Children's Rights And Family Autonomy In The South African Context: A Comment On Children's Rights Under The Final Constitution, Tshepo L. Mosikatsana

Michigan Journal of Race and Law

This Article investigates the nature and extent of the protection granted to children's rights in the South African Constitution. It concludes that the child-centered approach of the Constitution entitles children, as independent actors, to certain fundamental rights. Acknowledging both the parent-centered nature of the existing South African legal framework and the entrenched support for practices, many rooted in indigenous law and tradition, that contribute to the oppression of children, the author argues that the constitutionalization of these rights will contribute to the betterment of children in South Africa, proving to be more than mere moral exhortation. Predicting The Effect Of Italy's Long-Awaited Rape Law Reform On "The Land Of Machismo", Amy J. Everhart

Vanderbilt Journal of Transnational Law

In 1996, the Italian Parliament enacted a new rape law, replacing a law written in 1936 under the direction of Fascist-era leader Benito Mussolini. While the old law classified rape as a crime against public morality, the new law declares it a crime against the person. That it took sixty years to reform the law is a reflection of Italy's long history of subordinating its women. That the law has finally been reformed is a reflection that those women have united to change that attitude. This Note discusses the history of the rape law in Italy and the role of …

This article analyzes current proposals to regulate gambling on the Internet and suggests that their flaws stem primarily from a failure to appreciate the complexity of the vice/economic gain dichotomy that has been incorporated in American gambling regulatory policy. Americans have historically prohibited some forms of gambling while tolerating others. An Internet gambling regulatory system should view the Internet as a medium across which current gambling policies should be extended. Regimes that legalize all forms of gambling on the Internet are politically untenable and unwise. Thoughts From Across The Water On Hearsay And Confrontation, Richard D. Friedman

This article draws on the history of the hearsay rule, and on recent decisions of the European Court of Human Rights, to argue that the right to confrontation should be recognised as a basic principle of the law of evidence, and that aspects of the Law Commission's proposals for reform of the hearsay rule, and of the Home Office's proposals for restrictions on the right of cross-examination, are therefore unsatisfactory.

Now that the U.S. Supreme Court has upheld New York and Washington state laws prohibiting the aiding of another to commit suicide,2 the spotlight will shift to the state courts, the state legislatures and state referenda. And once again proponents of physician-assisted suicide (PAS) will point to a heartwrenching case, perhaps the relatively rare case where a dying person is experiencing unavoidable pain (i.e., pain that not even the most skilled palliative care experts are able to mitigate), and ask: What would you want done to you if you were in this person's shoes?

This guidebook is a resource for health care providers who seek training in the areas of intimate partner violence and sexual assault. The authors describe 36 sets of training materials designed to show health care providers how to treat cases of domestic violence and sexual assault. The materials described include manuals, videos, scripted lectures with slides, information packets and handbooks. Most of these materials can be used for individual study or as part of the curriculum for staff training by a health care organization (e.g. hospital). Despite a new emphasis on tourism and the resulting victimization of travelers to the "artificial environments," such as those offered in Las Vegas and Orlando, little empirical research has been conducted to estimate the extent to which the traveler is victimized when in these different areas. Research reported in this paper is a result of a survey of travelers who were victimized in Southern Nevada, Clark County, during the summer of 1996; Information was gathered from questions which were asked on the survey and combined with data on the victim, which was taken off the victims' original crime reports. This thesis explores the nature and extent of the print media's coverage of jury trials. A content analysis was conducted on the Los Angeles Times from 1973 to 1995, examining both overall trends in jury coverage and the extent and nature of that coverage before and after several high-profile jury trials. The findings of the content analysis validated the belief that the print media, by and large, provides to the public what the public is most interested in reading about. That interest, is unpredictable at best. It fluctuates from criminal trials of celebrities, to the sexual past of the President …

Minority over-representation in the juvenile justice system is a national concern. Research in this area is limited, however, there is indication that minority over-representation, particularly of African-American youth, seems to occur at various stages of juvenile justice processing. It is my belief that once arrested, minority youth are more likely to be certified as an adult than white youth. This paper examines the certification process in Clark County, Nevada, by studying a random sample of 200 cases. The results suggest that this theory holds true. The labeling perspective offers the best explanation of disparate treatment of African-American youth. Discrimination has …

Harvey Forbes Fierstein has become an important influence in the gay community. His first major play, Torch Song Trilogy, was a major milestone for gay theatre. By becoming the first gay play to be commercially successful, it launched Fierstein into the spotlight. Since his first major Broadway play, he has continued to be active as playwright, actor, and gay rights activist; This paper places two of Fierstein's major plays within the context of gay liberation history and gay theatre history. The effect of judge’s instructions and jurors’ preconceptions about children’s credibility on juror decision making and post-trial perceptions of children’s credibility was investigated. Also, the relationship between jurors’ post-trial perceptions of children’s credibility and measure of guilt was explored. Jurors’ level of authoritarianism was utilized as a covariate and jurors’ comprehension of the judge’s instructions was considered as a possible mediating influence on their decision making. One hundred and twenty five undergraduate women enrolled in psychology classes at Eastern Illinois University viewed a videotaped simulation of a child sexual assault trial.
