Substrate And Enzyme Profile Of Fast And Slow Skeletal Muscle Fibers In Rhesus Monkeys, Varvara P. Grichko, Gwen J. Gettelman, Jeffrey Widrick, Robert H. Fitts
Biological Sciences Faculty Research and Publications
Results from the Russian Cosmos program suggest that the rhesus monkey is an excellent model for studying weightlessness-induced changes in muscle function. Consequently, the purpose of this investigation was to establish the resting levels of selected substrate and enzymes in individual slow- and fast-twitch muscle fibers of the rhesus monkey. A second objective was to determine the effect of an 18-day sit in the Spacelab experiment-support primate facility [Experimental System for the Orbiting Primate (ESOP)]. Muscle biopsies of the soleus and medial gastrocnemius muscles were obtained 1 mo before and immediately after an 18-day ESOP sit. The biopsies were freeze-dried, …

Philosophical Considerations And The Use Of Narrative In Law, George A. Martinez
Philosophical Considerations And The Use Of Narrative In Law, George A. Martinez
Faculty Journal Articles and Book Chapters
The use of narrative in law raises a number of philosophical/jurisprudential issues. Narrative has been used primarily by critical theorists, including critical race theorists, Latino legal theorists, Asian-American legal theorists, feminist legal theorists, and gay/lesbian legal theorists. They offer narrative as a way to introduce a perspective that is not represented in mainstream legal discourse.
Drawing on philosophy, the author explains the importance of narrative for outsiders and offers responses to some important philosophical or jurisprudential objections to the use of narrative in law. In particular, the author responds to the following claims: (1) the use of narrative is an …

Processus Organisationnels Et Psycho-Sociaux Favorisant La Participation Des Travailleurs En Santé Et En Sécurité Du Travail, Marcel Simard, Marie-Claire Carpentier-Roy, Alain Marchand, François Ouellet

This study presents the results of vibration measurements carried out on three different models of tanker trucks in which two different seat models with air suspension were installed. These results are used to evaluate, for each of the truck/seat combinations, the severity of the exposure with respect to ISO standard 2631/18[1] , and to determine which of the truck/seat combinations provides an extended exposure time under similar operating conditions. Lastly, the IRSST effect of the load on the vibration levels is also evaluated.

The Juvenile Justice System Of Richmond : Progression Into The Future, Elizabeth Ann Teixeira
The Juvenile Justice System Of Richmond : Progression Into The Future, Elizabeth Ann Teixeira
Honors Theses
The area of juvenile justice in America is a growing concern among both urban and rural community leaders. According to the Community Collaborative for Youth, the juvenile violent crime rate in Richmond is triple the state average. 1 The juvenile violent crime rate is the percentage of violent crime committed by a person under the age of eighteen. This is merely one aspect of the adversity facing the juvenile justice system in the eyes of the community. As a result of the growing need for information on the subject, a great deal of literature has been published about the risk …
Gender Discrimination Within The Reproductive Health Care System: Viagra V. Birth Control, Lisa A. Hayden
Gender Discrimination Within The Reproductive Health Care System: Viagra V. Birth Control, Lisa A. Hayden
Journal of Law and Health
This Article begins with an examination of the prescription drug, Viagra and the medical condition it is intended to aid. Additionally, this Article evaluates the five most common, and FDA approved forms of contraceptives: contraceptive pills, intrauterine devices (IUD's), Depo-Provera shots, Norplant inserts and diaphragms. A basic understanding of the above prescriptions is necessary to determine if health care inequity exists between men and women in the area of prescriptive coverage, or if there is such a difference between the medical conditions involved that insurance companies are justified in excluding contraceptive coverage while including Viagra coverage. Part III of this …
Searching For The Holy Grail: The Human Genome Project And Its Implications , Allison Morse
Searching For The Holy Grail: The Human Genome Project And Its Implications , Allison Morse
Journal of Law and Health
This Paper will explore the ethical considerations of the reductionist paradigm that the Human Genome Project represents, and analyze how this paradigm affects our political institutions, our family relationships, and even our identity. Part Two will provide the scientific background for a discussion of the Human Genome Project. It will begin by defining two competing theoretical constructs scientists use when exploring biological phenomenon: reductionism and organism. This Part will then offer a rudimentary explanation of how genes function. Yet even this rudimentary explanation illustrates the complexity involved in the functioning of genes, leaving the reductionist notions of genes as the …
Current Legal Intervention Regarding Experimental Treatments Must Be Changed: An Analysis Of High Doses Of Chemotherapy With Autologous Bone Marrow Transplantation For Breast Cancer Patients, Emily Smayda
Journal of Law and Health
The specific analysis of HDC-ABMT will help the reader to realize that the medical procedures being dealt with by litigation are not necessarily wildly innovative. Insurance companies are hiding behind the guise of words such as "experimental" to avoid paying for treatments that are both feasible and needed. Further, HDC-ABMT being used for breast cancer patients, suggests a possible discriminatory aspect that cannot be reached with current legal intervention. This Note suggests ways of dealing with insurance coverage denial on a more direct level. Instead of being bogged down by contract language and ERISA preemption, proposals for national standards and …
Domestic Partnership Benefits: Why Not Offer Them To Same-Sex Partners And Unmarried Opposite Sex Partners, Debbie Zielinski
Domestic Partnership Benefits: Why Not Offer Them To Same-Sex Partners And Unmarried Opposite Sex Partners, Debbie Zielinski
Journal of Law and Health
Employers offering these benefits to same-sex domestic partners only, may face legal challenges such as marital status and sexual orientation discrimination or equal protection arguments from their unmarried heterosexual employees. In addition, states and municipalities have been increasing the potential of such litigation by passing laws that prohibit discrimination based on sexual orientation and marital status especially in the areas of housing and employment. This Note examines the potential of such legal challenges when employers use the narrow definition in structuring their domestic partner benefit programs. In addition, avoiding challenges by simply not offering benefits will be discussed. However, before …

