S. Nassir Ghaemi tells us that whereas "neurologists are sometimes accused of admiring disease rather than treating it," psychiatrists seek to cure disease even when they do not understand it. At the same time, he notes that Freud had both theoretical and practical interests that occasionally point in different directions, and psychiatrists have learned that theoretical understanding of the sources of suffering does not always translate directly into useful clinical practice. For their part, philosophers are often criticized for indulging in armchair speculation that yields neither empirical understanding nor practical efficacy. Depression needs to be understood within interdisciplinary scientific, biopsychosocial, therapeutic frameworks, but it also has a moral dimension. The tendency to oppose moral and therapeutic perspectives, as well as to replace moral outlooks with mental-health outlooks, handicaps thinking about depression and many other topics. John Stuart Mill's midlife crisis illustrates how an experience of depression can be both a sickness and a source of moral insight. Furthermore, therapy has a moral dimension, and conversely a humane outlook is interwoven with health-oriented approaches and avoids excessive blaming and guilt. Complicating matters, depression sometimes undermines moral autonomy, and there is a continuum …

A wide array of policy instruments can protect domestic firms against foreign competition. Regulatory measures that raise the costs of foreign firms relative to domestic firms are exceptionally wasteful protectionist devices, however, with deadweight costs that can greatly exceed those of traditional protectionist instruments such as tariffs and quotas. This Article develops the welfare economics of regulatory protectionism and a related political economy analysis of the national and international legal systems that must confront it, including the WTO, the NAFTA, the European Union, and the United States federal system. The WTO has become the chosen forum for various trade-related additional policies and provisions such as Trade Related Environmental Measures (‘TREMS‘), TRIMS, TRIPS, and possibly in the future, competition and investment rules. The TRIPS, as is well known, owes its existence to trade-offs with DCs, which have still not been fully implemented. Future additional policies, if controversial, would need to be justified separately on economic grounds, or risk failure. Detailed multilateral competition rules will undoubtedly be adopted one day. Constitutional Comparisons And Converging Histories: Historical Developments In Equal Educational Opportunity Under The Fourteenth Amendment Of The United States Constitution And The New South African Constitution, Alfreda A. Sellers Diamond

The black populations in both the United States and South Africa continue to suffer under the legacy of past discrimination and unequal educational opportunity. In both countries, the constitutional revisions eliminating state-sanctioned racial discrimination failed to alleviate the disadvantages experienced by blacks in terms of socioeconomic status, educational opportunity and political power.

America's post-emancipation history, including the Plessy v. Ferguson and Brown v. Board of Education Supreme Court jurisprudence, shows that the removal of de jure racial discrimination and constitutionally countenanced unequal treatment is not enough to repair the damage and lingering effects caused by former discrimination. The Americans with Disabilities Act (ADA) 1 was enacted in 1990 with considerable fanfare and support. Feminist Scholarship

INTRODUCTION The overarching question motivating this Review Essay is whether- and, if so, in what ways-we should understand lawyering roles to be gendered. I examine this question by reviewing Kathryn Kish Sklar's recent biography of Florence Kelley, an early "public interest" lawyer and social activist whom Felix Frankfurter described as the woman who had "the largest single share in shaping the social history of the United States during the first thirty years of this century."
