Still Adjusting To Markman: A Prescription For The Timing Of Claim Construction Hearings, William F. Lee, Anita K. Krug

This Article argues that, in most cases, there is an optimal time for holding the Markman hearing.

Part II provides a short summary of both the Federal Circuit's holding in Markman and the rationale behind the Supreme Court's affirmance of that holding. It then delves into the predictable effects of Markman, as well as into the maze of questions that the decision has engendered and the ways in which the district courts have answered those questions.

Part III discusses the issue of the timing of claim construction hearings, presenting at the outset the possible alternatives. It argues that holding …

My creative thesis consists of four short stories and my author's introduction to them.

In my introduction, I discuss my primary literary influences; not only the author's whose approaches to short fiction that I share, but also those I feel indifferent towards. Sherwood Anderson's Winesburg, Ohio is admirable for its sketches of common people and ordinary life events. James Joyce is highlighted as the originator of literary epiphany, a moment of revelation or profound insight, and both A Portrait of the Artist as a Young Man and Dubliners provide examples of the device. Interpersonal Solidarity In Relationships: A Cultural Analysis Of Lawyers Vs. Sports Agents, Andrea L. Cairns

The cultural affects on relationship solidarity and satisfaction in relationships between lawyers and their clients, and sports agents and their professional athlete clients was examined. The results were gathered through a process of correlation tests and frequency report tables. All four groups of subjects were asked to complete a twenty questions survey which contained variables such as interpersonal solidarity, relational satisfaction, and communicative patterns of interaction. The results indicated that the two types of relationships are adversely co-dependent with respect to self-disclosure and it's relationship to interpersonal solidarity within a client-agent relationship.

Alarm Calls Affect Foraging Behavior In Eastern Chipmunks (Tamias Striatus), Jessica K. Baack

I used playback experiments to test whether alarm calls affected the foraging behavior of Eastern chipmunks (Tamias striatus). I subjected chipmunks, foraging at artificial feeding stations, to three playback treatments (silent, control noise, and alarm call) and examined changes in vigilant and foraging behavior. Chipmunks responded to alarm calls with a greater degree and duration of vigilant behavior, such as look-ups and alert postures. Chipmunks also ran a shorter distance to cover, ran more directly to cover, and took longer to re-emerge from the burrow after hearing an alarm call. Service-Learning For Preservice Teachers: Ethical Dilemmas For Practice, David M. Donahue

Service Learning, General

Increasingly in the United States, service-learning is being used to educate preservice teachers. Service varies greatly in its ethical foundation, however, and service-learning presents new teachers with a variety of dilemmas revealing the moral and political nature of teaching and service. This article presents one case of four preservice teachers writing curriculum as a service to a community agency hoping to promote service geared toward social justice among high school students. The case highlights ethical dilemmas faced by teachers in the process and illustrates the potential of service-learning to educate teachers for the moral imperative of their profession.

Insect Limitation Of Weedy Plants And Its Ecological Implications, Svata M. Louda

The ecological consequences of releasing a genetically modified organism into a novel environment will depend upon its establishment, dispersal, and interactions with other organisms. Establishment and dispersal in the population dynamics of weedy plants are discussed by Jordan (these proceedings). My task is to discuss the known effects of plant-feeding insects on populations of native weedy plants, which provide the best current predictive basis for assessing the potential ecological consequences of the movement of resistance genes from genetically modified crops into their native weedy relatives.

Parasitization Of Callinectes Rathbunae And Callinectes Sapidus By The Rhizocephalan Barnacle Loxothylacus Texanus In Alvarado Lagoon, Veracruz, Mexico, Fernando Alvarez, Adolfo Gracia, Rafael Robles, Jorge Calderon

Gulf and Caribbean Research

Callinectes rathbunae and CalIinectes sapidus in Alvarado Lagoon, Mexico, were sampled monthly for one year to determine the extent of parasitization by the rhizocephalan cirripede Loxothylacus texanus. Prevalence levels. host sex ratio, carapace width-weight variation, and distribution of the number of parasites among hosts were analyzed. Loxothylacus texanus was present almost exclusively in C. rathbunae with a mean prevalence of 7.58%, while less than 1% of all C. sapidus were parasitized. Callinectes rathbunae constitutes a new host record for this parasite. A study of infection revealed significant variation in prevalence and host size throughout the study period. The sex …
