Mr. Justice Holmes's Constitutionally Crooked Path Part Ii: The State Sovereignty Jurisdictional Stopgap , Mitchell B. Weiss

Cleveland State Law Review

This article analyzes the last turn in Justice Holmes's constitutionally crooked path, largely by penetrating to the very core of the Supreme Court's recent decision in Alden v. Maine. Part I therefore traces the Court's waffling attitude towards the division of regulatory power between the state and federal governments. Then, against this backdrop, Part II takes the jurisdictional turn by analyzing the Court's most recent attempt to resuscitate the Tenth Amendment's check on Congress's Commerce Power. To sharpen the focus, much of this article will focus on the Fair Labor Standards Act, a federal statute that always seems to sit …

Chief Justice William Rehnquist analyzed the evolution of Supreme Court advocacy. The discussion begins with the initial preference for oral arguments and the influence of nineteenth century Supreme Court advocate Daniel Webster. Originally conceived and funded as a research project, the Internet has grown into a commercial, global and integrated service network. This has changed the nature of traffic on the Internet with the increasing use of things like video conferencing and time critical transactions. These forms of Internet usage place high demands on bandwidth. Added to this is the fact that the number of users is increasing at a dramatic rate and shows no signs of slowing. Swingers: Morality Legislation And The Limits Of State Police Power, Raymond Ku

St. Thomas Law Review

This article examines whether Florida can legitimately convict the swingers pursuant to the Florida Constitution specifically, and principles of constitutional law in general, and concludes that it cannot. In so doing, this article does not attempt to define privacy or to provide a taxonomy of activities that fall within its reach, which has been done quite thoroughly by others. The swingers' conduct clearly falls within what scholars have characterized as the right to sexual autonomy, personhood and freedom of association. Interdisciplinary mathematics and science courses are increasing in popularity. Faculty teaching these courses are given the opportunity to show how mathematics plays an important role in science and how it can be used to improve our understanding of mathematics and science. This paper discusses a new course in mathematical modeling that focuses on environmental issues. Course content and format are presented, as well as the results of a study on the changes in students’ perceptions of their mathematical abilities as a result of taking this new course.

As the computers available in schools become more powerful, more and more exciting tools are available to science and math students and teachers. Visualization tools, such as image processing, geographic information systems, modeling, and simulation software, are a class of tools with particular promise. These tools are being used in schools across the country to integrate computer use with the curriculum and to bring more hands-on inquiry to the students. The past three or more Congresses have seen substantial efforts to enact "risk reform" legislation that would require environmental, health, and safety regulations to be adopted following the performance of risk assessments modeled on quantitative risk assessment methods for carcinogens. While such a requirement has potentially beneficial effects on the quality of the resulting rules, there is also a substantial potential for mischief by reorienting substantive environmental, health, and safety regulation, and by introducing substantial new costs and delays into the regulatory process. This article discusses the lessons contained in States v. Singleton and the system that has been adopted for investigating and prosecuting high executive officers. After describing Singleton and the tumult it triggered in Part I of this Article, Part II returns to the Starr Referral and poses a question that may at first seem idle: what distinguishes Starr's promises to Lewinsky in exchange for her testimony from the efforts he charges the President made to help find her a job? This Essay takes on the challenge of describing some of the ways in which values often defined as "personal" or "religious" can be integrated into the practice of law at a large firm. Part I describes some of the aspects of big firm practice that make it particularly difficult to integrate religious and personal values which may give meaning to one's work. The recent growth of the Internet and the World Wide Web (WWW) has resulted in a vast array of on-line courseware and educational Web sites. Unfortunately, as a large percentage of this information is written in English, non-English speakers are unable to access it. Information written in other languages is likewise unavailable to many native English speakers. Therefore, in order to maximize the usefulness of educational material on the Web, it is necessary to design and implement cross-cultural, bilingual or multilingual Web sites and instructional programs.

In the United States, legislative responses to cloning among both federal and state lawmakers have been rapid and widespread. The Report of the NBAC to President Clinton proposed that Congress prohibit human cloning for a period of years. In the following year, Congress entertained a variety of bills proposing to ban or regulate human cloning. Some proposed prohibiting human cloning. Others proposed allowing such cloning for research purposes. Similarly, soon after Dolly's birth, state legislators presented a large number of bills aimed at regulating or prohibiting human cloning."
