 1999

Simulation Model For Maize Crop Growth Based On Acquisition And Allocation Processes For Carbohydrate And Nitrogen, O. Bonato, F. Schulthess, J. Baumgärtner

All Peer-Reviewed Publications

A population model for maize growth and development driven by temperature, solar radiation, soil water and soil nitrogen is presented. A time-varying distributed delay model is used to describe the dynamics of the attributes number, biomass and nitrogen belonging to leaf, root, stem, grain, rachys and husk populations. Photosynthate production as well as water and nitrogen acquisition was simulated with a demand-driven ratio-dependent functional response model. Carbohydrate, water and nitrogen supply-demand ratios were calculated to control the growth of different populations of plant. The metabolic pool model was used to allocate carbohydrates to plant subunits. The model was validated with …

The Effect Of Divalent Cations On The Prophenoloxidase Enzyme Cascade Activity In The Freshwater Crayfish Cambarus Latimanus, Hans Skailand Eikaas Dec 1999

The Effect Of Divalent Cations On The Prophenoloxidase Enzyme Cascade Activity In The Freshwater Crayfish Cambarus Latimanus, Hans Skailand Eikaas

Theses and Dissertations

The effect of divalent cations such as cadmium, calcium, copper, lead and magnesium upon the prophenoloxidase system (proPO) was studied in hemocytes of the crayfish Cambarus latimanus. It was demonstrated that cadmium, calcium, copper and lead increased proPO activity significantly, whereas magnesium had no statistically significant effect on the system. Also, the molecular weight of the proPO enzyme was estimated using SDS-PAGE and found to be approximately 76 kDa.

Multimode Solution For The Reflection Properties Of An Open-Ended Rectangular Waveguide Radiating Into A Dielectric Half-Space: The Forward And Inverse Problems, R. Zoughi, Aaron D. Benally, Karl Joseph Bois Dec 1999

Multimode Solution For The Reflection Properties Of An Open-Ended Rectangular Waveguide Radiating Into A Dielectric Half-Space: The Forward And Inverse Problems, R. Zoughi, Aaron D. Benally, Karl Joseph Bois

Electrical and Computer Engineering Faculty Research & Creative Works

Open-ended rectangular waveguides are extensively used in nondestructive dielectric material evaluation. The dielectric properties of an infinite-half space of a material are calculated from the measured reflection properties referenced to the waveguide aperture. This calculation relies on a theoretical and numerical derivation of the reflection coefficient likewise referenced to the waveguide aperture. Most of these derivations assume the dominant mode field distribution across the waveguide aperture. However, when dealing with low permittivity and low loss dielectric materials, there may exist significant errors when calculating the dielectric properties from the measured reflection coefficient. These errors have also shown to be more …

Evaluation Of A Web-Based Research Course, Mary E. Bowen, Anthony J. Frisby

Academic Commons and Scott Memorial Library Staff Papers and Presentations

A web-based research course for graduate nursing students was developed, implemented, and evaluated for academic and satisfactions outcomes. A collaborative paradigm was utilized in designing the course to increase successful attainment of the graduate nursing program’s goal of a complete online graduate nursing MSN program. This web-based research course with 24 enrolled students was compared to an identical classroom based research course with 20 enrolled students. Areas of evaluation were academic outcomes of overall numerical course grades, satisfaction with course scores, and qualitative data on satisfaction of course. Results of this descriptive exploratory study demonstrated no statistically significant differences between …

Extension's Portfolio For The 21st Century: A Place For One-On-One Consultations, Peggy Petrzelka, Steve Padgitt, Wendy Wintersteen Dec 1999

Extension's Portfolio For The 21st Century: A Place For One-On-One Consultations, Peggy Petrzelka, Steve Padgitt, Wendy Wintersteen

Journal of Extension

Revisits the individual consultations that provided the base from which the Cooperative Extension Service grew. Using data gathered from clients' and Extension staff evaluations of one-on-one activities, our findings show these consultations have an economic and educational value for clients. The consultations benefit field specialists as well, augmenting their need assessments by providing information from in the field, providing opportunities for on-going research, and building credibility. It is maintained that continuing (or re-implementing) these consultations as part of Extension's portfolio for the 21st Century has mutual benefit, both to the client and to Extension.

Consensus Management Model For Families Caring For A Loved One With Dementia, Robert J. Fetsch, Toni Schindler Zimmerman, Clifton F. Barber

Journal of Extension

This article proposes teaching care-giving families a practical, six-step Care-giving Consensus Management Model. Cooperative Extension professionals can teach clientele this model and can reduce caregiver burden by broadening the ownership of caregiver responsibilities among both proximate and distant family members. The model integrates strategic planning, futuring, decision making, effective family communication, task accomplishment, priority setting, and problem solving. It fosters shared responsibility and provides guidelines for effective family meetings and decision making.

Money 2000 Participants: Who Are They?, Barbara O’Neill, Barbara Bristow, Patricia Q. Brennan

Journal of Extension

This study was conducted to determine if there were any statistically significant differences between MONEY participants and others who attended three Extension personal finance conferences. The sample consisted of 124 MONEY 2000 program participants and 101 others. Using chi-square analysis, no significant demographic differences were found between the two groups of respondents. Significant differences were found at the .05 level, however, for action taken and/or planned to invest funds wisely and to set financial goals and objectives. A third significant difference was paying more than the minimum due on credit cards. A more powerful Mantel-Haenszel chi-square test for ordinal data …
