The impetus for this Article was a case handled this past year by the Civil Legal Services Clinic which I teach at New York University Law School. In the clinic, third-year students represent clients in a variety of cases, including housing, government benefits, immigration, guardianship planning for clients who are HIV positive, and education. The students, who work in pairs, select from the clinic's docket the kinds of cases on which they want to work. The two students in this particular case chose to work on a case for a client who was HIV positive. The clinic's experience in that …

My motivation is simple. In order to understand the evolution of political theory, it is important to identify the strands of socialist thought in Hayek that with time have become the mainstays of the political left. Hayek's effort to find some common ground with his opponents led him to make unwise concessions to the benevolent use of state power. Another category of rule might be called the Danger Zone Rules (DZRs). These rules do not so much forbid bad conduct, but rather describe situations that could lead to bad conduct. Those situations comprise a danger zone that lawyers are forbidden to occupy, either at all or without a client's informed agreement. DZRs are of two types..One type is matter-specific. It focuses on particular clients and matters or on particular kinds of transactions between lawyer and client. Let's call these Matter Danger Zone Rules (MDZRs). As we approach the new century, the Nation is at a critical juncture with respect to race relations and the law. For the past two decades “affirmative action” has been the central mechanism through which we have promoted racial integration, and, at the same time, a central issue of controversy. Since 1996, many authoritative voices challenge the legitimacy of affirmative efforts to achieve racial integration. The Supreme Court has struck down many affirmative action programs. The Court has not upheld any affirmative action program since 1989, when, by a 5-4 decision, it approved a narrowly targeted Congressional program to encourage …

I argue at the beginning of this Essay that Professor Yamamoto's claim that there exists a divide of chasmic proportions between progressive race theory and legal and political practice asserts too much. Nevertheless, my view of the relationship between theory and practice leads me to suggest that the guidelines he proposes for critical race praxis should be applied to progressive race theory. The tensions he describes in contemporary civil rights litigation exist in, though they do not derive from, progressive race theory.

Incidence Of Myocardial Infarction In Coronary Arteries With Previously Non-Significant Stenosis (<50%) Identified On Angiography, Brandi R. Haik, Amy M. Schreur

The objective of this study was to determine the frequency of myocardial infarctions in coronary arteries with previously non-significant (<50%) stenosis identified on coronary angiography. The angiograms of ten subjects who had undergone cardiac catheterization prior to their acute myocardial infarction were evaluated. Six of the ten subjects (60%) were found to have an acute myocardial infarction in areas supplied by vessels with <50% stenosis identified on previous angiography. Three of these six subjects had underwent percutaneous transluminal coronary angioplasty (PTCA) after angiography and one subject undergone coronary artery bypass grafting (CABG) prior to the initial angiogram. Four of the ten subjects (40%) included those who had >50% stenosis identified on prior angiography in the infarct related artery. Although this study involved a small sample that did not yield statistically significant results, the data did point to the fact that an acute myocardial infarction can occur in vessels with non-significant (<50%) stenosis.

Generative Concern, Political Commitment, And Charitable Actions, Bill E. Peterson, Lauren Duncan

Psychology: Faculty Publications

The implications of psychosocial generativity (Erikson, 1950) for understanding contemporary politics were explored. Study 1 replicated, in two samples, previous findings that generativity concerns are related to a variety of political activities, including the expenditure of time and money in support of political organizations. Using path analyses, Study 2 extended these findings and demonstrated how midlife generativity concerns interacted with political orientation and interest in politics to produce stronger relationships with giving. These findings suggest that people view the political arena as one important way to improve society and thereby manifest cultural generativity. Although focusing on the domain of politics, …

We have here, not the clash of opposites, but a series of family quarrels within what you might call the Party of Aspiration in legal ethics. My seven allies and I all favor lawyers' ethic of more complex judgment, and more responsibility to nonclients than the currently dominant one.
