The Causes And Consequences Of Migration: The Case Of Chinese Women, Janet L. Warren Oct 1998

The Causes And Consequences Of Migration: The Case Of Chinese Women, Janet L. Warren

Sociology & Criminal Justice Theses & Dissertations

The purpose of this research is to determine the causes and consequences of migration. Specifically, it focuses on Chinese women. Using 1988 survey data collected from Chinese respondents in Hubei, a province located in central China, questions about migration status, reasons for migration and contraceptive use were utilized. Analyses reveal that Chinese females migrate for non-economic reasons. This study also revealed that migrants want fewer children than non-migrants, migrants use contraceptives more than non-migrants, and migrants use different methods of contraception than non-migrants. This research also suggests that age, education, and parity makes a difference in the respondents' want for …

Sleepiness and driving are a dangerous combination that causes thousands of crashes each year resulting in injury and death. This problem not only jeopardizes the safety of the driver but passengers and other drivers as well. This study investigated driving performance and neurophysiological correlates of sleepiness during driving simulation in obstructive sleep apnea patients. The study included 15 obstructive sleep apnea patients and 15 normal subjects as a control group. After a practice drive through city conditions, participants completed a 60 minute driving simulation task designed to replicate a highway driving scenario. Driving performance and EEG data were continuously sampled …

Investigating The Effects Of Subtle Ratee Characteristics In Team Performance Appraisal: The Influence Of Personality And Cohesiveness, Jonathan Quinn Schroeder Oct 1998

Investigating The Effects Of Subtle Ratee Characteristics In Team Performance Appraisal: The Influence Of Personality And Cohesiveness, Jonathan Quinn Schroeder

Psychology Theses & Dissertations

This study extends the research into systematic bias in performance appraisal to include subtle (i.e., not overtly demographic) ratee characteristics. Specifically examined were the biasing effects of personality and group cohesiveness on performance ratings. It was hypothesized that raters' personality inferences regarding ratees' levels of agreeableness and conscientiousness would correlate with bias in performance ratings. Interpersonal group cohesiveness was also hypothesized to affect rating accuracy. Research participants (n = 90) rated the performance of two videotaped leaderless group discussions. Personality inferences correlated strongly with leniency in performance ratings. In addition, significant differences in accuracy were found between the more and …

The Rhetoric Of Neutrality And The Philosophers’ Brief: A Critique Of The Amicus Brief Of Six Moral Philosophers In Washington V. Glucksberg And Vacco V. Quill, Richard Church Oct 1998

The Rhetoric Of Neutrality And The Philosophers’ Brief: A Critique Of The Amicus Brief Of Six Moral Philosophers In Washington V. Glucksberg And Vacco V. Quill, Richard Church

Law and Contemporary Problems

Church discusses the amicus brief to the US Supreme Court in the companion assisted suicide cases of "Washington v. Glucksberg" and "Vacco v. Quill," in which six philosophers offer their views. The philosophers' charge--that prohibiting physician-assisted suicide can only be based on impermissible sectarian religious or ethical premises--can be raised against their "neutral" liberal argument itself.

Would Adr Have Saved Romeo And Juliet?, Pam Marshall Oct 1998

Would Adr Have Saved Romeo And Juliet?, Pam Marshall

Osgoode Hall Law Journal

Like many disputes, Romeo and Juliet is a story with no winners; the outcome is destined to be lose-lose. Disputes are an inevitable part of human interaction and people need to learn effective and reasonable ways of dealing with their disputes. The question is how can this be done in a way that leaves people intact. The article compares and contrasts two modes for resolving disputes: adjudication and alternative dispute resolution (ADR). The article looks at what happens when disputes arise-how do problems become "disputes" and what do people do about them? The role of lawyers as dispute creators as …

Why Arbitrate?: Ontario's Recent Experience With Commercial Arbitration, Randy A. Pepper Oct 1998

Why Arbitrate?: Ontario's Recent Experience With Commercial Arbitration, Randy A. Pepper

Osgoode Hall Law Journal

In 1988, Ontario adopted the International Commercial Arbitration Act and in January 1992 the Arbitration Act, 1991 came into force for domestic arbitrations. These statutes and similar legislation in other provinces pushed Canadian arbitration regimes into the forefront of industrial nations. However, there has not been a significant increase in the number of commercial arbitrations being conducted in Ontario. This article suggests that Ontario is ideally placed to become an important centre for domestic and international arbitration. The author asserts that if commercial parties and their counsel were more familiar with the benefits of the arbitral process and with the …

What Juries Can't Do Well: The Jury's Performance As A Risk Manager, W. Kip Viscusi, Reid Hastie Oct 1998

What Juries Can't Do Well: The Jury's Performance As A Risk Manager, W. Kip Viscusi, Reid Hastie

