In this article we ask, "What distinguishes a covenant from a mere contract, and what role does this distinction play for natural law?" Both of us have thought substantially about covenant over the past several years. The concept of covenant comes to us originally from religious sources, so we have paid explicit attention to what the Bible and organized religion have to say about covenant. We have also drawn from our own disciplines of law, economics, and sociology as they explain or draw from the initial concepts.

Whatever happened to the study of restitution? Once a core private law subject along with property, torts, and contracts, restitution has receded from American legal scholarship. Few law professors teach the material, fewer still write in the area, and no one even agrees what the field comprises anymore. Hanoch threatens to reverse the tide and make restitution interesting again. The book takes commonplace words such as "value" and "gain" and shows how they embody a society's underlying normative principles. This Essay merges the perspectives of context and decision-making to assess the role of contextual factors in the unfolding of violent events by adolescents. The framework for decision-making assumes that context is a dynamic rather than a static feature of the cognitive landscape. Decisions by adolescents to engage in crime or violence are shaped through interactions with features of their environments, are contingent on responses emanating from that context, and are filtered through the unique lens of adolescence. The Political Economy Of Recognition: Affirmative Action Discourse And Constitutional Equality In Germany And The U.S.A., Kendall Thomas

This paper undertakes a comparative exploration of affirmative action discourse in German and American constitutional equality law. The first task for such a project is to acknowledge an important threshold dilemma. The difficulty in question derives not so much from dissimilarities between the technical legal structures of German and American affirmative action policy. The problem stems rather from the different social grounds and groupings on which those legal structures have been erected. The purpose of this study was to describe factors that influence women's decision regarding hormone replacement therapy (HRT) at menopause. It is estimated that between 15 and 25% of eligible women are on HRT today. With all of the scientific evidence on the benefits of HR T, this percentage is very low. A questionnaire was sent to 420 randomly selected women from Black Hawk County ages 40 years and older. There were 161 usable responses for a 38.3% return rate. The majority of the women in the study were in the 40-60 years-old age group and were Caucasian college graduates. …

An environmental field study was conducted from April to October 1998 in the Black Hawk County, Iowa. The main goal of the study was to find an appropriate field method to enhance degradation of nitrates in the surficial soil. Seven different methods were developed in the study to compare between four variables. The variables that were investigated were the source of nitrates, the moisture content of the soil, the uptake by plants and the total carbon content of the soil. Fourth World Consumer Culture: Emerging Consumer Cultures In Remote Aboriginal Communities Of North-Western Australia, Ronald George Groves

Over the two centuries since the arrival of European settlers in Australia, the material culture and lifestyle of the indigenous Aboriginal people of Australia has undergone dramatic change. Based on qualitative fieldwork in three remote Aboriginal communities in north-western Australia, this study examines the emergence of unique consumer cultures that appear to differ significantly from mainstream Australia and indeed from other societies. The study finds that the impact of non-indigenous goods and external cultural values upon these communities has been significant. However, although anthropologists feared some fifty years ago that Aboriginal cultural values and traditions had been destroyed, this study …

A Life-Table-Response Experiment lasting 78 d was performed to investigate the toxic effects of sediment-associated 4-n-nonylphenol (NP) on growth, reproduction, and survivorship of isolated hermaphrodites of the infaunal polychaete Capitella sp. I. Demographic effects were evaluated using both a fully age-classified and a simple twostage model to estimate population growth rates (λ). Decomposition analysis was performed to explore the contributions of each of the affected life-history traits to the effects observed on l. Elasticity analysis was applied to examine the relative sensitivity of λ to changes in each of the different life-history traits under different exposure levels.

Mineta International Institute for Surface Transportation Policy Studies (IISTPS) at San José State University (SJSU) conducted this project to maintain and continue development of a transportation information system entitled TransWeb . The project elements included: 1) the maintenance and continued development of a World Wide Web site for IISTPS (TransWeb); 2) development and maintenance of a library resource database; and 3) a survey of transportation professionals, primarily in California, regarding their use of the Internet and TransWeb. Effect Of Maturity And Divalent Salts On Quality Of Low-Fat, Low-Sodium Restructured Beef., Sharon L. Pojedinec

Graduate Theses, Dissertations, and Problem Reports (ETD)

Manipulation of product formulation protocols and ingredients to optimize texture development and processing yields provides opportunity to produce high quality, low sodium, low-fat restructured beef. The objective of this experiment was to determine effect of preblending with MgCl2 and/or CaCl2 on functionality of A- and C-maturity, in low-sodium, low-fat restructured beef. Addition of CaCl2 decreased (p< 0.001) raw and cooked pH. For both maturities, raw products with CaCl2 had more soluble protein (p< 0.05) than products without CaCl2. C-maturity products contained more soluble myosin (p< 0.10) than A-maturity products. In C-maturity treatments, MgCl2 increased (p< 0.005) myosin solubility. Products with CaCl2 decreased (p< 0.01) actin solubility. In A-maturity products, MgCl2 had less (p< 0.05) soluble actin than treatments without MgCl2. In C-maturity products, MgCl2 contained more (p< 0.05) soluble actin than treatments without MgCl2. Addition of CaCl2 decreased (p< 0.005) cook yield and addition of MgCl2 increased (p< 0.005) cook yield. In C-maturity products, treatments without CaCl2 had a higher (p< 0.0005) peak force than treatments without CaCl2 in A maturity products. In A-maturity products, treatments without MgCl2 had lower (p< 0.005) peak force than the same treatment in C-maturity products and lower (p< 0.05) than MgCl2 containing treatments. C-maturity products were more cohesive (p< 0.08) than A-maturity. Addition of CaCl2 increased (p< 0.05) cohesiveness and added MgCl2 decreased (p< 0.05) cohesiveness. Addition of MgCl2 and CaCl2 and beef maturity affect protein-water interactions and texture development of low-sodium, low-fat restructured beef.

This thesis is an examination of the fictional works of J.M. Coetzee to date. By focusing my gaze upon either the lack of encounter or the encounters between the 'Self' and the 'Other', I explore the relationship between confrontation and the fluid formation and erosion of identity. This exploration takes place against a dual background: the history of the apartheid government in South Africa, the legacy of oppression and the post-apartheid opportunities and challenges; and Coetzee's own acknowledgement of complicity with the past and commitment to a reconciled future.
