The Missing Pieces Of The Debate Over Federal Property Rights Legislation, Max Kidalov, Richard H. Seamon Jan 1999

The Missing Pieces Of The Debate Over Federal Property Rights Legislation, Max Kidalov, Richard H. Seamon

UC Law Constitutional Quarterly

This Article analyzes the constitutionality of bills in Congress that would alter the two "ripeness" rules that the United States Supreme Court has developed for certain federal court lawsuits based on the Just Compensation Clause of the U.S. Constitution. The Court's ripeness rules apply when a property owner sues a local land-use agency in federal court claiming that the agency has "taken" property by severely restricting the property's use. One of the Court's rules requires the owner to get a final decision from the local agency regarding permissible uses of the property. The other rule requires the owner to exhaust …

The Elkhart County Guards : Company G, 19th Indiana Volunteer Infantry, Eugene D. Watkins Jan 1999

The Elkhart County Guards : Company G, 19th Indiana Volunteer Infantry, Eugene D. Watkins

Master's Theses

In July 1861, 101 farm boys and shopkeepers left northern Indiana to do their part to save the Union. These men, who formed Company G, 19th Indiana Infantry, served with distinction in the famed Iron Brigade. They received their baptism of fire at Brawner's Farm in August 1862. They served for four years, suffering on such battlefields as Antietam, Gettysburg, and the Wilderness. Twenty-five soldiers never returned home as they died during their service. The rest scattered across the country, living out their lives struggling with disabling illnesses and wounds. This study provides a micro-history focusing on a small group …

Multi-User Domain Object Oriented (Moo) As A High School Procedure For Foreign Language Acquisition, James A. Backer

CCAC Theses and Dissertations

Foreign language students experience added difficulty when they are isolated from native speakers and from the culture of the target language. It has been posited that MOOs (Multiuser domain Object Oriented) may help to overcome the geographical isolation of these students. MOOs are Internet-based virtual worlds in which people from all over the real world meet for synchronous textual conversations and can interact with asynchronous textual objects found there. Students who enjoy a MOO site may identify with its virtual target language community and find integrative motivation which the literature suggests is necessary for advanced language acquisition.

This study focused …

The Use Of Cooperative Groups In Learning How To Use New Software Programs, James R. Grunwald Jan 1999

The Use Of Cooperative Groups In Learning How To Use New Software Programs, James R. Grunwald

CCAC Theses and Dissertations

Many teachers lament the fact that they often need to spend too much classroom time training students how to use a particular software program before their students can use it effectively as a tool to complete other course work. Also, after completing the training process, too many students still have not mastered the basics of how to use the program effectively. The purpose of this research was to increase understanding of how the use of cooperative groups during new software training affects both the mastery of the basics of program use, as well as the amount of time needed to …

International Usability, Design Guidelines And Effectiveness Of A World Wide Web-Based Instructional Program For High School Students In A Cross-Culture Learning Environment, Hajime Hayakawa

CCAC Theses and Dissertations

The recent growth of the Internet and the World Wide Web (WWW) has resulted in a vast array of on-line courseware and educational Web sites. Unfortunately, as a large percentage of this information is written in English, non-English speakers are unable to access it. Information written in other languages is likewise unavailable to many native English speakers. Therefore, in order to maximize the usefulness of educational material on the Web, it is necessary to design and implement cross-cultural, bilingual or multilingual Web sites and instructional programs.

This study was designed to contribute to the area of bilingual learning on the …

Uncertain Identities : Aristocratic Women Of English Renaissance Drama, Kimberly Ann Turner Jan 1999

Uncertain Identities : Aristocratic Women Of English Renaissance Drama, Kimberly Ann Turner

Master's Theses

Often, women stand out as being some of the most interesting and ambiguous characters in English drama. In this study, I examine moments in five Renaissance plays in which female characters reject the extreme dichotomies that were used by society to describe women. In the first portion of the paper, I look at the ways in which malcontents are similar to unconventional female characters in that they both challenge existing patriarchal structures. Secondly, I explore the characters of Mellida, Sophonisba, and Desdemona who begin to assert their own desires, while at the same time, they continue to embody more traditional …

Faith And Understanding: The Reforms Of Nikolaus Cusanus, Joseph Eric Sych Jan 1999

Faith And Understanding: The Reforms Of Nikolaus Cusanus, Joseph Eric Sych

Master's Theses

This paper explores the reform ideas of Nikolaus Cusanus, Bishop of Brixen, and Cardinal of St. Peter in Chains. It demonstrates the centrality of reform to the life of Cusanus, and traces the development of his reform ideas. To accomplish this, several of Cusanus' works are utilized, including De concordantia catholica, De dicta ignorant, De quaerendo Deum, several of his sermons, as well as Reformatio genera/is, which contains his reform ideas in their most mature stage of development. The paper argues that Cusanus' reform concept was formulated early, but was later influenced by the emergence of mystical and nominalistic forces.

