A Government For Our Time? Business Improvement Districts And Urban Governance, Richard Briffault

The emergence and rapid spread of business improvement districts ("BIDs") is one of the most important recent developments in American cities. BIDs have been controversial, with both supporters and proponents viewing the districts as part of a trend toward the privatization of the public sector. By examining the legal and political structures that determine BID formation, functions, finances and governance, this Article determines that BIDs are not private entities but are, instead, a distinctive hybrid of public and private elements. Deterrence And Distribution In The Law Of Takings, Michael A. Heller, James E. Krier

Supreme Court decisions over the last three-quarters of a century have turned the words of the Takings Clause into a secret code that only a momentary majority of the Court is able to understand. The Justices faithfully moor their opinions to the particular terms of the Fifth Amendment, but only by stretching the text beyond recognition. A better approach is to consider the purposes of the Takings Clause, efficiency and justice, and go anew from there. Students place tens of thousands of posters around law schools each year – in staircases, on walls, and on bulletin boards. Rarely, however, do formal disputes about postering arise. Students know how far to go – and go no farther despite numerous avenues for postering deviance: blizzarding, megasigns, commercial or scurrilous signs. What is the history of poster law? What are its norms and rules, privileges and procedures? Is poster law effident? Is it just?

The Independent Counsel Act expires on June 30, 1999. Should it be extended? Extended with modifications? Radically reformed? Or should it be allowed to sunset with nothing put in its place? To answer these questions, we need to address some more fundamental questions: (1) Do we truly need an independent office to investigate alleged wrongdoing by high-ranking officers of the executive branch? (2) If so, what are the options for the organizational structure of such an office? (3) By what criteria should the different institutional options be evaluated? The Private Law Of Race And Sex: An Antebellum Perspective, Adrienne D. Davis

In this article, Professor Adrienne D. Davis traces the interaction of race, sex, and estate law in the antebellum and postbellum South. Through a close analysis of intestate succession and testamentary transfers involving the formerly enslaved, she unearths the role of private law in reconciling and preserving both property rights and racial hierarchy. The article centers on a series of historical case studies involving the rights of formerly enslaved women and their children to postmortem transfers of wealth. While the law of private property generally served to reinforce racial hierarchy, these cases involved the use of property rights -- specifically, …

In the Ecuadorian society there is a pronounced difference in the distribution of work between men and women. In the Ecuadorian society the man is dominant and the woman is seen as a free form of strenuous and excessive labor, who often goes without pay. The woman herself minimizes her own contribution in the production process, thereby magnifying this culture distinction. The division of work related responsibilities, through gender distinctions, has given women more tasks to complete, in addition to those generally reserved for females (taking care of the children, the animals and various household chores). The Behavior Of Preweanling Pups Exposed To Valproate In-Utero, Wayne Briner

Transactions of the Nebraska Academy of Sciences and Affiliated Societies

Valproate is a known human and animal teratogen that produces neural-tube defects. Valproate is also known to produce fetal death and a variety of fetal deformities. The present study considered the role of val pro ate as a behavioral teratogen in rats. Pregnant rats were administered saline or valproate, or simply handled at 10 days gestation and the offspring tested for a variety of behaviors and physical measures. Valproate-exposed animals demonstrated lags in the emergence of swimming behavior, negative geotaxis and weight gain. This evidence points to val pro ate being a behavioral teratogen producing delays in neuromuscular development.

Microhabitat Preferences Of Bullfrog Tadpoles (Rana Catesbeiana) Of Different Ages, Geoffrey R. Smith

Transactions of the Nebraska Academy of Sciences and Affiliated Societies

I experimentally investigated the habitat use preferences of bullfrog (Rana catesbeiana) tadpoles of different ages (early, first-year vs. late, second-year, premetamorphic) in the laboratory. Early tadpoles showed a preference for non-vegetated areas, whereas late tadpoles showed no preference. Early tadpoles were seen more often over small, gravel substrate as opposed to large rocks, whereas late tadpoles showed no preference. Early tadpoles preferred medium depths, whereas later tadpoles preferred deeper water. Thus, it appears there may be habitat preferences in bullfrog tadpoles, and that these preferences may change over time.
