The New Federalism And The Ada: State Sovereign Immunity From Private Damage Suits After Boerne, Roger C. Hartley

State sanctioned disability-based discrimination comes in two basic flavors: prejudice and thoughtlessness. The former takes disability into consideration, while the latter ignores it. The Fourteenth Amendment's Equal Protection Clause prohibits the prejudice but not the thoughtlessness, at least when the latter is unassociated with irrational assumptions based on myths, fears and stereotypes. Unlike most other civil rights statutes, the Americans With Disabilities Act (hereinafter "ADA" or "Act") prohibits both prejudice and thoughtlessness and aptly has been characterized as a "second-generation civil rights statute."

The International Legal Implications Of "Non-Lethal" Weapons, David P. Fidler

Michigan Journal of International Law

In this Article, the author attempts a comprehensive international legal analysis of "non-lethal" weapons to raise awareness about how many international legal issues they create and about the complexity of analyzing the international legality of the development and use of these weapons. In short, the emergence of "non-lethal" weapons does not rescue international law from its crisis in connection with controlling war. Indeed, in some respects, the coming of "non-lethal" weapons threatens to deepen that crisis in new and disturbing ways.

Towards A Market Economy: Security Devices For China, Guanghua Yu

From 1949 to 1978, China's economy was centrally directed under a very rigid system of state planning. Under the planning system, security devices were not widely used. The government drew specific plans for enterprises and the Ministry of Finance used banks to allocate the funds to enterprises or projects. The banks, however, did not have to screen projects and monitor the use of funds after disbursements. They merely distributed the money to enterprises and collected the profits. Mr. Goldman discusses many important issues that need to be considered when deciding to participate in and when drafting co-branding agreements, but which are often overlooked. As internet co-branding has become ubiquitous as a means of combining one website's functionality and another's marketing muscle in online business, practitioners handling co-branding agreements face the challenge of choosing the correct legal paradigms as starting points in these kinds of negotiations. Co-branding agreements often incorporate advertising, trademark licensing, service provisions and domain name components. Las Vegas has art galleries, an art museum, a Cultural and Community Affairs Division. It also supports the Allied Arts Council of Southern Nevada and a southern branch of the Nevada Arts Council. Clearly, art and art advocates are present in Las Vegas.
