An Ovidian Epigraph In Jude The Obscure, Emily A. Mcdermott Jan 1999

An Ovidian Epigraph In Jude The Obscure, Emily A. Mcdermott

Classics & Religious Studies Faculty Publication Series

In part first of Thomas Hardy's Jude the Obscure, the hero undergoes a tragic, if unexceptional, peripeteia. Having set himself idealistically and single-mindedly on the path to intellectual advancement, he is filled with "a warm self-content" at his prospects of moving onward to university study, where his "present knowledge will appear ... but as childish ignorance." Progress toward Christminster, however, is halted abruptly when the innocent Jude Fawley falls prey to Arabella, that "complete and substantial female animal." Suddenly, his Greek New Testament left open but unheeded, he plummets into a sordid spiral of seduction, entrapment, and imprisonment in a …

UF Law Faculty Publications

This Article presents a case study of lending by the International Finance Corporation (IFC), the private-sector lending arm of the World Bank Group, in the oil and gas sector in Guatemala. The case study emphasizes the need for additional environmental reform at IFC. With two separate loans in 1994 and 1996, IFC supported the activities of a small international oil company that was operating within a national park in the northern Guatemalan Petdn, an area of rich tropical forests and globally important wetlands. The company's operations had been "grandfathered"in to the park upon its creation in 1990. Funding from IFC …

The Impact Of Securities Laws On Developing Companies: Would The Wright Brothers Have Gotten Off The Ground?, Stuart R. Cohn Jan 1999

The Impact Of Securities Laws On Developing Companies: Would The Wright Brothers Have Gotten Off The Ground?, Stuart R. Cohn

UF Law Faculty Publications

Suppose the Wright brothers, to pursue their dreams of manned flight, needed outside financing. Confronted with the intimidating regulatory requirements of today 's state and federal securities laws, would they ever have gotten off the ground? With historical illustrations, this Essay presents an entertaining look at the serious problems that would be encountered today by entrepreneurs who have ideas but need capital to develop them. It analyzes the regulatory maze and prohibitions of state and federal securities laws and concludes that, in today's marketplace, the Wright brothers probably would have violated several laws to obtain essential financing for their venture.

Cooperation In International Bankruptcy: A Post-Universalist Approach, Lynn M. Lopucki Jan 1999

Cooperation In International Bankruptcy: A Post-Universalist Approach, Lynn M. Lopucki

UF Law Faculty Publications

This article examines the several competing systems proposed for international cooperation in the bankruptcy cases of multinational companies and concludes that a cooperative form of territoriality would work best. Universalism, the system that currently dominates the scholarship, diplomacy, and jurisprudence of international bankruptcy, holds that the courts of the multinational company's "home country" should have worldwide jurisdiction and apply its own law to the core issues of the case. Universalism is unworkable because it would require that countries permit foreign law and courts to govern wholly domestic relationships and because the of "home countries" of multinational companies are so ephemeral …

Life, Death And The Law - And Why Capital Punishment Is Legally Insupportable , Peter Fitzpatrick Jan 1999

Life, Death And The Law - And Why Capital Punishment Is Legally Insupportable , Peter Fitzpatrick

Cleveland State Law Review

Given that law has an integral commitment to life, in this lecture I want to show how the law should manifest something of a fundamental dissonance, even a terminal incoherence, when law is called upon to deal death. That is what happens in the judicial discourse on the death penalty in the United States. I will approach this demonstration in a way that may at first seem paradoxical, in a way that will bring out the deep affinity between law and death. That affinity is one in which death is, in a sense, the limit of law; a limit that …

College Students In Developmental Reading Classes: Influences Of Learning Styles And Previous Instructional Methods In Grades K-6, Lynda E. Cucco Jan 1999

College Students In Developmental Reading Classes: Influences Of Learning Styles And Previous Instructional Methods In Grades K-6, Lynda E. Cucco

Theses and Dissertations

The ability to read is the very foundation of education at any level. This is particularly true at the postsecondary level. When institutions of higher education have open door policies it is incumbent upon them to provide assistance to any student requiring or requesting it. This assistance may take many forms. A formal course in developmental reading was the focus of this study. The purpose of the study was to determine if there was a relationship between individual learning styles, teaching styles, and teaching methods where the students enrolled in the developmental reading class had experienced success in grades K-6. …

Will The Bang Mean Big Changes To Japanese Financial Laws, Jessica C. Wiley Jan 1999

Will The Bang Mean Big Changes To Japanese Financial Laws, Jessica C. Wiley

UC Law SF International Law Review

In response to both domestic and international pressure, the Japanese government began a series of reforms designed to deregulate their financial market in 1998. The reform plan is modeled after the British and U.S. deregulation measures often-termed "Big Bang" reforms. The essence of Japan's Big Bang is the end of highly segmented financial markets in favor of a single market where domestic and foreign banks, securities houses, insurance companies and other financial institutions will be free to compete in each other's business specialties.

The recent amendments to the Foreign Exchange and Foreign Trade Law are an example of Japanese Big …

Religion And State In Israel: The Case For Reevaluation And Constitutional Entrenchment, Gidon Sapir Jan 1999

Religion And State In Israel: The Case For Reevaluation And Constitutional Entrenchment, Gidon Sapir

UC Law SF International Law Review

From the establishment of the State of Israel until very recently, the issue of religion and state was handled in Israel according to the doctrine of status quo. As a result, matters of religion and state have changed little from the time the State of Israel was established. Underlying the status quo-viewed as an informal "gag rule"-was the perception that it served as a necessary condition for the emergence, maintenance and stability of democracy in Israel. Yet on many occasions over the past several years, once latent disagreements over matters of religion and state have become a major source of …

Swingers: Morality Legislation And The Limits Of State Police Power, Raymond Ku Jan 1999

Swingers: Morality Legislation And The Limits Of State Police Power, Raymond Ku

St. Thomas Law Review

This article examines whether Florida can legitimately convict the swingers pursuant to the Florida Constitution specifically, and principles of constitutional law in general, and concludes that it cannot. In so doing, this article does not attempt to define privacy or to provide a taxonomy of activities that fall within its reach, which has been done quite thoroughly by others. The swingers' conduct clearly falls within what scholars have characterized as the right to sexual autonomy, personhood and freedom of association. However, rather than simply reiterating what those authors have said and applying it to the novel facts of this case, …

A Preliminary Analysis Of The Supply And Demand For Middle School Mathematics And Science Teachers In Virginia, J. A. Sigler Jan 1999

A Preliminary Analysis Of The Supply And Demand For Middle School Mathematics And Science Teachers In Virginia, J. A. Sigler

Journal of Mathematics and Science: Collaborative Explorations

Virginia Colleges and Universities have a major challenge to produce educated elementary and middle school students. The magnitude of this challenge can be measured by studying the number of current teachers in each grade in Virginia and the anticipated retirements and departures from the profession for other reasons. The new licensure requirements have their biggest impact for the preparation of middle school teachers since middle school teachers will no longer be able to receive general middle school certification.
