The fusion gene CBFB-MYH11 is generated by the chromosome 16 inversion associated with acute myeloid leukemias. This gene encodes a chimeric protein involving the core binding factor β (CBFβ) and the smooth-muscle myosin heavy chain (SMMHC). Mouse model studies suggest that this chimeric protein CBFβ-SMMHC dominantly suppresses the function of CBF, a heterodimeric transcription factor composed of DNA binding subunits (CBFα1 to 3) and a non-DNA binding subunit (CBFβ). This dominant suppression results in the blockage of hematopoiesis in mice and presumably contributes to leukemogenesis. Commercial Speech In The Law Of The European Union: Lessons For The United States?, J. Steven Rich

Federal Communications Law Journal

Both the United States and the countries that comprise the European Union have previously imposed limits on tobacco advertising. These restrictions prevent tobacco companies from advertising on broadcast television. Recently, the European Union adopted a new proposal that would expand restrictions by phasing out press and billboard advertisements, and prohibiting tobacco company sponsorship of sporting events. It seems certain that advertising interests in Europe will challenge the new proposal as a violation of freedom of expression. An analysis of the European Convention on Human Rights reveals that these challenges should ultimately succeed since the restriction on commercial speech is more …

This study compares the Anglican diocese of Carpentaria in northeastern Australia with its Anglican neighbor the diocese of New Guinea. While New Guinea called for sacrifice on a heroic scale as befitted a mission among pure “pagans,” Carpentaria was intended primarily as a church for Europeans. However, the withdrawal of thousands of settlers from the Gulf of Carpentaria country from 1910 to 1942 in the wake of recurrent cyclones, economic depression, and drought led to wholesale white depopulation. This depopulation, added to the Anglicans’ acceptance of the London Missionary Society’s sphere in the Torres Strait Islands, left Carpentaria overwhelmingly Islander …

In the past decade nationalism has been conceptualized as a cultural artifact, a product of invention and social engineering. Yet despite the flourishing interest in questions of national identity, we still have no theory explaining the reasons why nationalism presents itself in a manifold diversity of forms and aspirations. One way of . accounting for the malleability of modern nationalism is to approach it as a product of dialectical interactions between various national ideals. In this respect, the case of Romanian nationalism is particularly instructive. Distinctive capabilities are founded upon Resource-Based Theory (Barney 1991) that focuses on internal resources as opposed to external market forces (Porter 1980). The present research discusses the integration of distinctive capabilities into this framework; that is, do certain distinctive capabilities (resources) create superior firm performance when linked to the appropriate generic business strategy?

The explosive growth of electronic commerce raises serious questions about the viability of the current state sales and use tax system. Sales via the Internet and other electronic means are changing both the form and substance of consumer transactions, and such sales often do not satisfy the traditional nexus requirement for state taxation because on-line vendors frequently lack physical presence in the purchaser’s home state. The inability to collect taxes on this growing segment of the retail sales market will impair states’ efforts to raise revenues and cause economically similar transactions to be treated differently. The Digital Millennium Copyright Act (DMCA)1 was signed into law by President Clinton on October 28, 1998. The legislation implements two 1996 World Intellectual Property Organization (WIPO) treaties: the WIPO Copyright Treaty and the WIPO Performances and Phonograms Treaty. The DMCA also addresses a number of other significant copyright-related issues.

The DMCA is divided into five titles:

Title I, the “WIPO Copyright and Performances and Phonograms Treaties Implementation Act of 1998,” implements the WIPO treaties.

Title II, the “Online Copyright Infringement Liability Limitation Act,” creates limitations on the liability of online service providers for copyright infringement when engaging in certain …

The survey period saw a large number of cases raising significant evidentiary issues. Two areas in particular should be noted and are discussed in detail below. First, criminal lawyers should be aware of the supreme court's reinterpretation of Cuzzort v. State, a landmark decision creating a broad exception to the hearsay rule for prior consistent statements. Second, all trial lawyers should be aware that the court of appeals continues to flirt with the idea of requiring parties to tender expert witnesses to the court for certification that they are, in fact, qualified to render expert testimony. It was my bright idea to take the plaintiff's deposition at his home. My timing was impeccable. The most notable and far-reaching judicial activity during this survey period dealt with the summary judgment standard applied in tort cases. Other noteworthy developments occurred in the areas of venue, renewal of actions, collateral estoppel, and bifurcation of trials in cases involving punitive damages. Only minimal legislation was enacted in the area of trial practice and procedure during the survey period. This Article focuses on the most notable decisions rendered by the judiciary and the most significant legislation touching upon trial practice and procedure in Georgia state courts.

The National Catholic Educational Association (1998) reports that 13.6% or 359,146, of all students in Catholic elementary, middle, and secondary schools are non-Catholic, manifesting the importance of educating Catholic school students to understand and appreciate the diversity of cultures and religions other than their own. This article examines some ways that Catholic schools can educate students about the Jewish Holocaust, or Shoah, and through its study embrace a truly Catholic approach.

The analysis described in this study is focused on the influence of religious ethics over individuals' tendency to seek top-managerial positions in their professional activity. The analysis assumes agents maximize utility. According to religious doctrines, afterlife salvation is a goal which could be accomplished only by following certain prescribed behavioural norms. Hurricane Bob, a category 3 storm, made landfall on Cape Cod in August 1991, and its effects on watersheds and adjoining estuaries were detected in the ongoing studies being caried out as part of the Waquoit Bay Land Margin Ecosystems Research project. On land, Bob had only minor overall effects on forests; localized wind bursts did snap and break trees in small and widely scattered forest parcels. Wind stripped up to half the leaves of deciduous trees and many herbaceous plants on the watershed, and most remaining leaves were damaged by salt, so that by the end of Aug, Cape …
