Modernity And The Satanic Face Of God, Michael J. Buckley S.J. Jan 1998

Modernity And The Satanic Face Of God, Michael J. Buckley S.J.

Religious Studies

The religious intellect must recognize that in the nineteenth century it confronts a unique situation, unprecedented both in the depth of its challenge and in the extension of its claims. During that period, the denial of the reality of God rose to achieve an articulate and influential presence within the intellectual culture of western Europe. This denial was no longer the persuasion of this or that idiosyncratic figure such as Diagoras of Melos or Theodore of Cyrene in preChristian antiquity; nor did it constitute the mentality of a peculiarly enlightened cast such as the d'Holbachian circle in Paris in the …

A Brief Return To The Digital Sampling Debate, Matthew G. Passmore Jan 1998

A Brief Return To The Digital Sampling Debate, Matthew G. Passmore

UC Law SF Communications and Entertainment Journal

This note revisits the problem of digital sampling by musicians and the copyright law issues that arise from it. After briefly surveying the historical and technical aspects of digital sampling, the note asks the question: "are transformative digital samples art?" and answers in the affirmative. The note then looks at the goals and doctrine of copyright law, and how they are implicated by the digital sampling problem. Finally, the note advocates an expanded interpretation of the fair use copyright defense in digital sampling cases, arguing that such an expansion would both effectuate the goal of copyright enforcement and recognize the …

No. 04: Silenced By Nation-Building: African Immigrants And Language Policy In The New South Africa, Maxine Reitzes, Nigel Crawhall Jan 1998

No. 04: Silenced By Nation-Building: African Immigrants And Language Policy In The New South Africa, Maxine Reitzes, Nigel Crawhall

Southern African Migration Programme

All people in South Africa have constitutionallyguaranteed language rights. To what extent do these rights apply to non-citizens and are they actually observed by various state departments and officials? This report presents the results of a preliminary investigation into this question by focusing on the rights and treatment of foreigners in South Africa, particularly foreigners from other African countries.

The report was commissioned by the Southern African Migration Project (SAMP) as part of a broader programme to understand the reception and treatment of non-South Africans in the new South Africa. Our aim, as authors, is to encourage government departments and …

Poststructural Analysis Of The Power And Class Behind The Formalistic Application Of Erisa Preemption Of State Law, Erik Nelson Jan 1998

Poststructural Analysis Of The Power And Class Behind The Formalistic Application Of Erisa Preemption Of State Law, Erik Nelson

St. Thomas Law Review

This comment presents a poststructural approach to the current formulation of the Employment Retirement Income Security Act (ERISA) of 1974. Part I details the context in which Congress created federal protection for ERISA beneficiaries. Part II illustrates how the judiciary wavered in its broad preemptive construction of ERISA before ultimately privileging a construction of ERISA which denied ERISA beneficiaries extracontractual and punitive damages. Part III will examine deconstruction and its impact on the jurisprudence of the federal courts. Part IV embarks on a deconstructionist analysis of the "relates to" preemptive provision of ERISA to reveal that the only rationality to …

Biblical Hermeneutics And Hebraism In The Early Seventeenth Century As Reflected In The Work Of John Weemse (1579-1636), Jai Sung Shim Jan 1998

Biblical Hermeneutics And Hebraism In The Early Seventeenth Century As Reflected In The Work Of John Weemse (1579-1636), Jai Sung Shim

CTS PhD Doctoral Dissertations

This dissertation presents a contextual and historical understanding of hermeneutics and exegesis in the early seventeenth century, in the form of a study of the biblical exegete and Hebraist, John Weemse of Lathocker and Prebend of Durham. This study argues both for the continuity of early seventeenth-century biblical exegesis with Reformation exegesis and for the progress of Protestant exegesis after the Reformation. In substantial similarity to the Reformers with regard to the doctrine of Scripture and to exegetical principles, the foundation of Weemse's exegesis was reading Scripture in its original languages. He enriched his efforts through grammatical and textual studies …

Disease And Water Supply: The Case Of Cholera In 19th Century Iran, Amir A. Afkhami

Medicine Faculty Publications

This paper explores why Iran was a particularly fertile ground for repeated visitation of cholera in the 19th century. Along with certain unique Iranian cultural and religious factors, the author demonstrates how Iranian urban ecology, particularly the qanat system, contributed to the fatal spread of the epidemic. These multi-faceted conditions, the author concludes, resulted in distinct modes of disease transmission and mortality in Iran.