Vanderbilt Law School Faculty Publications

Can juries handle complex cases? One way to frame this question in behavioral science terms is to ask: What tasks can juries perform well and what tasks will they perform poorly? Our basic precept is that the legal system should ask juries to perform tasks that they are good at performing and should not require juries to carry out tasks that they cannot perform well. A second guiding theme in our approach to the issue of jury competency is that the most relevant, most useful analyses of jury performance are based on empirical observations and data, not on rational analyses …

Psychiatric Evidence In Criminal Trials: To Junk Or Not To Junk?, Christopher Slobogin Oct 1998

Psychiatric Evidence In Criminal Trials: To Junk Or Not To Junk?, Christopher Slobogin

Vanderbilt Law School Faculty Publications

This Article begins, in Part I, with a brief review of the past four decades" of psychiatric and psychological testimony in criminal trials (henceforth referred to simply as "psychiatric testimony"). Although this review cannot be called comprehensive, it does make clear that, contrary to what the popular literature would have us believe, psychiatric innovation is neither at an all time high nor the prevalent form of opinion testimony by mental health professionals. At the same time, such "nontraditional" expert opinion from clinicians, on those rare occasions when it does occur, has changed over the past few decades in both content …

Gender Types, Self-Esteem, And Academic Achievement In Middle School Students, Kimberly D. Noll Oct 1998

Gender Types, Self-Esteem, And Academic Achievement In Middle School Students, Kimberly D. Noll

Student Work

The relationship among gender typing, self-esteem, and academic achievement was investigated in 314 middle school participants. Participants were administered the Children’s Sex Role Inventory (CSRI) and the Coopersmith Self-Esteem Inventory-School Form (CSEI). The results of the CSRI and CSEI were compared to each participant's score on the California Achievement Test (CAT). Analysis of variance, chi-square, and Pearson product moment correlation's were utilized to assess relationships among the variables. Results indicated that, in the current sample, self-esteem and achievement were unrelated, aschematic characteristics were correlated with high achievement, girls exhibited higher achievement than boys, both boys and girls responded most frequently …

The Effects Of Phonological Awareness Activities On At-Risk First Grade Readers, Kimberly L. Van Belois Oct 1998

The Effects Of Phonological Awareness Activities On At-Risk First Grade Readers, Kimberly L. Van Belois

Masters Theses

The purpose of this study was to look at a variety of phonological awareness studies and their impact on students with reading difficulties and to implement a program to develop student's reading abilities and look at its impact on student's knowledge of vowel and consonant recognition, vowel sounds, and sight words. Phonological awareness can be defined as one's sensitivity to, or explicit awareness of, the phonological structure of words in one's language. A number of researchers (eg., Libennan, Shankweiler, & Liberman, 1989) have concluded that adequate awareness of the phonological structure of words helps to make learning to read words …

Jesus In Film: Hollywood Perspectives On The Jewishness Of Jesus, Adele Reinhartz Oct 1998

Jesus In Film: Hollywood Perspectives On The Jewishness Of Jesus, Adele Reinhartz

Journal of Religion & Film

The purpose of this article is to survey a number of Jesus movies with respect to the portrayal of Jesus' Jewishness. As a New Testament scholar, I am curious to see how these celluloid representations of Jesus compare to academic depictions. For this reason, I begin by presenting briefly three trends in current historical Jesus research that construct Jesus' Jewishness in different ways. As a Jewish New Testament scholar, however, my interest in this question is fuelled by a conviction that the cinematic representations of Jesus both reflect and also affect cultural perceptions of both Jesus and Judaism. My survey …

Men Are Not Angels: The Realpolitik Of Direct Democracy, Eric Lane Oct 1998

Men Are Not Angels: The Realpolitik Of Direct Democracy, Eric Lane

Hofstra Law Faculty Scholarship

My task is to compare the processes of American representative democracy, or deliberative democracy, with those of direct democracy, or direct initiative lawmaking. By direct democracy I mean a form of lawmaking that allows a state's citizens to initiate amendments to statutes or constitutions for public consideration through a referendum. Included within this definition are systems that permit opportunity for legislative action prior to a referendum.

Comparing representative democracy and direct democracy involves more than an a contextual analysis of the steps in each process. Lawmaking processes are the exercise of real power. They regulate behavior, redistribute wealth, and indicate …

The goals of our work have been to enhance the learning environment of our students and to increase the productivity of faculty by freeing them from the drudgery of grading homework and quizzes, as well as the time required to record and compute grades. We have achieved these goals by means of the highly interactive World Wide Web (WWW)-based learning environment provided by MallardTM, 1,2 and by the development of several java applets within the Mallard environment to enhance the learning process. These Java applets are the subject of this paper. They include the ability to draw timing diagrams and …