Cobra Continuation Coverage And The Plain Reading Of The Statute: Geissal V. Moore Medical Corporation , Judith C. Brostron
Cobra Continuation Coverage And The Plain Reading Of The Statute: Geissal V. Moore Medical Corporation , Judith C. Brostron
Journal of Law and Health
This Paper will discuss the relevant statutes, case law and the Supreme Court's opinion in Geissal v. Moore Medical Corp. It concludes that the Supreme Court correctly reversed the Eighth Circuit's opinion in Geissal by applying the plain meaning of the statute and rejecting the "significant gap" theory. James Geissal was entitled to COBRA continuation coverage even though his wife had preexisting group health insurance coverage. The Fifth, Eleventh and Eigth Circuits' significant gap theory is not supported by the plain meaning of the statute or Congress' intent. The employee should have the choice to elect COBRA or decide whether …
Beyond Washington V. Glucksberg: Oregon's Death With Dignity Act Analyzed From Medical And Constitutional Perspectives , Steven B. Datlof
Beyond Washington V. Glucksberg: Oregon's Death With Dignity Act Analyzed From Medical And Constitutional Perspectives , Steven B. Datlof
Journal of Law and Health
This Article examines several aspects of the medical and legal debate on physician-assisted suicide. Part I describes the Oregon Death with Dignity Act, the only existing American law legalizing physician assisted suicide. Understanding the provisions of the DWDA provides a concrete, practical framework for discussing the medical and constitutional issues central to the PAS debate. Part II considers the wisdom of the DWDA in light of current medical knowledge and practice. The law allows a patient, with only a few months to live, a human end to intolerable suffering under controlled conditions. It is carefully crafted to ensure that patient …
Directors' Duty Of Care To Monitor Information Systems In Hmos: Some Lessons From The Oxford Health Plan, Mary E. O'Byrne
Directors' Duty Of Care To Monitor Information Systems In Hmos: Some Lessons From The Oxford Health Plan, Mary E. O'Byrne
Journal of Law and Health
Given this scale of investment, the centrality of information systems to the success of an HMO, the obligation of regulatory compliance, plus the attention now focused on the year 2000 "millenium bug" problem, information systems are clearly a major area of concern and oversight by corporate directors. This paper analyzes the role of information systems in HMOs and the nature of the HMO directors' duty of care in monitoring the integrity of the information systems to determine when directors may be held personally liable for losses suffered by the corporation when the systems collapse. Section I addresses in general the …
Mr. Peanut Goes To Court: Accomodating An Individuals Peanut Allergy In Schools And Day Care Centers Under The Americans Wtih Disabilities Act, Marie Plicka
Journal of Law and Health
This article explores the ADA and the interpretive case law, as it pertains to schools and day care centers, in hopes of better understanding the purpose of the statute as well as to predict its future. Part II of this article provides a brie explanation of peanut allergies. Part III contains an overview of Title II and Title III of the ADA and their interpretive regulations. Part IV analyzes whether an individual asserting a Title II claim under the ADA, where the relief sought is also available under the Individual with Disabilities Education Act before asserting his or her ADA …

Erisa Preemption: Will The Elimination Of The Erisa Preemption Clause Help Or Harm America's Ability To Deal With Its Pending Health Care Crisis, Damon Henderson Taylor
Journal of Law and Health
This article explores the arguments surrounding the fate of the preemption clause and argues that Congress must work to preserve self-insured employers' accountability to its employees while concurrently retaining the services of self-insured employers in the health care business. Part II analyzes the federal government's relationship with the health care industry, concentrating selectively on four episodes of federal regulation which helped create the health care crisis that we encounter today - the Hill-Burton Act, the Congressional amendments to the Health Professions Educational Assistance Act, the advent of Medicare, and ERISA. Armed with this understanding, Congress's evaluation of health care issues, …
Environmental Clean-Up And Property Price Change, Emily Aronow
Environmental Clean-Up And Property Price Change, Emily Aronow
Honors Papers
In my experiment, I am trying to find the value, to Lorain County property owners, of cleaning up the Black River which runs through Lorain County. This study involves a number of property variables, a number of neighborhood variables, and the environmental variables. The hedonic price function takes this general form:
Property Price = c + β1Property Characteristics + β2Neighborhood Characteristics + β3Environmentai Characteristics + u.
This equation says that the price of a piece of property is a function of several things: the characteristics of the property, the characteristics of the neighborhood it's in, and the characteristics of the …

In this article we examine the Orphan Drug Act and one of the most important incentives it provides for the development of new drugs for rare diseases, a seven-year period of market exclusivity for new orphan drugs. The FDA has had difficulty interpreting the market exclusivity provisions of the Orphan Drug Act since its enactment. The continuing uncertainties about the scope of protection that the Act provides for innovative products threaten the basic purposes of the Act. The FDA's recent interpretation of the Act raises numerous questions: Should market protection from the Orphan Drug Act depend on the physical and …
