Standards Of Care And Standard Form Contracts: Distinguishing Patient Rights And Consumer Rights In Managed Care, Wendy K. Mariner Oct 1999

Standards Of Care And Standard Form Contracts: Distinguishing Patient Rights And Consumer Rights In Managed Care, Wendy K. Mariner

Faculty Scholarship

There is hardly a legislature in the country that is not currently debating the issue of patient rights in managed care. Not surprisingly, legislators, as well as reporters covering the debate, have called upon George J. Annas, Edward R. Utley Professor of Health Law and Chair of the Health Law Department at Boston University, for information and advice. Professor Annas has earned the title of "father of patient rights" for his decades of research, writing, and advocacy on behalf of individuals who need health care and deserve justice.

Today, however, one might ask whether patient rights are compatible with managed …

Beyond The Formalism Debate: Expert Reasoning, Fuzzy Logic, And Complex Statutes, Edward S. Adams, Daniel A. Farber Oct 1999

Beyond The Formalism Debate: Expert Reasoning, Fuzzy Logic, And Complex Statutes, Edward S. Adams, Daniel A. Farber

Vanderbilt Law Review

Formalists and antiformalists continue to debate the utility of using legislative history and current social values to interpret statutes. Lost in the debate, however, is a clear model of how judges actually make decisions. Rather than focusing on complex problems presented by actual judicial decisions, formalists and antiformalists concentrate on stylized examples of simple statutes.

In this Article, Professors Adams and Farber construct a more functional model of judicial decisionmaking by focusing on complex problems. They use cognitive psychological research on expert reasoning and techniques from an emerging area in the field of artificial intelligence, fuzzy logic, to construct their …

State Defiance Of Bankruptcy Law, Kenneth N. Klee, James O. Johnston, Eric Winston Oct 1999

State Defiance Of Bankruptcy Law, Kenneth N. Klee, James O. Johnston, Eric Winston

Vanderbilt Law Review

Bankruptcy is the principal device by which failing businesses and financially-troubled families get one last chance to reorganize their affairs back to financial health. It is also the graveyard for business failures, the place where we bury dead corporations and divide their remaining assets among their surviving creditors.

In the last decade, the bankruptcy system has given seven million middle-class families a way to start over-an opportunity to save their homes from foreclosure, rid themselves of overwhelming debts, and reintegrate themselves into the workforce as productive citizens. It has also been the way that 10,000 corporations have restructured their way …

Aboriginal Forestry: Community Management As Opportunity And Imperative, Deborah Curran, Michael M'Gonigle Oct 1999

Aboriginal Forestry: Community Management As Opportunity And Imperative, Deborah Curran, Michael M'Gonigle

Osgoode Hall Law Journal

In recognition that forests are one of their greatest resources, Aboriginal peoples are considering how altered tenure arrangements might uphold traditional values, including ecological integrity, while providing economic and employment opportunities. However, the federal and provincial forest management structures have historically precluded First Nations from helping to define, and participate in, the forest industry. The authors explore the legal and regulatory basis of forest management in Canada, and assess how it facilitates or impedes Aboriginal management of traditional areas. This is done through a legislative and policy analysis, and through the use of case studies from across Canada. The authors …

Report To Congress On Waivers Granted Under The Elementary And Secondary Education Act, Jacqueline Raphael, Kristen M. Olson, Luke Miller

Department of Sociology: Faculty Publications

This is the third annual report to Congress on waivers granted by the U.S. Department of Education, mandated under section 14401(e)(4) of the Elementary and Secondary Education Act (ESEA). Three education laws passed in 1994 — the Goals 2000: Educate America Act, the School-to-Work Opportunities Act, and the reauthorized ESEA — allow the Secretary of Education to grant waivers of certain requirements of federal education programs in cases where a waiver will likely contribute to improved teaching and learning. States and school districts use the waiver authorities to adapt federal programs and use federal funds in ways that address their …

Abnormal Electrical Potentials In Lower Limb Muscles After Ankle Sprain Grades I, Ii And Iii, Talal A. Al-Shatti

Rehabilitation Sciences Theses & Dissertations

Fibrillation and positive sharp wave potentials have been found after ankle sprain in muscles around the injured joint. The purpose of this study was to better define and explain the reaction of the muscles around the ankle joint after grades I, II and m ankle sprains. Methods: Fifteen subjects (9 males and 6 females, mean age of 33.2 years) with ankle sprains voluntarily participated in this study. A stress x-ray was done to determine the grade of ankle sprain. Nerve conduction velocity and EMO studies were done three weeks after the injury. None of the patients in this study manifested …

