Embracing Descent: The Bankruptcy Of A Business Paradigm For Conceptualizing And Regulating The Legal Profession, Jeffrey W. Stempel Jan 1999

Embracing Descent: The Bankruptcy Of A Business Paradigm For Conceptualizing And Regulating The Legal Profession, Jeffrey W. Stempel

Scholarly Works

Lawyers are said to travel in packs, or at least pairs, and in the popular parlance are often compared to hoards of locusts, herds of cattle, or unruly mobs. However, at least for purposes of assessing concerns with professionalism currently surrounding the bar and the public, whether attorneys are more or less social than other human animals does not matter. My point is simply that lawyers are social beings; like other human beings in social and occupational groups, lawyers behave largely in accordance with group norms, in much the same way peer pressure led Julian English toward juvenile delinquency in …

Modeling And Simulating Chemical Weapon Dispersal Patterns In Dirsig, Peter Arnold Jan 1999

Modeling And Simulating Chemical Weapon Dispersal Patterns In Dirsig, Peter Arnold

Theses

Fieldable thermal infrared hyperspectral imaging spectrometers have made it possible to design and construct new instruments for better detection of battlefield hazards such as chemical weapon clouds. The availability of spectroscopic measurements of these clouds can be used not only for the detection and identification of specific chemical agents but also to potentially quantify the lethality of the cloud. The simulation of chemical weapon dispersal patterns in a synthetic imaging environment offers significant benefits to sensor designers. Such an environment allows designers to easily develop trade spaces to test detection and quantification algorithms without the need for expensive and dangerous …

Colonialism And Modern Constructions Of Race: A Preliminary Inquiry, Tayyab Mahmud Jan 1999

Colonialism And Modern Constructions Of Race: A Preliminary Inquiry, Tayyab Mahmud

Faculty Articles

This article aims at an examination of the colonial career of the modern construction of race and its traces in post-coloniality. It locates race in regimes of legality and illegality attendant to British colonial rule over India to underscore the defining role of colonialism in modern constructions of race. The first part recounts the modern grammar of racial difference rooted in the colonial encounter between modern Europe and its colonies. The second part identifies three specific sites of deployment of colonial racial stereotypes in colonial India, namely, "martial races," "criminal tribes," and indentured labor. The last part traces the shadow …

What Does The Gaming Industry Pay In Taxes, And Does The Gaming Industry Pay A Proportionate Share?, Jewelene Nelson Jan 1999

What Does The Gaming Industry Pay In Taxes, And Does The Gaming Industry Pay A Proportionate Share?, Jewelene Nelson

UNLV Theses, Dissertations, Professional Papers, and Capstones

The purpose of this paper is to research what the gaming industry pays in taxes to the local and state governments, and if the gaming industry pays a proportionate share of taxes compared to the other sources of tax revenue generated from other non-gaming businesses in the State of Nevada. The scope of the paper is limited to the State of Nevada, and more specifically, Clark County. The sources used were personal observations, as well as published literature. In conclusion, the research will show that not only does the gaming industry pay a proportionate share of taxes to the local …

Affirmative Action And Discrimination, Girardeau A. Spann Jan 1999

Affirmative Action And Discrimination, Girardeau A. Spann

Georgetown Law Faculty Publications and Other Works

The contemporary debate about race in the United States is perplexing. Each side seems genuinely to feel distressed at the demands being made by the other. Racial minorities point to Dred Scott's insistence on racial castes, Plessy's endorsement of official segregation, and Brown's reluctance to remedy unlawful discrimination as evidence that the white majority is inevitably inclined to advance its own interests at minority expense. Minority group members, therefore, tend to argue that the only way to arrest this majoritarian inclination is through the use of race-conscious remedial programs that will ensure an equitable distribution of resources. Most members of …

Protected Area Planning Principles And Strategies, William T. Borrie, Stephen Mccool, George H. Stankey Jan 1999

Protected Area Planning Principles And Strategies, William T. Borrie, Stephen Mccool, George H. Stankey

Society and Conservation Faculty Publications

In this chapter, the challenges of protected area planning are explored by addressing the latter question. The chapter focuses on maintaining protected area values in face of increasing recreational pressure, although these general concepts and principles can be applied to other "threats" as well (Machlis and Tichnell 1985). First, the social and political contexts within which such planning occurs are outlined. It is to these complex contexts that an interactive, collaborative-learning based planning process would seem most appropriate. Next, an overview of eleven principles of visitor management is presented. These principles must be acknowledged and incorporated in any protected area …

Reviewing Software As A Means Of Enhancing Instruction, Marcus D. Childress, Guang-Lea Lee, Gregory P. Sherman Jan 1999

Reviewing Software As A Means Of Enhancing Instruction, Marcus D. Childress, Guang-Lea Lee, Gregory P. Sherman

Teaching & Learning Faculty Publications

A software review procedure developed by the authors is described. The procedure centers around a form that extends the functionality of traditional software evaluation forms by enhancing the use of the computer software in the early childhood classroom. The form encourages teachers to discover ways a piece of software can be integrated across disciplines and used as an anchor for instruction. Users of the review form are also encouraged to examine ways the software motivates the user to remain engaged in its use. The majority of the review form emphasizes the important role of the teacher in identifying outcomes or …

Toward Comprehensive Watershed- Based Restoration And Protection For Great Salt Lake, Robert W. Adler Jan 1999

Toward Comprehensive Watershed- Based Restoration And Protection For Great Salt Lake, Robert W. Adler

Utah Law Review

Unbeknownst to many Utahns, Great Salt Lake is one of the globe's great ecosystems. While some believe that it is virtually devoid of life, in fact it supports immense populations of an impressive diversity of species. Aggregations of waterfowl, shorebirds, and colonial water birds during its spring and fall migrations and its summer staging seasons are among the great wildlife spectacles to be seen anywhere around the world. Because of its extreme conditions, its large periodic fluctuations in size and salinity, and the relatively small diversity at the very base of its food web, however, the ecosystem on which this …

The Crime Victims' Rights Amendment And Two Good And Perfect Things, Steven J. Twist Jan 1999

The Crime Victims' Rights Amendment And Two Good And Perfect Things, Steven J. Twist

Utah Law Review

After years of struggle, we now know that the only way to make respect for the rights of crime victims "incorporated with the national sentiment" is to make these rights a part of the sovereign instrument of the whole people, the Constitution. The movement for constitutional rights for crime victims, properly understood, constitutes neither an attack on the rights of defendants, nor on the power of public prosecutors, but rather is a movement to save these two good and perfect things in the American justice system by tempering their excessive virtue with true balance. Indeed, this Amendment just might save …
