Federal Transfer Taxation And The Role Of State Law: Does The Marital Deduction Strike The Proper Balance?, Mitchell M. Gans

The federal transfer-tax system often makes state law a critical determinant. This is a necessary feature of a system that taxes the transfer of property, a concept that ordinarily derives its meaning from state law. As a matter of federal tax policy, however, it is important that the system neither overemphasize nor under emphasize state law. Part I undertakes a consideration of the role of state law in the transfer-tax system and the negative consequences that occur where the tax law fails to strike the proper balance.

For social scientists, every orientation interview is inherently an opportunity for systematic observation, analysis, and critique. Consider, by way of contrast, a hypothetical committee of mathematicians who visit archival repositories searching for documentary materials to display during the upcoming centennial celebration of the Mathematics Department at their home university. As mathematicians, orientation interviews are simply means to their pragmatic ends. For social scientists, however, especially for qualitative sociologists such as myself (Hill 1993), the situation is more complex. The Warren Court is dead. None of its Justices remain on the benchindeed, only Justice White survives-and the recent history of the Supreme Court has been in large part a history of repudiating controversial Warren Court doctrines. Public opinion likewise repudiates Warren-style judicial activism, and constitutional scholarship-which as recently as the mid- 1980s consisted in considerable measure of theoretical defenses for Warren Court-inspired methods of interpreting the Bill of Rights-has grown increasingly skeptical of expansive interpretive strategies. It is quite possible that future constitutional historians will regard the Warren era as an aberration. The Warren Court, after all, was not …

This Comment explores the various legal methods designed to protect cultural property and to prevent its illegal removal. Part I examines both international and U.S. efforts to prevent illegal removals of cultural property. This Part briefly outlines the history of cultural property protection, focusing upon the first international agreements to contain cultural property protections and their failure during World Wars I and II. The topic for this thesis examines the utilization of senatorial websites by United States Senators as a new communication tool. Three different areas of content will be examined: informational content, interactive content and audio-visual content. Those three areas will be used to examine the differences between Senators in several different ways: gender and race, party affiliation, length of service in the senate, region of the country they represent, urban and rural states, and age of the Senators. The Topic. The topic of this project is evangelistic theory. Because of the large-scale secularization of Western society, the evangelistic method that has prevailed for decades is becoming less and less effective. Some adjustment to evangelistic process must be made if it is to remain effective in speaking to thinking, sophisticated modems.

Problem

The Lorn we and Yao tribes in Malawi practice traditional male circumcision rituals which are damaging the Malawian society. While these rituals have value and fill key functions in society, they are at the same time troublesome. The lack of proper medical equipment and training in performing actual circumcision, as well as accompanying teachings which encourage sexual promiscuity, makes these ceremonies physically, spiritually, and morally dangerous. The AIDS epidemic in Malawi can also be partly traced to these rituals. The "globalization" of commerce provides ever-growing opportunities for producers, employers, and service providers to shop the globe for more amenable jurisdictions. While they enjoy a "race to the top," an international "race to the bottom," spawned by decreasing relocation costs, threatens to compromise the achievements of the welfare state and lower standards of consumer protection. National governments, weakened by competition that entails leaner budgets, find it increasingly difficult to cooperate in the appropriation of crucial shared natural resources, seriously endangering these assets while damaging the environment. This research examines the role of gender in African women’s economic co-operatives in the Northwest Province of South Africa. The theoretical frameworks of feminist geography and gender and development reveal the interconnections between issues of women, work, and rural economic development. Background information is presented to illustrate the complexities of rural African women’s economic exclusion under apartheid and today, and a case study approach is utilized to reveal the development and viability of two particular economic co-operatives. Land-use history in Zimbabwe has caused dramatic differences in erosion severity between Commercial and Communal Lands. High population numbers have been found to be positively correlated with the extent of eroded area in Communal Lands. Dambo wetlands are particularly vulnerable to this population pressure as they are isolated wet areas supporting plant growth during the six to eight months of the dry season. In Zimbabwe, they cover 1.3 million hectares of the country. This study examines the plant composition and seed bank of these wetlands and compares vegetation in dambos with contrasting land-use histories, communal versus commercial. Communal Lands are …

Gypsy Moth, Lymantria dispar (L.), has been an exotic pest in West Virginia for at least fifteen years. The initiation of treatment to prevent defoliation has been an important method that helps to reduce the spread of, and the area defoliated by, this pest. This research study identifies the recent expansion of the gypsy moth population and the extension of the affected area, documents the defoliation, and evaluates the treatment of gypsy moth infestation in West Virginia for the years 1986 to 1996. Repeated defoliation by the gypsy moth damages and kills trees and has hygiene and aesthetic consequences. The …

The purpose of this study was to understand how a special education supervisor, four beginning special education teachers and their building principal experienced improvement of instruction. The study was conducted in four special education classrooms in a county with a school-aged population of approximately 14,000 students. The county was located in a rural, upper Southern state. Data were collected primarily from January through June of 1997. Using qualitative methodology, data were collected by use of participant observation, interviews, and analysis of documents pertinent to improvement of instruction. This research note examines the phenomenon of cross-border shopping between the United States and Canada as a form of borderlands tourism. This activity has always existed in the region and has traditionally been characterized by high but consistent numbers of Canada-to-US flows and lower but consistent numbers of US-to-Canada flows. However, in 1997, owing to an increase in value of the Canadian dollar and other economic variables, the number of Canadian shopping trips to the United States increased dramatically until 1992, when the value of the Canadian dollar began to fall.
