"Batson" For The Bench? Regulating The Peremptory Challenge Of Judges, Nancy J. King

The choice of whether to adopt or preserve judicial peremptories should not turn on the resolution of one issue. The risk that such challenges will be used to discriminate between judges on the basis of race must be considered along with the other disadvantages of the challenge and weighed against its potential benefits. Nevertheless, if there is one lesson to be learned from the last few decades of scrutiny of the criminal justice system, it is that discretion can and will be used to discriminate. Mandatory Indeterminate Sentences Under Dangerous Offender Legislation, Jennifer J. Soward

On September 17, 1996, Allan Rock, Minister of Justice and Attorney General of Canada, and Herb Grey, Solicitor General of Canada, announced "tough new measures" to deal with dangerous offenders. These measures were introduced in Bill C-55, which received Royal Assent on April 15, 1997. The following comment focuses on only one significant change to the dangerous offender legislation. As part of these measures, the new section 753(4) of the Criminal Code removes a judge's discretion to award a determinate sentence once an accused is found to be a dangerous offender. Among the puzzling aspects of the Breard episode was the Clinton administration's claim that the decision whether or not to comply with the Order of the International Court of Justice requiring the postponement of Breard's execution lay exclusively in the hands of the Governor of Virginia. The ICJ's Order provided that"[t]he United States should take all measures at its disposal to ensure that Angel Francisco Breard is not executed pending the final decision in these proceedings." As a teacher in a criminal practice-based clinic, I often feel like an eavesdropper on the discourse among clinicians about lawyering skills and professional values. Both the context of, and the language describing, criminal law practice, are sufficiently different from civil practice to make it difficult to teach many of the lessons and approaches developed in traditional texts used in clinical education, particularly those concerned with client-counseling. The Catholic Church's opposition to the death penalty places Catholic judges in a moral and legal bind. While these judges are obliged by oath, professional commitment, and the demands of citizenship to enforce the death penalty, they are also obliged to adhere to their church's teaching on moral matters. Although the legal system has a solution for this dilemma by allowing the recusal of judges whose convictions keep them from doing their job, Catholic judges will want to sit whenever possible without acting immorally. It is costly to train the counselors who serve in intensive Family Preservation Services (IFPS). The hiring agency must pay for traveling expenses in addition to any fee paid for training. When an IFPS worker chooses to terminate employment before the end of two years of employment, this puts a strain on an already tight budget. This problem could be alleviated by finding an efficient pre-hire screening instrument. The three personality traits described in Hardiness Theory literature: commitment, challenge, and control, are traits often used to describe the ideal IFPS worker. Conceptualizing The Impact Of Health Care Crimes On The Poor, Brian K. Payne

Sociology & Criminal Justice Faculty Publications

Past research shows that a small percentage of health care employees commit an assortment of criminal acts while on the job. Missing from previous research, however, is an examination of the effects such acts have on the poor (i.e. the victims). This paper fills this void by considering the effects of three broadly defined health care crimes: Medicaid fraud, elder abuse, and prescription fraud. In addition to the direct victimization experiences of those served by me health care system, the physical, economic, and time losses are also considered. Implications for future research and policy are provided.

Grandparents Today: A Demographic Profile, Maximiliane E. Szinovacz

This article presents a demographic profile of grandparents, using the National Survey of Families and Households. Specific dimensions of grandparenthood addressed include grandparents' survival, the timing of grandparenthood, grandparents' involvement in other roles, surrogate parenting, and stepgrandparents. The data indicate considerable heterogeneity among grandparents of different genders and races or ethnicities. They also suggest modifications in previous descriptions of modern grandparenthood.

The Violence Against Women Act Of 1994: Connecting Gender-Motivated Violence To Interstate Commerce, Judi L. Lemos

This Comment explores whether the Supreme Court will grant certiorari in the Brzonkala v. Virginia Polytech and State University, and whether the Court will uphold the Violence Against Women Act (VAWA) as a constitutional use of the commerce power. Part I explains the provisions of VAWA. Part II scrutinizes the development of Commerce Clause jurisprudence, which culminated in the Lopez decision. Part III analyzes the panel's Fourth Circuit ruling in Brzonkala. Part IV reviews the Supreme Court's handling of post-Lopez Commerce Clause cases and discusses whether the Court will grant certiorari to a challenge of VAWA's constitutionality. …

Iowa Journal of Communication

There is no singular method of immediately and permanently dispensing with anxiety about public communication. The pedagogical strategies described in this thought piece, however, when used in a receptive environment and combined with the essentials of public speaking training can, given time, help students appreciate the thrill of public speaking. In my experience, individual attention outside of class and constructive group criticism during class do much to ease highly apprehensive students. This narrative contains my reflections on working with just such a group.

In recent years, attacks upon the adversary system have been unprecedented in their breadth and intensity, and at times have been "scathing [and] venomous." For example, at a conference of twenty-five of the country's "professional elite" (most of them lawyers and judges) the adversary system was "thoroughly savaged." Efforts by the conferees to produce an acceptable alternative to the adversary system ended unsuccessfully on a "note of resignation.

"Mental Pictures And Emotional Intimacy: A Theoretical Explanation For The Sexual Sadistic Serial Murder's Heterosexual Lifestyle", John E. Holman

Clinical Sociology Review

This paper develops a theoretical explanation for the sexual sadistic serial murderer's heterosexual lifestyle. The theoretical formulation developed draws upon Glasser's (1984) control theory and Marshal's (1989) general theory of sexual offending. It synthesizes Glasser's propositions around idealized life style and mental pictures and Marshal's propositions on intimacy. The theoretical formulation developed focuses on the mental and behavioral contradictions implicit in the life of this type of offender. The paper concludes by comparing these lifestyles to those of homosexuals in similar heterosexual lifestyles.
