Traffic Jam: Recommendations For Civil Penalties To Curb The Recent Trafficking Of Women From Post-Cold War Russia, Christopher M. Pilkerton

Michigan Journal of Gender & Law

This Article will examine the recent criminal trend of trafficking women from post-Cold War Russia into the United States. First, it will examine the Russian mafia and its development. It will also discuss the system of economic corruption that currently exists in Russia, which facilitates government involvement with this criminal activity. It will further investigate the issues surrounding trafficked women and the international anti-trafficking conventions that have been created by the United Nations. Next, it will go into a deeper discussion of the current status of relevant international law and the issues involving the International Criminal Court. Finally, this Article …

Sobriety In A Post‐Genocidal Society: Good Neighborliness Among Victims And Aggressors In Rwanda?, Mark A. Drumbl Jan 1999

Sobriety In A Post‐Genocidal Society: Good Neighborliness Among Victims And Aggressors In Rwanda?, Mark A. Drumbl

Scholarly Articles

Now as Rwanda begins to mourn the firth anniversary of its genocide, it should also celebrate the fifth anniversary of its survival. As time passes, Rwanda enters a stage of social and historical development which can be referred to as the "post-genocidal" stage. Some would say that Rwanda is actually in an intra-genocidal phase, given the persistence of Hutu rebel insurrection throughout the country, specifically in the Ruhengeri prefecture of the north-west. Although the merits of this classification can be debated, fatalistically characterizing Rwanda to be intra-genocidal assumes an ability to look in the future, a task no scholar is …

The Republic Of Turkey In Europe: Reconsidering The Luxembourg Exclusion, Patrick R. Hugg Jan 1999

The Republic Of Turkey In Europe: Reconsidering The Luxembourg Exclusion, Patrick R. Hugg

Fordham International Law Journal

The EU's rebuff of Turkey's application for accession represents more than a missed opportunity to strengthen and deepen the relationship between these two related spheres. Indeed, the lack of finesse--the unnecessarily impolitic form of the rejection--propels Turkey in the opposite direction. The old assumption that relations with Europe were of primary importance is “subject to increasingly critical examination.” Acknowledging that Turkey may not be ready for accession in the next wave, the EU should have pursued some less antagonizing route. The premature decision to begin negotiations with Cyprus only intensifies the conflict.

Disestablishing Local School Districts As A Remedy For Educational Inadequacy Note, Aaron J. Saiger Jan 1999

Disestablishing Local School Districts As A Remedy For Educational Inadequacy Note, Aaron J. Saiger

Faculty Scholarship

Most state constitutions recognize a right to education, but courts have been hard pressed to respond to violations of that right. Some state courts have imposed financial and substantive reforms, only to see their implementation miscarry as educational deficiencies stubbornly persist. Other state courts, fearing such outcomes, instead treat education claims as nonjusticiable political questions; in these states, public education is a right with no remedy. This Note argues that courts should instead base remedies on state statutes that permit states to disestablish-i.e., to withdraw authority from-deficient school districts. Disestablishment, like other structural remedies, is largely self-implementing and avoids judicial …

An Evaluation Of State Enterprise Zone Policies: Measuring The Impact On Business Decisions And Housing Market Outcomes: Dissertation Summary, Robert T. Greenbaum Jan 1999

An Evaluation Of State Enterprise Zone Policies: Measuring The Impact On Business Decisions And Housing Market Outcomes: Dissertation Summary, Robert T. Greenbaum

Dissertation Awards

The dissertation examines the impact of state urban enterprise zones on business and housing market outcomes at the ZIP code level in six states: California, Florida, New Jersey, New York, Pennsylvania, and Virginia. In order to obtain consistent estimates of zone impacts, I limit the analysis to relatively similar subsamples of zone and non-zone areas. The estimated probability of zone designation is used to create comparison groups that control for differences in pre-designation characteristics. I find that, on average, zones have had little impact on business or housing market outcomes. New businesses create significantly more jobs in zones, but this …

Ecological And Population Changes In Fishing Communities Of The North Atlantic Arc, Lawrence C. Hamilton, Richard L. Haedrich Jan 1999

Ecological And Population Changes In Fishing Communities Of The North Atlantic Arc, Lawrence C. Hamilton, Richard L. Haedrich

