Application Of A Fiber-Reinforced Continuum Theory To Multiple Deformations Of The Annulus Fibrosus, Stephen M. Klisch, Jeffrey C. Lotz

Mechanical Engineering

Accurate tissue stress predictions for the annulus fibrosus are essential for understanding the factors that cause or contribute to disc degeneration and mechanical failure. Current computational models used to predict in vivo disc stresses utilize material laws for annular tissue that are not rigorously validated against experimental data. Consequently, predictions of disc stress resulting from physical activities may be inaccurate and therefore unreliable as a basis for defining mechanical–biologic injury criteria. To address this need we present a model for the annulus as an isotropic ground substance reinforced with two families of collagen fibers, and an approach for determining the …

Alj Final Orders On Appeal: Balancing Independence With Accountability, Jim Rossi

This essay addresses how ALJ final order authority in many state systems of administrative governance (among them Florida, Louisiana, Missouri, and South Carolina) poses a tension between independence and accountability. It is argued that political accountability is sacrificed where reviewing courts defer to ALJ final orders on issues of law and policy. Standards of review provide state courts with a way of restoring the balance between independence and accountability, but reviewing courts should heighten the deference they give to the agency's legal and policy positions -- giving little or no deference to the ALJ on these issues -- even where …

Smoking Status And Public Responses To Ambiguous Scientific Risk Evidence, W. Kip Viscusi, Wesley A. Magat, Joel Huber

Situations in which individuals receive information seldom involve scientific consensus over the level of the risk. When scientific experts disagree, people may process the information in an unpredictable manner. The original data presented here for environmental risk judgments indicate a tendency to place disproportionate weight on the high risk assessment, irrespective of its source, particularly when the experts disagree. Cigarette smokers differ in their risk information processing from nonsmokers in that they place less weight on the high risk judgment when there is a divergence in expert opinion. Consequently, they are more likely to simply average competing risk assessments.

The estimated health risks from smoking have significant external financial consequences for society. Studies at the national level indicate that cigarettes are self-financing since external costs such as those due to illnesses are offset by cost savings associated with premature death, chiefly pension costs. This paper extends this analysis to all 50 states and considers the costs considered in the state attorneys general suits against the cigarette industry. Cigarettes are always self-financing from the standpoint of costs to each state. The extent of the cost savings is less than at the federal level. We make decisions every day for which we may not have full information. Not all such decisions lead to negative consequences, however. For example, scientists still know very little about why aspirin has its beneficial effects. However, the lack of our knowledge does not necessarily imply that our decisions are in error or that our freedom to make these decisions should be constrained. Almost invariably, we must make decisions with uncertain implications when we fail to have complete information, whether it be with respect to today's weather forecast or the chemical composition of the foods we eat, but this does …

This Article analyzes a recent decision of the Supreme Court that illustrates the enormous destructive power of the Rehnquist Court's peculiar brand of anti-tribal activism, Idaho v. Coeur d'Alene Tribe. Coeur d'Alene Tribe is likely to heighten the urgency with which Eleventh Amendment scholars have called for an overruling of Hans to ameliorate the damage that Hans and its progeny already have done to the regime of federally protected rights under the Constitution, laws and treaties of the United States-a regime at the core of the Framers' vision of paramount federal law and essential to securing true liberty for all …

Kinematic Analysis Of Obstacle Clearance During Locomotion, Gary P. Austin, Gladys E. Garrett, Richard W. Bohannon

This study investigated the effect of obstacles of different heights on the locomotion of 15 healthy subjects. The following parameters were studied: (1) the distance of the toe and heel markers from the obstacle during toe-off and heel contact, respectively, (2) the minimum clearance distance of the toe and heel markers, and (3) the angular displacements and velocities of the hip, knee, and ankle. Results show significant differences in joint angular kinematics and clearance distances as obstacle height increased. The kinematic and distance differences exhibited both strong linear and non-linear trends. Toe-off distance and heel contact distance did not change …

On the afternoon of Sunday, July 23, 1837, in Preston's Vauxhall Chapel, Heber C. Kimball preached the first Latter-day Saint sermon to be delivered in England. Heber presided over England's first baptisms one week later, after which he and his six companions parted company to cover more territory. People flocked to hear the missionaries' message, and by the time Elder Kimball left England nine months later, over fifteen hundred people had been baptized in and around Preston. A more fertile land for missionary work could hardly be imagined.

