Establishing New Legal Doctrine In Managed Care: A Model Of Judicial Response To Industrial Change, Peter D. Jacobson, Scott D. Pomfret

Courts are struggling with how to develop legal doctrine in challenges to the new managed care environment. In this Article, we examine how courts have responded in the past to new industries or radical transformations of existing industries. We analyze two historical antecedents, the emergence of railroads in the nineteenth century and mass production in the twentieth century, to explore how courts might react to the current transformation of the health care industry.
In doing so, we offer a model of how courts confront issues of developing legal doctrine, especially regarding liability, associated with nascent or dramatically transformed industries. Our …

Moving Toward A Clearer Definition Of Insider Trading: Why Adoption Of The Possession Standard Protects Investors, Lacey S. Calhoun

In recent years, insider trading has become a publicized focus of securities law enforcement. The definition of insider trading has emerged slowly through case law, and the term has been clarified by new theories of liability. The use and possession tests are two standards of liability used to judge the treatment of inside information. The use standard offers a defense to insider trading liability while the possession standard premises liability on mere possession of inside information. Dnak And The Heat Stress Response Of Pseudomonas Syringae Pv. Glycinea, Lisa M. W. Keith, James E. Partridge, Carol L. Bender

The dnaK gene from Pseudomonas syringae pv. glycinea PG4180 was cloned and sequenced. The dnaK coding region was 1,917 bp and contained a putative O32 heat shock promoter 86 bp upstream of the translational start site. grpE, another heat shock gene, was found immediately upstream of the putative dnaK promoter. The predicted amino acid sequence of dnaK showed relatedness to the ATPase and substrate binding domains commonly found in heat shock proteins, as well as the highly conserved signature sequence motifs belonging to the Hsp70 protein family. Furthermore, the PG4180 dnaK gene complemented an Escherichia coli dnaK mutant …

The Ord River Irrigation Area (ORIA) in the Kimberley Province of Western Australia is the product of a bold and imaginative plan to develop part of the nation's tropical north for intensive agriculture by harnessing the waters of the Ord River. The principal features of the scheme are:
* A major storage reservoir formed by a dam constructed where the Ord River enters the Carr-Boyd Ranges, 160 kilometres south-east of Wyndham.

There are a number of 3D graphics accelerator architectures on the market today. One of the largest issues concerning the design of a 3D accelerator is that of affordability for the home user while still delivering good performance. Three such architectures were analyzed: the Heresy architecture defined by Chiueh [2], the Talisman architecture defined by Torborg [7], and the Tayra architecture's specification by White [9]. Law and Contemporary Problems
Fort and Noone relate business ethics to notions of transcendence found in nature and anthropology. They address the notion of contracts within corporate legal theory because contracts are used as a model both by those who advocate minimalist, agency business duties and by others who propound a broad business ethic.

Manure or compost from beef cattle feedlots can be an excellent sources of nutrients and organic matter when added to soils, but they can also pollute runoff. We determined the effects of simulated rainfall on runoff losses of P and N, and EC and pH following application of manure and compost to a Sharpsburg silty clay loam (fine smectitic, mesic Typic Argiudoll) soil having grain sorghum [Sorghum bicolor (L.) Moench] and winter wheat (Triticum aestivum L.) residues. Manure, compost, and fertilizer were applied to no-till fields at rates required to meet N or P requirements for corn ( …

In its current distribution and abundance, the swift fox (Vulpes velox) has been significantly reduced from its historic range. A possible cause is competition with, and predation by, coyotes (Canis latrans). We investigated the level of spatial, temporal, and dietary resource use overlap between swift foxes and coyotes at the Pinon Canyon Maneuver Site in southeastern Colorado. We captured and radio-tracked 73 foxes and 24 coyotes from April 1997 to August 1998. We collected 10 832 and 5350 locations of foxes and coyotes, respectively. Cambium-feeding behavior by black bears (Ursus americanus), or bear damage, is a major reforestation problem in the Pacific Northwest. Historically, studies have measured the cumulative effects of damage over time, but few have viewed damage in the frame of one season. Bear damage occurring in 1996 was surveyed in areas of radio-marked bears in western Washington. Fresh damage occurred on 48% of bear location plots (n = 96). Douglas-fir (Pseudotsuga menziesii) (69%), western hemlock (Tsuga heterophylla) (19%), and Pacific silverfir (Abies amabilis) (10%) with a mean dbh of 25.1, 29.5, and 30.7cm, …

Cullin-3 Targets Cyclin E For Ubiquitination And Controls S Phase In Mammalian Cells, Jeffrey D. Singer, Mark Gurian-West, Bruce Clurman, James M. Roberts

Cyclin E is an unstable protein that is degraded in a ubiquitin- and proteasome- dependent pathway. Two factors stimulate cyclin E ubiquitination in vivo: when it is free of its CDK partner, and when it is phosphorylated on threonine 380. We pursued the first of these pathways by using a two-hybrid screen to identify proteins that could bind only to free cyclin E. This resulted in the isolation of human Cul-3, a member of the cullin family of E3 ubiquitin–protein ligases. We found that Cul-3 was bound to cyclin E but not to cyclin E-Cdk2 complexes in mammalian cells, and …

Jewish Exile And Immigration: Re-Imagining Home On The North Dakota Prairie, Jason Zevenbergen

From the memoirs of several Jewish homesteaders in North Dakota, one observes a series of binaries between Diaspora and homeland and between Jewish Orthodoxy and more liberal forms of Jewishness. The writers of these memoirs generally produce these binaries through two methods. First, the content they introduce in their stories reflects opposing categories of Jewishness, such as Orthodox and Reform Judaism, that significantly frame the nature of their relationships to their families, local community, and country. Second, when the writers transfer stories from their past into the contemporary moment, they juxtapose a previous self with their present self at the …

1-Butaneboronic Acid Binding To Aeromonas Proteolytica Aminopeptidase: A Case Of Arrested Development, Carin C. De Paola, Brian Bennett, Richard C. Holz, Dagmar Ringe, Gregory A. Petsko

Hydrolases containing two metal ions connected by a bridging ligand catalyze reactions important in carcinogensis, tissue repair, post-translational modification, control and regulation of biochemical pathways, and protein degradation. The aminopeptidase from Aeromonas proteolytica serves as a paradigm for the study of such bridged bimetallic proteases since its three-dimensional structure is known to very high resolution and its catalytic reaction is amenable to spectroscopic examination. Herein, we report the X-ray crystal structure at 1.9 Å resolution of AAP complexed with 1-butaneboronic acid (BuBA). The sudden, rapid, and widespread increase in the number of specialized law reviews has attracted relatively little scholarly attention even though it is the most significant development in legal academic publishing in the second half of the twentieth century. As a consequence, there is a dearth of information about the proliferation, significance, and status of specialized reviews. In this Article, we attempt to fill this information gap by documenting the rise of the specialized review and by providing an empirical ranking of the top 100 specialized reviews.
