This Comment focuses instead on the subtle reemergence of the private facts tort in factual scenarios Warren and Brandeis most likely could not foresee one hundred years ago. Part II of the Comment briefly describes the development of the private facts tort. Part III examines the inevitable conflict between the private facts tort and the First Amendment, and common law attempts to reconcile that conflict through variations of the "newsworthiness" defense. The Future Of Bioethics Testimony: Guidelines For Determining Qualifications, Reliability, And Helpfulness, Bethany Spielman, George Agich

This Article addresses key questions about expert bioethics testimony4 from within the framework of the basic rule concerning expert witnesses, Federal Rule of Evidence 702.' This Rule6 requires judges to affirmatively answer three basic questions before admitting expert testimony: (1) does this witness qualify as an expert by knowledge, skill, experience, training, or education; (2) does the testimony consist of scientific, technical or other specialized knowledge; and (3) will the testimony assist the trier of fact. Bioethics testimony presents distinctive problems in each area, on which commentators have not necessarily focused. Part II of this Article addresses the question of …

Container transport operations have been extending inland, providing more comprehensive service across the shipping network. Accordingly, container transport operators are making extensive capital investments in deploying inland container depot (ICD) networks. Optimizing the location of such facilities financially is vital for both capital and operating efficiencies. Currently, there are no models at the regional network level to guide container operators in locating ICDs on their networks. This research studies the ICD location problem and develops a comprehensive ICD location model. Recovering submerged histories is instrumental in counteracting colonial cultural hegemony and its persistent attempts to erase the past that subject peoples had prior to the epoch of colonial rule. In Toni Morrison's novels reclaiming the past is a necessary condition of subjectivity since it restores a voice and history to those who were deprived of the awareness of both. In other words, it is a restoration of subjectivity. In a postcolonial context, reclaiming the past means more than a linear or literal recording of historical facts. The Article suggests an approach courts should use when considering whether to abate a public nuisance within a home that is consistent with the goals and purposes of traditional public nuisance law as well as modern approaches to the regulation of individual rights and property. A central issue in environmental ethics is characterization of our “moral relationship” to future generations. What, if any, obligations do we owe to the future? How should our present actions be influenced by their impact on the future?

"Chevron," Cooperative Federalism, And Telecommunications Reform, Philip J. Weiser

In this Article, Professor Weiser argues that the advent of cooperative federalism statutes, like the Telecommunications Act of 1996, calls for a new conception of federal court review of state agency decisions. In particular, Professor Weiser suggests that federal statutes that invite state agencies to interpret federal law subject only to federal court review should be interpreted as calling for a deferential standard of review. Such a standard, to be sure, would allow cooperative federalism statutes to mean different things in different states. Missouri's bid for statehood reflected the struggle to extend the southern slave culture onto the western frontier of settlement. The Northwest Ordinance of 1787 and the Missouri Compromise set specific geographic boundaries for the extension of slavery, which in turn created distinctive patterns of migration and settlement on the frontier. The Platte Purchase region of northwest Missouri is one of the areas that reflect slavery's influence on settlement. This paper will discuss slave ownership, the need for slavery, and explain the geographic distribution of slaves in the Platte region.

The indigenous culture of Iceland--the Hidden People, Eve’s other children--struggles with an Irish monastery and its religion which asks its followers to change, a change with which not all of the Hidden People are comfortable. Expansion of the maxilla is used to correct skeletal and dental transverse discrepancies between the maxilla and mandible. These discrepancies are corrected through a combination of skeletal expansion (separation of the maxillary midpalatal suture) and dental expansion ( lateral tipping of the maxillary posterior teeth). A recently introduced temperature-activated, nickel titanium (NITI) palatal expander is claimed to produce a light, continuous force which is capable of expanding the maxilla and correcting molar rotations. There has been an increased interest in composting because of the benefits provided to both farmer and industry. These benefits include reductions in pesticides, water pollutants such as nitrogen in water runoff, volume reductions of manure and other waste products, a reduction in harmful pathogens, and cost reductions associated with normal disposal methods. Traditional silvicultural practices focus on manipulating forest vegetation structure for commodity production. Structural features important to wildlife, such as snags, trees with decay, and cavity trees are also affected by forest management, but these effects are often not quantified. This study measured the effects of different thinning intensities (45, 60, 75% residual relative densities, and uncut controls), heartwood decay resistance (resistant, slight), and time of formation (pre or post-treatment) on the density, basal area, and volume of snags and decayed wood in an Appalachian hardwood stand. This thesis examines the use of nature in the uneven development of Ohiopyle State Park, located sixty miles to the southeast of Pittsburgh, Pennsylvania. The production of this park resulted from a complex system of socio-spatial relationships that existed between Ohiopyle and Pittsburgh during the city's industrialization. The thesis has two objectives: (1) to demonstrate that the park is a space of produced nature, resulting from decades of human activity; and (2) to illustrate the various ways in which the production of this park is an extension of the production of the Pittsburgh industrial space. Occupational exposure to crystalline silica has been associated with lung damage and fibrosis. Although previous studies have demonstrated that silica induces apoptosis both in vitro and in vivo, its role in the pathogenesis of silicosis remains unknown. The purpose of the present study was to: 1) characterize silica-induced apoptosis in vitro; 2) establish a temporal relationship between silica exposure, the induction of apoptosis, and lung inflammation/damage; and 3) investigate the role of apoptosis in the differential susceptibilities of two mouse strains to silica. Muscle growth is regulated by the balance between the two opposing processes of protein synthesis and protein degradation. The calpain system consisting of two ubiquitous proteolytic enzymes m-calpain, µ-calpain and calpastatin (their endogenous inhibitor) is considered to be the major proteolytic system that catalyzes the initiation of myofibrillar protein degradation in muscle. Gene expression studies of the calpain system were carried out in male and female broiler skeletal muscle from breast (pectoralis), leg (semitendinosus) and wing (brachi) in chickens one week through six weeks of age. Eva Demski and Ika Hügel-Marshall are two contemporary women writers whose works contribute significantly to the Afro-German culture. Demski is a “white” German author who depicts in her novel the life of an Afro-German woman, Afra, as well as the life of her “white” daughter, Nivea. Hügel-Marshall, who was born in 1947 as the daughter of a German mother and an African-American father, depicts in her autobiography her own development from object to subject.