The United States Supreme Court Answered "YES" to the $1.45 million over exaction question for 1999. In City of Monterey v. Del Monte Dunes at Monterey Ltd., a unanimous court extended the scope of compensatory takings review beyond land dedication conditions into the realm of regulatory denial. Justice Kennedy's opinion vitalized the "legitimate state interests" test from Agins v. City of Tiburon to sustain an inverse condemnation conclusion and damage award to the frustrated developer. A majority of the court also concurred that the trial court may delegate this takings conclusion to the jury under federal civil rights law. The …

Service-Learning Is A Feminist Issue: Transforming Communication Pedagogy, Eleanor M. Novek

How do we "do" emancipatory feminist teaching when we have not observed it or experienced it ourselves? The author argues here that service-learning is a useful strategy for feminist communication educators to begin challenging the power relationships of traditional pedagogy. Pioneered in the 1960s and '70s, this pairing of traditional course work with community service is now used as a learning model in schools around the nation. Because service-learning allows educators to forge relational links between ourselves, our students, our neighbors, and the communities in which we live, it deserves careful consideration from feminist educators.

Risk communication strategies can help increase the effectiveness with which educators, specialist communicate with audiences about human health and safety. This publication outlines specific techniques and strategies to motivate people to take action, calm people down when they are enraged, and to communicate information that may be difficult to understand. Many programming areas, agriculture and natural resources, community development, consumer and family sciences, and 4-H and youth each deal with risk-related subject areas. The application of strategies like those outlined in this publication can help to increase the effectiveness with which health and safety programs are developed and delivered.

Financial literacy is a highly promoted objective - one that takes many partners to address effectively. Colorado State University Cooperative Extension family economics specialists initiated a statewide collaborative effort to develop new ways to link financial education for youth to educators. An Economic Education Expo was planned which attracted more than 100 educators and 40 inner city, ethnically diverse young people. Adults attended workshops ranging from economic standards to personal finance. The young people shared a wide range of entrepreneurship experiences and expertise. A collaboration wall exercise after lunch gave participants an opportunity to write mini proposals for small grants. …

Transferring Poultry Information To The Public Using The Internet: Aviannet @ Purdue University, Mickey A. Latour, Ryan A. Meunier

This article describes the impact of AvianNet, a web site designed to aid the dissemination of information from the university to county educators and poultry producers. Educators most frequently use the site (33%), compared to poultry producers (19%). The number of phone calls regarding poultry needs to the authors' offices has decreased by ten-fold compared to a similar period before the inception of this project. It is believed that this decrease is a direct result of the extensive poultry database. County educators who would have previously called the authors' offices can now search under the web site's "publication" section. Direct …

Throughout the United States, mentally ill persons are confined against their will in psychiatric hospitals as a result of being accused of dangerous behavior. Some are committed involuntarily by a judge after an administrative hearing during which they are afforded legal representation, a right to be present, and important due process protections, including the right to cross-examine witnesses and present one's own witnesses. However, a significant number of individuals, initially confined in psychiatric institutions for allegedly posing a danger to life or safety, never see an impartial judge, lawyer, or even a family member. Whether a severely impaired or critically ill infant should receive lifesaving, and sometimes extraordinary, medical treatment, or be allowed to die, is hotly debated. The issue initially garnered public attention in 1982, when an infant who was born with Down's Syndrome, “Baby Doe,” was allowed to die from a correctable birth defect. Following this, the federal government took a lead role in determining the fate of critically ill newborns. In the meantime, doctors, philosophers, and others have debated whether federal interference in this area is appropriate.

Objective: Decision making in cases of acute appendicitis poses a clinical challenge specially in developing countries where advanced radiological investigations do not appear cost effective and so clinical parameters remain the mainstay of diagnosis. The aim of our study was to devise a scoring system from our local database and test its accuracy in the preoperative diagnosis of acute appendicitis.Methods: Clinical data from 401 patients having undergone appendectomy were collected to identify predictive factors that distinguished those with appendicitis from those who had a negative appendectomy.
