The (Limited) Role Of Regulatory Harmonization In International Goods And Services Markets, Alan O. Sykes Jan 1999

The (Limited) Role Of Regulatory Harmonization In International Goods And Services Markets, Alan O. Sykes

Articles

With the conclusion of the Uruguay Round and its agreements relating to technical barriers, much attention has been devoted to the possibility of harmonizing international regulatory policies to reduce the impediments to commerce that result from regulatory heterogeneity. This paper argues that, as a normative matter, harmonization is inferior to a legal system that tolerates regulatory differences subject to legal constraints, and that relies on mutual recognition where appropriate (the exception to this claim being matters of technical compatibility between products). Related, as a positive matter, harmonization will often lack any political constituency and thus instances of true harmonization will …

Introduction: Latcrit Theory: Mapping It's Intellectual And Political Foundations And Future Self-Critical Directions, Margaret E. Montoya Jan 1999

Introduction: Latcrit Theory: Mapping It's Intellectual And Political Foundations And Future Self-Critical Directions, Margaret E. Montoya

Faculty Scholarship

The third annual gathering of LatCrit scholars has resulted in this cluster of essays and articles that continue the work of defining the foundations and the future directions of this legal scholarship movement. As described in some of the articles within this cluster, LatCrit has had the benefit of learning valuable lessons from other slightly older schools of critical legal theory, most particularly from the Critical Race Theory ("CRT") Workshop. The LatCrit movement has been strengthened because scholars identified primarily with CRT working with and alongside scholars identified primarily with LatCrit have struggled to recognize, name and address the hetero-normativity …

Family Cluster Of Rocky Mountain Spotted Fever, James E. Childs, Timothy F. Jones, Allen S. Craig, Christopher D. Paddock, Don B. Mckechnie, Sherif R. Zaki, William Schaffner

Zoonotics and Wildlife Disease: Publications

Soon after a patient from Tennessee died of Rocky Mountain spotted fever (RMSF), several family members developed symptoms suggestive of the disease and were treated presumptively for RMSF. Fifty-four persons visiting the index patient's home were interviewed; serum samples were collected from 35. Three additional cases of RMSF were confirmed, all of which occurred in firstdegree relatives. Time spent at the family home and going into the surrounding woods were significantly associated with developing antibodies to Rickettsia rickettsii. Ticks were collected and examined for rickettsiae by polymerase chain reaction analysis. Because hyperendemic foci and family clusters of RMSF can …

Interdisciplinary Teaching And Learning, Deborah Dezure

Professional and Organizational Development Network in Higher Education: Archives

Interdisciplinary initiatives are proliferating throughout higher education at an unprecedented rate (Edwards, 1996; Gaff and Ratcliff, 1997; Klein, 1996). They can be found in general education, replacing and augmenting distribution requirements; in emerging disciplines, such as cultural and gender studies, environmental studies, and neuroscience; in new curricular designs, such as learning communities, capstone courses, and service learning; and in the new pedagogies, such as collaborative learning, discovery and problembased learning, and the use of technology, particularly the Internet for instruction.

If we want our students to engage in complex intellectual tasks to integrate the insights of different disciplines, then lets …

Murder, Nonnegligent Manslaughter, And Spatial Autocorrelation In Mid-South Counties, F Carson Mencken Jan 1999

Murder, Nonnegligent Manslaughter, And Spatial Autocorrelation In Mid-South Counties, F Carson Mencken

Regional Research Institute Working Papers

In this paper we explore to what extent murder and violent crime rates in the mid-South are spatially autocorrelated with a variety of county-level spatial association measures. The analysis shows that while statistically the murder and violent crime rates in the mid-Southern counties are spatialy associated, the degree of clustering among these counties is minimal-especially when compared to clustering among the significant predictors of violent crime (percent black, female headed households, percent in poverty, etc.). The analysis has important implications as to how county violent crime rates are being modeled.

Available Resources Of The Fire Clay Coal In Part Of The Eastern Kentucky Coal Field, Stephen F. Greb, Gerald A. Weisenfluh, Robert E. Andrews, John K. Hiett, James C. Cobb, Richard E. Sergeant Jan 1999

Available Resources Of The Fire Clay Coal In Part Of The Eastern Kentucky Coal Field, Stephen F. Greb, Gerald A. Weisenfluh, Robert E. Andrews, John K. Hiett, James C. Cobb, Richard E. Sergeant

Report of Investigations--KGS

Available resources for the Fire Clay coal were calculated for a 15-quadrangle area in the Eastern Kentucky Coal Field. Original coal resources were estimated to be 1.8 billion tons (BT). Coal mined or lost in mining was estimated at 449 million tons (MT), leaving 1.3 BT of remaining Fire Clay resources in the study area. Of the remaining resources, 400 MT is restricted from mining, primarily because the coal is less than 28 in. thick, normally considered too thin to mine underground using present technology. The total coal available for mining in the study area is 911 MT, or 52 …

The Foreign Corrupt Practices Act As A Threat To Global Harmony, Steven R. Salbu Jan 1999

The Foreign Corrupt Practices Act As A Threat To Global Harmony, Steven R. Salbu

Michigan Journal of International Law

Focusing primarily on the pragmatic and moral perils of cultural imperialism, I also alluded very briefly to a "political peril" that arises from the FCPA. This peril consists of the added risk of cross-national hostility that is attributable to officious and overreaching legislation across national borders. This article will examine the political hazard in greater detail, explaining why the proliferation of FCPA-style legislation unjustifiably increases the threat to global harmony.

The Holocaust: A Text Set To Extend Beyond The World History Text, Stacie Lynn Deason Jan 1999

The Holocaust: A Text Set To Extend Beyond The World History Text, Stacie Lynn Deason

All Graduate Projects

This project examined the use of trade books, particularly historical fiction and nonfiction, in the social studies curriculum. Through the development of this project, a text set was designed to extend and enrich the students' knowledge of the holocaust beyond the world history textbook. The literature revealed strong support for the use of trade books as a vehicle to learn more than the names, dates and facts presented in the textbook. Trade books allow the students to learn about the human experience of historical events, specifically the Holocaust for the purpose of this project. Through historical fiction and nonfiction trade …

A School-To-Work Transition Manual For Secondary Administrators, Ronald Dean Woodruff Jan 1999

A School-To-Work Transition Manual For Secondary Administrators, Ronald Dean Woodruff

All Graduate Projects

The School-to-Work Opportunities Act was designed to improve student learning, in-school retention, and transition to the workplace by improving the quality and relevance of education for all students. School-to-work uses experiences that integrate school-based and work-based learning and improve students' knowledge of and access to career opportunities. Administered by the U.S. Departments of Education and Labor, the School-to-Work Opportunities Act gives States seed money to design and implement their own comprehensive School-to-Work system. States and localities are given broad latitude in designing their own systems so long as each includes the Act's three components: Work-based learning, school-based learning, and connecting …