Between The Field And The Museum: The Benedict Collection Of Bagobo Abaca Ikat Textiles, Cherubim A. Quizon Jan 1998

Between The Field And The Museum: The Benedict Collection Of Bagobo Abaca Ikat Textiles, Cherubim A. Quizon

Textile Society of America: Symposium Proceedings

Any researcher working on vintage textiles and clothing from the Philippines collected during the early years of the American colonial period is likely to encounter the following informative catalogue entries: "From headhunters," or "From chiefs attire." Since the Bagobo people of southern Mindanao were also once famous for the practice of human sacrifice, the cloth, weaponry and ornament of these people were of high anecdotal value for collectors.

By contrast, a typical entry in the Bagobo textile collection of Laura Watson Benedict in this museum, the American Museum of Natural History (AMNH), circa 1910 reads: "Woven by Antap [who specializes …

Ngoc Efforts Towards The Creation Of A Regional Human Rights Arrangement In The Asia-Pacific Region, Ali Mohsin Qazilbash

ILSA Journal of International & Comparative Law

I feel honored to be given an opportunity to speak at this panel on an issue which has a lot to do with a part of the world I belong to. NGOs in Asia and the Pacific have been crucial to the struggle for a regional human rights arrangement. Indeed it is they who have kept both the debate over and the struggle for an Asian human rights system alive.

Creating And Conducting In-Class Simulations In Public International Law: A Producer's Guide, Andrew L. Strauss Jan 1998

Creating And Conducting In-Class Simulations In Public International Law: A Producer's Guide, Andrew L. Strauss

ILSA Journal of International & Comparative Law

I define an in-class simulation as any classroom exercise that attempts to depict real-life events. Simulations can be extremely elaborate attempts to enact complex proceedings, or they can be as simple as having two students spontaneously represent lawyers making opposing arguments during class discussion.

A Poetry Curriculum For Primary Teachers, Janice M. Matheny Jan 1998

A Poetry Curriculum For Primary Teachers, Janice M. Matheny

All Graduate Projects

This project examined the role of poetry in language development and literacy acquisition in children. The review of current literature strongly supported the rationale for providing poetry experiences beginning at an early age and continuing on through the first few years of school. All stages of language development benefit from exposure to rhythm and rhyme. Poetry can be there to bridge the gap as young children speak their first words, read their first book and write their first sentence. Included is a poetry curriculum centering on the theme of Playground Rhymes. It was specifically written for primary teachers. The research …

Multiple Intelligence Theory And Its Application In Modern Vocal Pedagogy, Robb Dennis Jan 1998

Multiple Intelligence Theory And Its Application In Modern Vocal Pedagogy, Robb Dennis

CGU Theses & Dissertations

In 1983, Howard Gardner shook the foundations of intelligence testing and the field of education by suggesting that there are seven distinct intelligences. These intelligences had testable and distinct attributes that were supported by his research at the Boston Veterans Administration. This research cited the existence of savants and prodigies, isolation by brain damage, and psychometric findings as support for Multiple Intelligence Theory. Widely accepted by the education community at large, the application of MI principles has been further elaborated in the writings of Thomas Armstrong and David Lazear. Can the principles of Multiple Intelligence Theory be applied in the …

Phonetic Skills And Vocabulary Size In Late Talkers: Concurrent And Predictive Relationships, Jennifer Mirak, Leslie Rescorla Jan 1998

Phonetic Skills And Vocabulary Size In Late Talkers: Concurrent And Predictive Relationships, Jennifer Mirak, Leslie Rescorla

Psychology Faculty Research and Scholarship

Phonetic skills and vocabulary size were investigated in 37 toddlers (24 to 31 months) identified with specific expressive language impairment and 20 comparison toddlers matched on age, SES, and nonverbal ability. The use of consonants was highly consistent across two contexts: 20 minutes of structured testing and 5 minutes of free play. The comparison children produced almost triple the number of consonant types and five times as many consonant tokens as the late talkers. However, the most frequently present consonants were similar across groups, indicating delayed rather than deviant phonetic development in the late talkers. The late talkers used a …