Derivatives Regulation In The Context Of The Shingle Theory, Allen Madison Jan 1999

Derivatives Regulation In The Context Of The Shingle Theory, Allen Madison

Faculty Publications

This article discusses the regulation of derivative financial instruments. It notes that the government has neither come to a conclusion as to the necessity of regulation nor which agency would have jurisdiction. It also suggests that one tool that regulators could use as an enforcement tool is the "shingle" theory. Next, it provides history and analysis of this theory. Finally, it examines the current state of affairs regarding regulation of derivatives.

Symposium On Human Cloning: Legal, Social, And Moral Perspectives For The Twenty-First Century- Foreword: Cloning Debate, Janet L. Dolgin

Hofstra Law Review

In the United States, legislative responses to cloning among both federal and state lawmakers have been rapid and widespread. The Report of the NBAC to President Clinton proposed that Congress prohibit human cloning for a period of years. In the following year, Congress entertained a variety of bills proposing to ban or regulate human cloning. Some proposed prohibiting human cloning. Others proposed allowing such cloning for research purposes. Similarly, soon after Dolly's birth, state legislators presented a large number of bills aimed at regulating or prohibiting human cloning." Other governments and international bodies responded to Dolly's birth with similar speed …

Missouri's Law On Admissibility Of Other Crimes Evidence: Increasing Inclusivity, Justin M. Dean Jan 1999

Missouri's Law On Admissibility Of Other Crimes Evidence: Increasing Inclusivity, Justin M. Dean

Missouri Law Review

Evidence of other crimes, or uncharged misconduct evidence as it is commonly called, has been important in many criminal trials, including such well-publicized trials as that of O.J. Simpson for murder and those of William Kennedy Smith and Mike Tyson for rape.2 Furthermore, this type of evidence is important because studies have shown that admission of uncharged misconduct evidence greatly increases the likelihood that a jury will find the defendant guilty.3 State v. Skillicorn4 presents a look at the current state of the law concerning admission of other crimes evidence in Missouri. The case illustrates the difficulty in applying current …

Note, A Birthright Rearticulated: The Politics Of Bilingual Education, Nirej S. Sekhon Jan 1999

Note, A Birthright Rearticulated: The Politics Of Bilingual Education, Nirej S. Sekhon

Faculty Publications By Year

This Note addresses Proposition 227, California's recently enacted voter initiative banning bilingual education in public schools. Nirej Sekhon argues that the proposition functions rhetorically as a racially inflected exhortation to nonwhite peoples in the United States. The proposition equates American identity with white identity by claiming English as the birthright privilege of white Americans. As such, the proposition is continuous with the history of language and education politics in the United States. The author concludes by sketching the broad challenge that his analysis poses to current legal mechanisms.

Humanist Ethics And Political Justice: Soto, Sepúlveda, And The "Affair Of The Indies", G. Scott Davis Jan 1999

Humanist Ethics And Political Justice: Soto, Sepúlveda, And The "Affair Of The Indies", G. Scott Davis

Religious Studies Faculty Publications

In the debate over Spanish treatment of the natives of the New World, both sides regularly invoked Aristotle on natural slaves. This paper argues that the interpretation of the Spanish Dominican Domingo de Soto displays a greater understanding of Aristotle and the Aristotelian tradition of justice than that of Juan Gines de Sepúlveda, the Spanish Humanist. The paper goes on to argue that it is the humanist tradition itself that disposes Sepúlveda to misconstrue Aristotle and the tradition of political justice.

Linking Printed Books To Computerized Speech, Edward D. Crook

CCAC Theses and Dissertations

Adult students who experience difficulties in comprehending written (printed) language frequently are limited in their scholastic development and possible employment opportunities. These individuals, who represent a growing segment of the learning disabled population, include poor readers and dyslexics and they routinely seek help and remediation through various educational techniques. One remediation technique often used is "books on tape". Through books on tape, recorded spoken text is presented in a sequential manner to the remedial reader as he or she is reading the corresponding printed document. This dissertation reviewed the books on tape paradigm, and through the use of current computer …

Critical Multiculturalism And The Globalization Of Capital: Some Implications For A Politics Of Resistance, Peter Mclaren, Ramin Farahmandpur Jan 1999

Critical Multiculturalism And The Globalization Of Capital: Some Implications For A Politics Of Resistance, Peter Mclaren, Ramin Farahmandpur

Education Faculty Articles and Research

"Despite the historic defeat of Marxism and constant attempts by so-called progressive educators to exorcize any residual Marxist discourse from the literature on multiculturalism, the contradictions of capital playing themselves out in the theater of contemporary social relations are beckoning Marx's spectre to return and further trouble those theories proclaiming that the "end of ideology" is upon us and that all we need to do in order to rescue humanity is to heed the clarion call of diversity. Too often overlooked in the debates over multiculturalism at present engulfing the academy are the myriad ways in which globalization is shaping …
