The Right To Her Embryos: An Analysis Of Nahmani V. Nahmani And Its Impact On Israeli In Vitro Fertilization Law, Janie Chen

Cardozo Journal of International and Comparative Law

The note examines the landmark 1996 Israeli Supreme Court decision in Nahmani v. Nahmani, which ruled that a woman’s right to parenthood outweighs her estranged husband’s objections to fatherhood in the context of frozen embryos created through IVF. The Court established a three-prong test to balance conflicting interests, legitimate expectations, and public policy, ultimately prioritizing the woman’s right to motherhood over the man’s right to refuse parenthood. The decision reflects broader tensions between reproductive rights, personal autonomy, and cultural-religious values, particularly the Jewish legal and ethical emphasis on procreation and the sanctity of life.

Opting In, Outing Out, Or No Options At All: The Fight For Control Of Personal Information, Jeff Sovern

Washington Law Review

Businesses routinely buy and sell personal information about consumers. Many consumers find this objectionable, but relatively few of them opt out of that trade. This Article argues that businesses have both the incentive and the ability to increase consumers' transaction costs in protecting their privacy and that some marketers do in fact inflate those costs. Faced with this and other constraints, many consumers ultimately decide not to protect their privacy. This Article proposes several ways by which consumers' transaction costs can be reduced or eliminated.

Demographics Of The Gay And Lesbian Population In The United States: Evidence From Available Systematic Date Sources, Dan Black, Gary Gates, Seth Sanders, Lowell Taylor

There are thousands of studies on the gay and lesbian population. Because of the difficulty of sampling this population, most studies have used “convenience samples” for analysis. Until recently, it was extremely rare that survey data on gays and lesbians were collected from a known sampling frame, and equally rare that the same survey instrument was fielded to the gay and lesbian population and to a comparison group of other men and women. Comparative analysis of the gay and lesbian population has thus been difficult, and researchers have been properly reluctant to draw general inferences from available samples of gays …

The Self: Death By Technology, Kenneth J. Gergen

Kenneth Gergen asks whether in the midst of a techno-cultural revolution the traditional conceptions of self and community continue to secure a morally viable society. Gergen examines the erosion of both individualism and communalism (and their associated institutions) by the accumulating “technologies of sociation,” the host of relatively low-cost technologies that dramatically expand and intensify social connection. He considers the effects of these technologies on the experience of a private self and argues that cumulatively they undermine the presumption of the individual as the locus of moral agency.

Sports marketing is a fast-growing business endeavor. However, certain aspects of it have drawn criticisms from several corners (e.g., media, government, coaches, and fans). This paper raises a number of ethical questions about various dimensions of sports marketing. Advice for addressing some of the ethical problems that occur is provided. The paper specifically asks if organizations using professional sports associations as a promotional lever for increasing sales can be hurt by a lack of ethics on the part of the leagues, teams, or players. Race-Focused Service-Learning Courses: Issues And Recommendations, Roberta L. Coles

Social and Cultural Sciences Faculty Research and Publications

This article discusses the interaction between race and service-learning in the college classroom. The author found that students of color were more likely to choose the service-learning option in her courses when the incentive was higher and there was more latitude in site choice. The article then looks at factors that adversely affect the service-learning experience in courses that are specifically race-focused and suggests counterbalancing strategies.

Three-Dimensional Reconstructions Of Tadpole Chondrocrania From Historical Sections, Gary Radice, Mary K. Boggiano, Mark Desantis, Peter Larson, Joseph Oppong, Matthew Smetanick, Todd Stevens, James Tripp, Rebecca Weber, Michael Kerckhove, Rafael De Sá

Virginia Journal of Science

Reconstructing three dimensional structures (3DR) from histological sections has always been difficult but is becoming more accessible with the assistance of digital imaging. We sought to assemble a low cost system using readily available hardware and software to generate 3DR for a study of tadpole chondrocrania. We found that a combination of RGB can1era, stereomicro­scope, and Apple Macintosh PowerPC computers running NIH Image, Object Image, Rotater, and SURFdriver software provided acceptable reconstruc­tions. These are limited in quality primarily by the distortions arising from histological protocols rather than hardware or software.