Evaluation Of The Enantiomeric Composition Of Amino Acids In Tobacco, John P. Kullman, Xianghong Chen, Daniel W. Armstrong Oct 1999

Evaluation Of The Enantiomeric Composition Of Amino Acids In Tobacco, John P. Kullman, Xianghong Chen, Daniel W. Armstrong

Chemistry Faculty Research & Creative Works

Despite the fact that several studies have reported the concentrations of various free amino acids in tobacco, their enantiomeric composition is unknown. Both the absolute and enantiomeric compositions of proline, alanine, asparagine, aspartic acid, valine, methionine, leucine, and phenylalanine were determined for three strains of tobacco leaf, three types of smokeless tobacco, and six different blended filtered and nonfiltered reference cigarettes. Some of the highest levels of D-amino acids ever found in agricultural products were observed. Possible mechanisms for the production of these D-amino acids are considered. The relevance of D-amino acids in tobacco is discussed.

Work-Life Role Integration: A Construct Validation Study, Tonya Alicia Miller Oct 1999

Work-Life Role Integration: A Construct Validation Study, Tonya Alicia Miller

Psychology Theses & Dissertations

Two studies were conducted to define and validate the theoretical construct, role integration. Study 1 focused on producing a theoretical definition and a psychometrically sound measure. Content, convergent, and discriminant validity evidence was collected. Study 2 provided further validity evidence for the role integration construct by testing a conceptual model and refining the role integration measure. Study 1 and Study 2 established a psychometrically sound 12-item, two-factor role integration measure. The first factor focused on knowledge, skills, and experiences (KSE). The second factor focused on values, beliefs, and attitudes (VBA).

The conceptual model in Study 2 added the role integration …

Comparative Study Of Economic Adjustment And Housing Quality Of Migrants And Natives In The State Of Virginia, Bayram Unal

Sociology & Criminal Justice Theses & Dissertations

This research has directed attention towards comparing and understanding the characteristics of both native and migrant populations and both recent and long-term migrant populations in the state of Virginia. The research question is: how does migrant population differ from native population? And how do recent migrants differ from long-term migrants in terms of their employment status, occupation, income, home ownership, quality of housing and amount of rent. This study utilizes data from the 5 percent sample of the U.S. 1990 Census. Cross tabulation and analysis of variance are used to compare migrant with native population and recent migrants with long-term …

A Study On The Effects Of The N-Terminal Amino Acid Sequence On The Activation Of Human T-Cell Leukemia Virus Type 1 Protease, Hidayah Muhammad Kendall Oct 1999

A Study On The Effects Of The N-Terminal Amino Acid Sequence On The Activation Of Human T-Cell Leukemia Virus Type 1 Protease, Hidayah Muhammad Kendall

Chemistry & Biochemistry Theses & Dissertations

Human T-cell leukemia virus type 1 (HTL V-1) is dependent upon the enzymatic activity of its protease for maturation. Maturation of the protease is facilitated by cleavage of specific amino acid residues, followed by dimerization. The effects of the amino acid sequence located N-terminally to the cleavage site on the ability of the protease to become active were the focus of the current study. These amino acid sequences were contributed by the plasmid vector into which the protease gene was inserted.

Surface probability analyses (SPAs) of the vectors, as well as for native sequences which produce the mature protease and …

Intravascular Lymphomatosis With Bone Marrow Involvement: A Case Report And Review Of The Literature, Tammy J. Tucker Oct 1999

Intravascular Lymphomatosis With Bone Marrow Involvement: A Case Report And Review Of The Literature, Tammy J. Tucker

Student Publications

We describe the case of a 56-year-old man who presented with numbness and tingling of the extremities, weakness, and fatigue. Laboratory findings included anemia and thrombocytopenia. A diagnosis of intravascular lymphomatosis was established when liver, omentum, and bone marrow samples were examined. A review of the literature reveals that most cases of intravascular lymphomatosis have cytopenias, mainly anemia and thrombocytopenia, but bone marrow involvement is rare. In our case, a subtle neoplastic infiltrate in the marrow sinusoids was highlighted with a B-cell marker. While immunohistochemical analysis was not performed in most reported cases in the literature, our studies suggest that …
