Continuing The Trend Toward Equality: The Eradication Of Racially And Sexually Discriminatory Provisions In Private Trusts, Katheryn F. Voyer Apr 1999

Continuing The Trend Toward Equality: The Eradication Of Racially And Sexually Discriminatory Provisions In Private Trusts, Katheryn F. Voyer

William & Mary Bill of Rights Journal

Racially and sexually discriminatory private trusts are presumed to be valid under traditional common law governing dispositions of property. Most courts have held that if the state plays a "passive" role, only private actors are involved and the Fourteenth Amendment is not implicated The United States Supreme Court, however, has declared in one context that discriminatory charitable trusts violate public policy and are unconstitutional. This Note argues that because private trusts involve unlawful state action and are not purely private, courts have an affirmative obligation imposed by the Supreme Court and a moral responsibility because of well-established public policy against …

Review Of Western Visions: Perspectives On The West In Canada By Roger Gibbons And Sonia Arrison, Michael D. Behiels Apr 1999

Review Of Western Visions: Perspectives On The West In Canada By Roger Gibbons And Sonia Arrison, Michael D. Behiels

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

In the 1997 Canadian election, Preston Manning's Reform Party emerged as Her Majesty's Loyal Opposition with 60 seats in the House of Commons. The Liberal Governing Party of Prime Minister Jean Chretien would have been reduced to a minority had Liberals not won 101 of Ontario's 103 seats. Why and how did this development occur? What are some of its probable consequences? Western Visions provides a timely and revealing set of answers to these questions so closely related to Canada's perennial national unity crisis. Most academics and interested citizens think about that crisis primarily, if not exclusively, in terms of …

Review Of The Powder River Expedition Journals Of Colonel Richard Irving Dodge Edited By Wayne R. Kime, R. Eli Paul Apr 1999

Review Of The Powder River Expedition Journals Of Colonel Richard Irving Dodge Edited By Wayne R. Kime, R. Eli Paul

Great Plains Quarterly (through 2013)

Richard 1. Dodge served in the United States Army from 1848 to 1891. By the time of the 1876 Powder River Expedition, one of several military responses to the crushing defeat suffered at the Little Big Horn, Dodge had reached the rank of lieutenant colonel. At the behest of Brig. Gen. George Crook he accepted the command of the infantry contingent of this winter campaign against SiouxCheyenne foes.

The campaign met with some success, and many historians consider it the beginning of the end of the Great Sioux War. On 25 November 1876, a Cheyenne village of Chief Dull Knife …

Factors In Rural Community Survival: Review Of Insights From Thriving Small Towns, Milan Wall Apr 1999

Factors In Rural Community Survival: Review Of Insights From Thriving Small Towns, Milan Wall

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

During the 1980s crisis in the agricultural economy, some observers claimed that many towns were too small, too isolated, or too distant from larger population centers to survive in times of economic turmoil. We decided to evaluate these assumptions through a series of in-depth case studies of thriving small communities in the Great Plains. The communities we studied fit the general description of towns that were doing better than expected. Using an anthropological approach, the teams of field researchers from the Heartland Center for Leadership Development visited communities, ranging in size from 300 to 6,000, in Colorado, the Dakotas, Kansas, …

Effect Of Winter Wheat Seeding Date On Soil Erosion In The West-Central Great Plains, S. J. Meyer, Drew J. Lyon, D. D. Baltensperger Apr 1999

Effect Of Winter Wheat Seeding Date On Soil Erosion In The West-Central Great Plains, S. J. Meyer, Drew J. Lyon, D. D. Baltensperger

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

In the west-central Great Plains, the risk of soil erosion due to wind is high, particularly during winter. One way to reduce soil erosion is to plant winter wheat (Triticum aestivum L. ) early in the season, so that the crop establishes four tillers prior to the onset of winter dormancy. Currently, however, wheat is seeded late in the planting season to reduce disease and insect infestation. In this study, we evaluated potential soil erosion in relation to seeding date. Using historical climate data, we determined the probability that winter wheat plants will establish four tillers prior to dormancy …

As the new Associate Editor for the social sciences, I will be encouraging and handling submissions relevant to the social sciences, including anthropology, cultural science, economics, ethnography, family science, psychology, and sociology. Our aim is to expand the scope of high quality submissions to GPR in several ways. First, we are working to add major abstract and indexing services in the social sciences. We understand the importance of promoting the impact of our published work. Second, we are soliciting synthesis and thoughtful reviews of major social issues for the Great Plains …

Review Of The Origins Of Native Americans: Evidence From Anthropological Genetics By Michael H. Crawford, Theodore Schurr Apr 1999

Review Of The Origins Of Native Americans: Evidence From Anthropological Genetics By Michael H. Crawford, Theodore Schurr

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

Since the presentation of the tripartite model of Native American languages, genes, and cultures by Joseph H. Greenberg and others (1986), there have been few attempts to synthesize anthropological genetic data from New World populations to evaluate various models of the peopling of the Americas. Although offering no new theoretical paradigm to explain the observed patterns of biological diversity in the New World, The Origins of Native Americans presents a thorough review of the current genetic data from Siberian and Native American populations. Rather than taking an explicitly historical view of these anthropological genetic studies, the book instead examines the …

From Representing Clients To Serving Recipients: Transforming The Role Of The Iv-D Child Support Enforcement Attorney, Barbara Glesner Fines Apr 1999

From Representing Clients To Serving Recipients: Transforming The Role Of The Iv-D Child Support Enforcement Attorney, Barbara Glesner Fines

Faculty Works

Attorneys for the poor are being asked to serve more clients for less money and with more restrictions on their practice than ever before. These restrictions, both on amounts and uses of funds, influence the attorney's independent professional judgment. Determining when that influence is inappropriate becomes a difficult practical and ethical issue. Is this issue resolved if one simply reconceptualizes the role of the entities and individuals involved? What if the government becomes the client and the individual receiving legal services becomes something other than a client? Examining the development of governmental funding of child support enforcement, one finds just …
