Liberalism And Abortion, Robin West Jan 1999

Liberalism And Abortion, Robin West

Georgetown Law Faculty Publications and Other Works

First in a groundbreaking book, Breaking the Abortion Deadlock: From Choice to Consent, published in 1996, then in various public fora, from academic conference panels to Christian radio call-in shows, and now in a major law review article entitled My Body, My Consent: Securing the Constitutional Right to Abortion Funding, Eileen McDonagh has sought to redefine drastically our understanding of the still deeply contested right to an abortion, and hence, of the nature of the constitutional protections which in her view this embattled right deserves. Her argument is complicated and subtle, but its basic thrust can be readily …

Hanging With The Wrong Crowd: Of Gangs, Terrorists, And The Right Of Association, David Cole Jan 1999

Hanging With The Wrong Crowd: Of Gangs, Terrorists, And The Right Of Association, David Cole

Georgetown Law Faculty Publications and Other Works

Part I will sketch the current contours of the right of association, a right limited to "expressive" and "intimate" association, and will describe the government's attempts to extend this categorical approach by limiting associational protection still further to membership per se. Part II will argue that the Court's limitation of associational rights to expressive and intimate associations and the government's attempt to distinguish association from conduct are unworkable, inconsistent with the Court's own precedents, and fail to reflect the normative reasons for protecting the right of association. Part III will offer an alternative framework for addressing the right of association, …

Evaluation Plan Checklist, Project Star Jan 1999

Evaluation Plan Checklist, Project Star

Evaluation/Reflection

Purpose of This Checklist: The Evaluation Plan Checklist will help you assess how "operational" your Evaluation Plan is. It has been designed to show what information is missing or not fully developed.

Why Use This Checklist: This Checklist will help ensure that your Evaluation Plans are clear and doable. It will provide tips to assist you in developing Evaluation Plans that stand alone and can be implemented by people new to the program. Implementing your evaluation should not depend upon some secret knowledge, or one person's memory of what sections of the Plan mean.

When to Use This Checklist …

The Effects Of Testing Methods On The Flexural Fatigue Life Of Human Cortical Bone, L. V. Griffin, J. C. Gibeling, R. B. Martin, V. A. Gibson, S. M. Stover Jan 1999

The Effects Of Testing Methods On The Flexural Fatigue Life Of Human Cortical Bone, L. V. Griffin, J. C. Gibeling, R. B. Martin, V. A. Gibson, S. M. Stover

Biomedical Engineering

A flexural model of four-point bending fatigue that has been experimentally validated for human cortical bone under load control was used to determine how load and displacement control testing affects the fatigue behavior of human cortical bone in three-point and symmetric four-point bending. Under load control, it was predicted that three-point bending produced no significant differences in fatigue life when compared to four-point bending. However, three-point bending produced less stiffness loss with increasing cycles than four-point bending. In four-point bending, displacement control was predicted to produce about one and a half orders of magnitude greater fatigue life when compared to …

The Work Of Re-Membering: After Genocide And Mass Atrocity, Martha Minow

Fordham International Law Journal

First, this article explores the role of international criminal trails and truth commissions in resisting narratives of collective guilt and producing a different sort of collective memory, helping the society-and the watching world-not merely recall but also re-member, that is, to reconstitute a community of humanity against which there can be crimes (hence, "crimes against humanity"), and within which victims and survivors can be reclaimed as worthy members. Second, this article explores the role of nongovernmental organizations in building towards a politics of inclusion. Finally, this article explores the experience of survivors of mass atrocity reconciling memory with living.

Looking Back . . . And Ahead, Hugo Paemen Jan 1999

Looking Back . . . And Ahead, Hugo Paemen

Fordham International Law Journal

It seems that any projection of Europe's future today must pass through the prism of its multi-faceted relationship with the United States. To some Europeans, this thought is obnoxious. The role of the United States as the sole world power, however, makes this concept even more ineludible. How should it be done? And how can the United States help, once more? These are some of the thoughts that occasionally crop up in the back of the mind of someone dealing with the day-to-day vicissitudes of European Union (‘EU‘) and U.S. relations.

Protecting The Rights Of Pediatric Research Subjects In The International Conference On Harmonisation Of Technical Requirements For Registration Of Pharmaceuticals For Human Use, Ann E. Ryan

Fordham International Law Journal

This Comment argues that the parties to the International Conference on Harmonization of Technical Requirements for Regulation of Pharmaceutical Drugs (ITCH) should adopt more specific guidelines for pediatric research than those included in its Good Clinical Practice Guidelines (ICH GCP), and analyzes their attempt to do so in the Draft Guideline on Pediatric Trials. Part I of this Comment outlines the genesis of the current international guidelines for human research and how they relate to pediatric subjects. Part I also explains the human research guidelines of the three principal members of the ICH. Part II describes the function of the …
