Colonialism And Modern Constructions Of Race: A Preliminary Inquiry, Tayyab Mahmud

This article aims at an examination of the colonial career of the modern construction of race and its traces in post-coloniality. It locates race in regimes of legality and illegality attendant to British colonial rule over India to underscore the defining role of colonialism in modern constructions of race. The first part recounts the modern grammar of racial difference rooted in the colonial encounter between modern Europe and its colonies. The second part identifies three specific sites of deployment of colonial racial stereotypes in colonial India, namely, "martial races," "criminal tribes," and indentured labor. The purpose of this paper is to research what the gaming industry pays in taxes to the local and state governments, and if the gaming industry pays a proportionate share of taxes compared to the other sources of tax revenue generated from other non-gaming businesses in the State of Nevada. The contemporary debate about race in the United States is perplexing. Each side seems genuinely to feel distressed at the demands being made by the other. Racial minorities point to Dred Scott's insistence on racial castes, Plessy's endorsement of official segregation, and Brown's reluctance to remedy unlawful discrimination as evidence that the white majority is inevitably inclined to advance its own interests at minority expense. Minority group members, therefore, tend to argue that the only way to arrest this majoritarian inclination is through the use of race-conscious remedial programs that will ensure an equitable distribution of resources. In this chapter, the challenges of protected area planning are explored by addressing the latter question. The chapter focuses on maintaining protected area values in face of increasing recreational pressure, although these general concepts and principles can be applied to other "threats" as well (Machlis and Tichnell 1985). First, the social and political contexts within which such planning occurs are outlined. It is to these complex contexts that an interactive, collaborative-learning based planning process would seem most appropriate. A software review procedure developed by the authors is described. The procedure centers around a form that extends the functionality of traditional software evaluation forms by enhancing the use of the computer software in the early childhood classroom. The form encourages teachers to discover ways a piece of software can be integrated across disciplines and used as an anchor for instruction. Users of the review form are also encouraged to examine ways the software motivates the user to remain engaged in its use. After years of struggle, we now know that the only way to make respect for the rights of crime victims "incorporated with the national sentiment" is to make these rights a part of the sovereign instrument of the whole people, the Constitution. The movement for constitutional rights for crime victims, properly understood, constitutes neither an attack on the rights of defendants, nor on the power of public prosecutors, but rather is a movement to save these two good and perfect things in the American justice system by tempering their excessive virtue with true balance. The Unnecessary Victims' Rights Amendment, Robert P. Mosteller

The principal purpose of this essay is to examine the major justifications advanced by supporters of the proposed Victims' Rights Amendment (the "Amendment") that they contend require victims' rights to be protected through the unique form of a constitutional amendment. I begin with what should be an uncontroversial proposition: proponents of an amendment to the United States Constitution bear a heavy burden of persuasion and must be able to justify enactment of the amendment on substantive grounds. I conclude that the Amendment is unnecessary, and therefore its proponents simply have not made their case.

One false view of separation is the view that religious ideas must not serve as rationales for public policy. This view, called the "principle of secular rationale," is put forward as a means of protecting the public sphere be supported on the basis of accessible public reasons. But in fact, it rests on inaccurate stereotypes and questionable epistemological premises, and it would disenfranchise religious persons as full participating members of the political community. In confronting the issues raised by the current judicial assessments of VAWA, this Note has attempted to synthesize a workable Commerce Clause test from previous Commerce Clause jurisprudence, a test faithful to principles of federalism and one that courts may use to assess the constitutionality of statutes that regulate non-economic, intrastate activities. Ultimately, commerce power questions are largely political in nature and any attempt to fashion justiciably manageable standards of review of Commerce Clause questions must recognize and respond to this fact. Studies were undertaken to investigate the suitability of several molecular and physiological responses as biomarkers of UV-B exposure in several marine macroalgal species. Investigations into the sensitivity of mature plants and the reproductive unicells were also carried out. Furthermore, experiments were conducted to determine the interaction between UV-B radiation and the antifouling compound Irgarol 1051 in both a fouling alga and two non-target algal species. Chlorophyll fluorescence, in vivo thallus absorptance and ion leakage were investigated for their suitability as physiological biomarkers of UV -B exposure in the intertidal alga Enteromorpha intestinalis and the subtidal alga Palmaria palmata. Dietary factors are one of the most significant considerations in the regulation of appetite in fish since dietary nutrient and energy concentration modulate feed intake in the short and longer term. These interactions may also be important from a commercial aspect, since the objective of aquaculture is to obtain maximum growth, feed efficiency and consumer acceptance of the product. This study addresses the issue of phonemic awareness instruction and its effects on reading. Benefits of reading programs that encompass phonemic awareness training and problems with approaches that do not encompass phonemic awareness were discussed as well as benefits and problems associated with both direct phonemic awareness instruction and indirect phonemic awareness instruction. An action research study using Scholastic Phonemic Awareness Kit was conducted and conclusions were drawn from the study and from the literature. This instructional development project integrated the language arts and the science areas. The science content was ponds and water from the second grade curriculum. A rich learning environment was provided through a literature base, representing the different genres and related expressive activity.