Sociology

In the decades since World War II, large-scale ecological changes have affected fishing communities across the northern Atlantic. Substantial declines hit their historically important resources, most notably the Atlantic cod. Such declines were often accompanied by increases in other, previously less exploited, species. Interactions between fishing pressure and environmental variation have driven ecological change. Ecological changes in turn reshaped the fisheries, contributing to altered demographic profiles of fisheries-dependent communities. Many places lost population, especially through out-migration of young adults. Broad social forces also contributed to these trends, but the timing and geographical details of population changes often correspond to specific …

Zinc Mining Contamination And Sedimentation Rates Of Historical Overbank Deposits, Honey Creek Watershed, Southwest Missouri, Jason L. Carlson Jan 1999

Zinc Mining Contamination And Sedimentation Rates Of Historical Overbank Deposits, Honey Creek Watershed, Southwest Missouri, Jason L. Carlson

Graduate Theses/Dissertations

Sediment-associated contaminants released by past mining activities in the Tri-State Lead and Zinc District in southwest Missouri pose a long-term risk to water quality. This study uses sedimentological and geochemical analyses to describe the relationships between mine contaminant dispersal and historical sedimentation patterns of the Honey Creek watershed ( 176 km2) which drains the Aurora Sub-district along the eastern boundary of the Tri-State District. This watershed has been subjected to an intense period of Pb-Zn mining that began in 1886, peaked in 1916, and ended by 1930. The objectives of this study are to: (1) determine the magnitude and distribution …

Bringing The Standards Into The Classroom: A Case Study Of One School District's Implementation Process, Georgia Sarroub, Aleidine Kramer Moeller

Department of Teaching, Learning, and Teacher Education: Faculty Publications

In 1993 federal funding was provided for the development of national foreign language standards for students in kindergarten through twelfth grade. The resulting content standards (Standards for Foreign Language Learning: Preparingfor the 21st Century) define what students should know and be able to do in grades four, eight, and twelve and were intended to "serve as a gauge for excellence" (National Standards in Foreign Language Learning Project 1996, 13). Like the mathematics goals, the foreign language goals were viewed as criteria for excellence rather than as a minimum level of competency (National Council of Teachers of Mathematics 1989, 2).

The Marriage Mirage: The Personal And Social Indentity Implications Of Same-Gendered Matrimony, Linda S. Eckols Jan 1999

The Marriage Mirage: The Personal And Social Indentity Implications Of Same-Gendered Matrimony, Linda S. Eckols

Michigan Journal of Gender & Law

This Article will examine why so much is at stake in the political, social, and legal debate over same-gender marriage. It will not address the constitutional questions of whether there is a fundamental right to marry, although persuasive arguments have been advanced from both sides of the debate." This Article will focus on a more introspective view of the potential effects of legalizing same-gender marriage on the identities of gay men and lesbians in committed relationships and on the interaction between same-gender couples and society. Marriage would provide the integration sought by gay men and lesbians, but at the expense …

Analysis Of Impact And Value Of Neasc High School Accreditation Procedures On School Accountability And School Improvement From 1987-1997, George Allan Cushing Jan 1999

Analysis Of Impact And Value Of Neasc High School Accreditation Procedures On School Accountability And School Improvement From 1987-1997, George Allan Cushing

Doctoral Dissertations

From a 1983 federal study which concluded, as its title suggests, that America had become A Nation at Risk because of a failing public school system, the modern standards movement was born. This educational reform movement beginning in the 1980's and continuing through the 1990's brought about the development and establishment of many accountability and improvement initiatives aimed at public schools. Also during this time, the New England Association of Schools and Colleges (NEASC), through its Commission on Public Secondary Schools along with five other regional accrediting agencies across the country, was continuously engaged in the practice of evaluating and …

Examining The Viability Of Another Lord Of Yesterday: Open Range Laws And Livestock Dominnance In The Modern West, Coby Dolan Jan 1999

Examining The Viability Of Another Lord Of Yesterday: Open Range Laws And Livestock Dominnance In The Modern West, Coby Dolan

Animal Law Review

In this comment, the author explores the development of open range laws in Oregon and other western states and argues such laws should be abolished or drastically amended. Common law requires ranchers to fence livestock in or face liability for damages caused by strays. Hvever, historical customs and practices of Western states were shaped by vast open lands and sparce populations, leading to open range customs which required a landowner to fence "out" livestock to protect their property. This comment focuses on the case of Dr. Patrick Shipsey, an Oregon landowner convicted of shooting cattle that wandered onto his land. …
